How do I get Bank of America/BAC to stop calling me 3 to 4 times a day to ask me when I am sending my payment in that is NOT LATE?  Can I file a complaint somewhere?  Is it legal for them to call me if my payment is not late?

    File complaints with FTC for phone harassment, and with the Office of the Comptroller of the Currency, for attempting to use phone harassment to violate the terms of your mortgage.

    You might also contact the new Consumer Financial Protection Bureau to vile a complaint.

    Forward copies of your complaints to BofA's executive offices and demand they cease harassing you over on-time payments.

      wont help BOA is controlled by no one, Im going thru hell with them for 10 months  they say we can take your husbands off the loan and put mine on it

    The other vulnerability for large corporations engaged in idiocy is embarassment through local TV consumer reports.

    One part of the company may be running on autopilot harassing their customers, but another part of the company is charged with selling and maintaining their customer image and brand.  This usually gets you to high level corporate VP level responses quickly, and has worked in a number of cases of problems with BofA.

    Contact a consumer reporter at your largest area TV station.

      Please go to consumerfinance.gov and fill out a complaint. I received  help in less than 24 hours!

    BOA collections keeps calling me telling me I owe fees of over 150.  I'm current on my mortgage and always pay by the 2nd, but this month when I didn't pay by the 5th, they have been calling 3 times a day.  I told them I will pay on the 15th, one day before late fees are charged, and will do this from now on.  They keep calling.  I'm having my calls forwarded to CEO Brian Moynihan (781) 235-1004.

      BRILLIANT!!  if you have savings take it out. if you have a checking account close it. if you are underwater with your mortgage but making your payments get them to modify.  if they don't, you consider walking away.  If you don't walk away it is because you are happy there and finding something better is not worth your trouble. Cash is still king.  Gold gets more valuable everyday. Silver is more attainable.  diversify. finally,  To get bofa to stop calling if you have already begun talking to them by phone,  you must tell them verbally and in writing to stop calling all the numbers they have for you and to contact you further with regards to any account by mail.   Or they won't stop calling.  paying later than you normally do is what is making them nervous and triggering your name to be on a a call list. so who are you driving crazy? them or you?  know why they are calling if you pay on time. because everything is automated including knowing when a customer is falling behind or could become delinquent by signs outside of what is normal, like paying 1 day late.

    Normal banks don't call and harass you if you are not past the late fee date.

    Sounds like something Countrywide would have done.
    What is this, an old Countrywide loan?

    They make more money if they can intimidate you into paying earlier.

      My is an old Countrywide Jumbo ARM loan that I'm paying. Wanted to get out of this program but because I had a short sale 3 years ago (also with BoA), I cannot qualify for remodication, so I was told by Quicken Loans.

    I hate BOA. Even though your payment grace period is the 15th of the month they start calling us up to 10 times a day starting on the 2nd. I even get threatening letters of foreclosure if not paid on the first of each month. I will never do business with this bank again. They start calling at 8AM and continue until 9PM non stop. If more people would stop banking with them maybe they will change the way they treat their customers. 5th 3rd is the bank I now do business with and they are Fantastic!

      Yeah, well, I used to think I was "safe" with 5/3rd....until I modified my mortgage with them. I started getting calls to "verify" my contact info every other day or so when I still had 10 days to go till the modification paperwork was even due. Then I got a call early one Saturday morning, three days after I had overnighted the certified funds and signed/notarized paperwork. The rep CONFIRMED they had received all of it, but said that I would continue to get calls until they booked it into their system......and sure enough, got ANOTHER CALL 24 hours later-at 8:15 on Sunday morning. Am going to contact the Attorney General's office and the local news station and hopefully shame them into stopping this egregious and nonsensical practice.

    Bank of America calls every single day, sometimes 5 or more times. I do answer, explain that the payment will be mailed and get there by the end of the month since i get paid bi-weekly. I am not behind technically, but owe for the month. The month is not even over and they keep calling and i talk to a rep, tell them the situation, give all of the information about when the payment will get there ect.. am on the phone for at least 15 minutes each time. Low and behold the very next morning ANOTHER BANK OF AMERICA PHONE CALL!!  Nothing has changed since yesterday so why do they keep calling me?? I don't want to take it out on the reps but by this time, after repeating myself every day all week, I am fuming mad!!!! Is there anything I can do???

    LOAN MOD/SHORT SALE/IDENTITY THEFT SCAM:
    involving, BANK OF AMERICA (what a surprise)

    This is a complaint that follows one we are filing with Federal LE. We are senior citizens in Sacramento and for the last EIGHT months have been harassed by (1) Bank of America (2) Call Centers for Bank of America (3) Titanium Solutions o/b/o Bank of America and (4) others acting on behalf of Bank of America, who REFUSE to identify their organizations.

    They (BofA, Call Centers, Titanium) call our landline private phone number, asking for a KIRK SIKLIN or Thicklin (sic). They refuse to spell the last name, hang up on us when we ask for the correct spelling.

    They (all numbers listed below) have refused to remove our phone number from their call list, claiming they don't have it. When we ask how did they call us, they claim it is a robocall. We were given the number to a Bank of America rep, who refused to remove our phone number, without getting other private information.

    When we actually do take these harassing phone calls in person, we are asked our name, telephone number and address. We refuse to give this to them, as this is private, they tell us they won't stop calling us until they get our private information.

