Cannot cancel a contract signed by a minor

My 17 year-old daughter and her friends went to Bally Fitness Center. They had trial pass with them, but the employee talked them into signing a contract. When she said that she is only 17 and will be 18 in a few months, the employee changed her date of birth in the contract and said is not a problem.

When I discovered they signed the papers, I contacted the corporate office and requested that her membership with Bally Fitness Center be canceled because it was signed by a minor without parent's approval.

They responded that the contract will be canceled as soon as they have a copy of her birth certificate. I promptly sent the documents via registered mail. At the time we already started getting non-payment notices from Bally Fitness Center.

The calls from collection agency stopped for a few months but resumed again a month ago. We assumed that the contract has been canceled but apparently it was not.

I am not sure what to do as I already contacted our local attorney general, the corporate office, and FTC. They use deceptive practices to get people into signing a contract and I only hope that other people who read this will be aware of the way they conduct business.

    Next time, We have to be smart. During our conversation with Ballys stuffs we should bring tape recorder and record the conversation. Then only they can't said do you have a proved that our people said that? They always point with their contract that we signed

    YOU HAVE AN OPTION TO FREEZE YOUR CONTRACT AT A LOWER RATE THEN THE MONTHLY FEE. IF YOU HAVE A CONTRACT. AND ARE PAYING BY CHECK, ONLY SEND $10.00 PER MONTH WITH A LETTER TO FREEZE YOUR ACCOUNT. YOU STILL HAVE TO PAY BUT ONLY 10 A MONTH. IF YOU PAID BY CREDIT CARD CALL YOUR CREDIT CARD COMPANY AND TELL THEM NOT TO LET BALLY TAKE MONEY FROM YOU,  IF THEY ARE TAKING MONEY FROM YOUR CHECKING CALL YOUR BANK AND TELL THEM NOT TO LET BALLY TAKE ANY MORE OF YOUR MONEY. IF YOUR ARE UNDER 18 YOU CAN PROBABLY GET YOUR MONEY BACK.

    sent two messages a day to ballys website.  went to contact us, they make you fill out form name address if member blah blah.  put membership number and told them cancel that and electronic fund tranfers make it simple.  received email from them canceling the contract went to bank and stopped payment each month. make copies of everything because they can bite you in the butt later if you dont keep info

But they could refund and redo another.  I asked for a confirmation that I was getting my refund. They said they could not provide that for me. "

    They just set you up for later fraudulently claiming you had never cancelled and still owed on the contract they have now "confiscated".  They have now taken away access to the contract terms that would allow you to find out how to verifiably cancel (probably by registered mail to some address), with nothing in writing from them to indicate a cancellation ever happened.

    You are one step away from being screwed.

    I was called concerning a free 1 year memorship. so i go into the fitness center i get there and they inform me that i did not win 1 year but i won a few months and just had to pay one small fee.I had 4 people in the office all talking to me at once rushing me thrugh everything so I sign thinking that im getting a few free months and 2 times with a personal trainer all for one low price. I told them i did not wanto to be a member. So they told me it would be a trial run with them if i liked it I could become a memeber. So yea I signed. I was definitly tricked. I went one time and then never had the time to go back again. Then after these months are over. I thought i was not a memeber so therefore I signed on with another gym. I then finally got the time to look at my bank history and realize that I was charged 70 from ballys. So i thought maybe this is a misunderstanding with me and the company. I then called them and they told me I was on a 2 year contract. I told them I then need to cancel it. They told me to call there franchise office in california. I then called them, and they told me I cant cancel I then proceede to tell them how I was decived and tricked. And they said well your signed a contract and you therefore can not get out of it inless i move far enought from there facility or I give them a doctors note saying I cant work out. So i asked to speak to a supervisor The supervisor was even ruder and told me that i had to go back to my bally and tell them i wanted to cancel. Where I was just at. They continued to send me back and forth calling both. Both telling me to call the other. I call the one in baton rouge and they tell me they have to get my cotract and they will call me back in a week. Why should i have to wait a week for them to find a contract to tell me what that i signed it again. This is ridiculus. and every time i call now some how the managers always seem to be on break or with a customer. this is bull. They also told me i could transfer my contract to another person ans it would then be there contract. Now im afraid to bc im afraid then me and my friend will both b in a contract then both not being able to get out. I waas thinking to send it to my friend bc he is in the army. And the army is supposed to be able to get out of contracts if they r deploid but i read early. that a military person could not even get out there contract bc they never got back to the person. What do I do? HELP?

    heyy I have the same experience with bally did you do anything about it , cz im sick of paying every month without even goin there . if u have any response plz reply as soon as you can !

