I need to pay a 100$ every two weeks and since I agreed then they said theyll file a report against me and take me to jail

      Carey, just a piece of advice. Do not provide your personal information such as your email on a public forum as it allows predators or scammers to contact you. People on this post can assist your by replying to your post. You must be careful when putting your information out on the internet.

    Do not agree to pay RJ Capital anything. They have purchased your information from somewhere and make their money collecting from people who become intimidated by them. They are breaking a FEDERAL law by threatening anyone, they through in a couple of legal sounding phrases in order to get you to pay money. Indicate they are to CEASE and DESIST calling you at your job, your family members and you and that you are recording all their calls and you have instructed everyone else to do so who they call as this is deemed harassment, they can NOT call you at your place of employment if you have indicated to them you can not receive such calls. Do NOT provide them with any additional information. Indicate that you are consulting with a legal advisor and that you wish for whatever debt they are speaking of to be sent to you in writing which is your right. If they can not send you something in writing, then how would they be able to present a case against you in court?  

    Regardless, bad debt or debt period is NOT a criminal offense, you can not and will not be arrested. The most any creditor can do is take you to court and even with that, you have a right to dispute the amount if it is not accurate if it is LEGITIMATE.

    RJ Capital makes its money by intimidating people, the average law abiding person does not know that these people are NOT allowed to threaten you.

    You have rights whether you have bad debt or not, please read the Fair Debt Collection Act so you will know your rights. Do not let yourself be scammed, times are hard enough as it is...and what these people are doing are victimizing people who may have fallen on difficult times or people who simply do not know their rights...

    As a follow up to my previous posts, I am advising anyone who has been targeted by unfair and threatening collection attempts whether it is a legitimate debt where you got behind or whether it is bogus to go to the Federal Trade Commission website and do a little research before agreeing to anything, providing any information or paying anything. There are people being taken advantage of or being unfairly harassed while going through hard times by predators Debt BUYERS like RJ Capital.  As I stated in my earlier post, you have a right to receive any claims of debt in writing!  Please research the information at the FTC and file a complaint against any company which exhibits threatening or harassing behavior towards you or discloses information about your debt to someone other then you.

      They called me today and said that I will be served at my job by the end of day or by Monday.. Will they really serve me?? They say it's from a defaulted payday loan.  They've callu job and stated that they will have to fax papers to my job saying I'm being charged with check fraud wcause I work with consumers is that true?  Someone

        If they were going to serve you a summons on a lawsuit, why would they also be threatening you with check fraud?

        And why would they be threatening to disclose all this to a third party, your employer, rather than relying on the outcome of a court proceeding (a lawsuit) to collect what they claim you owe?

        Both actions, and even threatening them, are illegal and violate FDCPA.  You can sue them for just threatening.

        Their threats suggest they have no intention on relying on any lawsuit to get money from you.  Otherwise, there would be no reason for them to make them, and risk getting sued.

        That suggests they are lying about this "lawsuit" from the beginning, and maybe about whether any "debt" is owed to them as well.

        Legitimate debt collectors comply with the law.  In particular, they don't make threats they don't intend to, or can't, carry out. Within 5 days the send a letter notifying you of the alleged debt, and of your right to dispute it, as required by law (FDCPA).

        Debt collectors who fail ro comply with the law are running scams.

    I actually did not receive any calls from this company, but 'Brad Sutton", from RJA Capital has managed to leave messages about me with just about all my friends and family, not sure how he got their phone numbers, but he did. I called him this morning to find out who he was, and why he was looking for me, the call back number he left is: 607-231-8060...He has got to be the most unprofessional person I have ever came across, screaming at me, threatening me..I explained to him that I honestly had no idea about any of the information he was trying to give me, and to please send me some information by mail, and mentioned my rights under the FDCPA, I think that is what set him off, he proceeded to scream over me, not letting me speak at all, and basically told me that the sheriff would be contacting me, and good luck. If "Brad", and "RJA Capital" was legitimate, they would not need to use threats to intimidate people into paying them, and they would have absolutely no problem sending the information by mail. I am 100% sure that I don't owe any outstanding debt, and I have not written any "bad checks" as he tried to claim.
    Is this guy for real?? I'm sure he "scares" a lot of people to paying him, but seriously?? How could anyone really think this guy, and this company is for real??

      The only thing that set him off was you didn't act all timid and scared and just hand over your credit card number so he could take whatever he wanted to.

      Illegal third party disclosure appears to be just part of his standard M.O.  That pattern runs through many complaints against this company, along with reports of threats against people to collect unowed debt.

      They are not collecting based on real "debt", but based on illegal harassment and threats to embarass.  That is simply extortion.

      File complaints with FTC, your state AG, the New York AG, and the Buffalo office of the FBI.