    After a year contracted membership I also tried to cancel.  I had to send letter to a corporate address in CA. It was mailed certified so when I got notification that it was delivered I was also notified that it was forwarded to another address,unknown.  This was Mar. & it it now Aug. & they are still billing me.  My attempts to call have been difficult, with claims that my ID # was invalid, etc.  Finally called back to Bergen cty Bally's & after heated exchange with manager, got another number.  That number did get me a person but was told I would b charged $10. This person claimed there was no Fax, to mail in a copy of my letter again plus the certified tracking # of the 1st letter.  Right now I'm in process of doing this.  All I can say is this is a scam!!!  Be alerted that this business will use every attempt to thwart cancellation of membership. I'm contacting CA & NJ consumer protection agencies.  I'm sure others have similar horror stories.

    Bally's sucks - I have recieved my first phone call today about a $1600 balance from 2004. All I can say is "Here we go!!". I, too, had cancelled the contract due to relocation. What I never knew, or at least remembered, is that this was a loan that I was repaying from jump for membership. Reading through several blogs now - it's amazing how stupid we all are to fall for that. I only remember the smoothie bar and how there were never any close parking spots. HA! $1600 for, I would guess around five visits. What a business!! Seven years later, Planet Fitness seems to be ok so far. "I pick things up and put them down" right? Any way - seeing that the last post was 2010 - I am probably just venting to myself. Sweet

    well for me i was so extided that i reached the 3 years on Dec 10' but in January they kept withdrew money so i called there like u need to write a letter so we can cancel ur account OMG!!

    Your statement just FURTHER proves why no human being alive should ever step foot in a Bally's Total Fitness facility.  We have had nothing but problem after problem with Bally's.  When my husband and I first signed up the "sales" associate commited fraud by opening up three additional accounts in my husbands name.  How did we find this out?  When we started receiving collection calls on accounts when we told them we have two accounts and are set up on EFT withdrawals every month so how could we owe?? We checked his credit and sure enough there were the accounts that we opened up without OUR KNOWLEDGE!  We had to send letter after letter (certified of course) in order to get this off of his credit and threaten legal action.  The only reason we even stayed with Bally's after this was because of the Hapkido martial arts program that was offered.  Everything was okay and then I became pregnant.  We never stopped our EFT's and I always called to update my card information once it was about to expire and guess what?  All of a sudden the payments for my account stopped being debited, why?  I have NO IDEA!  I received a call from the collections department and told him I'm pregnant can I freeze or hold my account and he told me NO! I asked him why my payments were stopped in the first place and he had no answer, I told him I was never sent anything in the mail and I tried to make payment online and I found it funny that it said my membership had $0 due and that my enrollment date was defaulted to 01/01/1900, really?  I had been a member since 1900?  I don't think it should be my responsibility to keep calling and trying to fix the situation when Bally's had everything they needed to get their money from me.  The collection's department messed up by "BREACHING THE CONTRACT" by telling me that after being a member for over four years I was not able to freeze my account.  The last straw was when I went to work out and brought my 18 month old to the daycare center and the lady in there said it was too full and I should have "called her" and told her I was coming because it was "peak hours"????????????  Excuse me where does it say I have to call and for a BUSY club located in Houston why wouldn't there already be more than 1 employee in there to handle 15 kids?????????? Come on now Bally's!  

    Jenna you coming on this complaint forum and using the language that you have used just further fuels the incompitancy that operates Bally's on a daily basis.  This club is full of steroid using uneducated staff and I am GLAD that I switched to Lifetime Fitness!!!!!  I am also paying an extra $100 MORE a MONTH AND I DON'T MIND IT!  We are treated fabulously there, Bally's you can kiss my A**, as your employee Jenna would say.

    Are you still working for Bally's? I'd be careful what you say on here if you are indeed representing the company because it can bite you in [***] if there were legal action taken against the company.

    Bally's make it hard to cancel the membership.  They drag as much time as possible so they can collect more money.  I could not cancel the membership through the phone as what they told me when I signed up the membership.  To officially cancel the membership I will have to send them a written authorization to a P.O. Box in Washington D.C.  I am just wondering how come the things I have been told before I signed the contract versus the real information I received when I am actually trying to cancel the membership are different.

    i called to make payment arrangements for the amount due and they told me the account was closed out. Here it is a year later and they are saying I still owe them money?? how does that consistently happen to a lot of people with Bally Memberships? something is obviously flawed/illegal that theyre doing with these contracts