    We believe they are part of an identity fraud/mortgage scam/loan fraud/short sale scam scheme that goes way beyond what the Feds are bearing down on BofA. We believe they are trying to scam financial information of people who have intact financial backgrounds.

    We have received over TWO THOUSAND phone calls, robocalls, and others from BofA/Titanium/other repro short sale intermediaries for BofA between March 2012 todate:

    This week, they have passed our phone number to KRAFT REAL ESTATE phone number (916) 751-0507.

    The KRAFT employee (female)who left two messages indicated she was an agent for Kraft, and was working on a LOAN MODIFICATION for KIRK SICKLIN or THICKLIN.

    We spoke to her today, and asked how how she got our phone number which is unlisted, that we are not KIRK SICKLIN. She said she got it from a Kraft RE sheet she was working off.

    She said she would note this is not the correct number and we told her (because this has gone to Federal LE) she needs to do better than note it, to call the head of Kraft RE, since they will now be involved.

    We had told her Kraft RE has a good reputation in Sacramento and would hate to see them drawn into an investigation and she needed to talk to the head of Kraft RE.

    She then stated she never indicated this was for Kraft, she was working with TITANIUM SOLUTIONS. She repeated she was not working for Kraft. (Her caller ID indicate Kraft RE.)We admonished her calls were monitored, she had left voicemails indicating such, including the deadline for the loan mod was today, and so we told her we can prove she was lying. She then hung up on us.

    This is more than just phone harassment, this is part of a bigger mortgage loan/short sale scam.

    We have, and have had nothing to do with Bank of America, we have no contracts with Bank of America or any of their affiliates, legal entities or associates or vendors or subcontractors, because they are always in the media, discovered to be disreputable,shady, criminal-minded scamsters.

    Our private phone number has been private for YEARS, until we gave it out to do a lot of volunteer work PRO BONO with (omitted)  in Sacramento - around the same time this Bank of America phone nightmare began.


    RESOLUTION:
    We would like to seek financial damages from BofA, we want Titanium added to the investigations into BofA, and would like a judge to order them to pay $1,000 per harassing phone call.

      Don't let B of A mess up your day. Mess with theirs. You can make payments toward principal any time.
      $5.00 or $ 10.00 dollars every couple of days will mess with there accounting. You are entitled to adequate accounting by financial lenders. As soon as you can prove they are using the US Mail to send bad statements with poor accounting you'll be able to file compaints with the Attorney General. If every one that is displeased with B of A would do this, they might start transferring the mortgages to other, more reputable lenders.

        Bank of America said we did not qualify for a home modification 3 years ago although our income had reduced. Instead they offered to refinance for a $2000.00 fee. I asked for a 15 year mortgage. We received paperwork for a 30 yr. with no savings on interest and fees of $6000.00. We never signed anything and all I got was a voicemail to state we wanted a 15 year mortgage and that we had a good faith estimate of fees
        of $2000. We received a message they would honor the fees but did nothing about the term.
        Then we received a message that we had an appointment to close. WE NEVER signed anything to
        expect a closing date because it was not what we wanted to pay for.  I left a very defined message to say the least.
        Recently we went again to try a home loan modification. Our payments were behind 45 days. Again we were told we did not qualify. I refused to leave any copies of our financial information. At that point it was none of their business.
        The following day we received an Intent to Foreclose in the mail. With a balance due for one month at twice our mortgage payment. I was livid.
        I made one payment, then another payment the same day. Then a week later I made another payment that placed us a month ahead.
        We have since received letters, FED EX packages and and packets from a company called Titanium
        Solutions and Bank of America that want us to give up our financial information with offers to help us through our tough financial times. No one at B of A branches could tell me who Titanium Solutions were. And I refused to give them any information when they started calling us.
        We have a letter that says we now have a designated Customer Services representative so I asked her how I get a copy of our amortization schedule. She said she did not know what that was. That scared me. She is supposedly a Manager in the Home Loans, Home Modification and Debt Collections Department.
        I am so done with B of A. So I made another payment that now puts us two months ahead and yet
        to receive a payment statement. I just have receipts and copies of Cashiers checks.
        So now, I am making it my mission to totally screw up their accounting. I will make $5, $10. up to $100. principal payments every other day until I can prove they are not worthy of handling our mortgage.
        I will continue to collect all there BS paperwork and letters of intimidation to send copies
        to FHA, HUD, the newspaper, attorney general, an attorney, and every other organization I can think of
        to mess up there days as bad as they have messed with mine.
        I can only hope I can prove that they use the US mail to fall into a felony offense punishable by imprisonment. Racketeering is a major no-no.
        So B of A you might have our mortgage, but by the time I'm done, you may want to give it to another lender.
        I have only begun to fight. And I am doing it by the book.

        FOR ANYONE THAT HAS HAD ISSUE WITH B OF A AND THEIR HOME LOANS - I  SUGGEST YOU START MAKING REGULAR AND SPORADIC PAYMENTS TOWARD PRINCIPAL SO THEY FEEL THE PAIN OF THEIR TRYING TO PUSH PEOPLE AROUND. EVERYONE CAN COME UP WITH $5.00

          BA is running some kind of scam  I have never missed a payment or been late.  only after asking for a modification was I reported being late.  I have proof that the checks were cashed I am going to report this to the Attorney General

    Bank of America does the same thing to me.   If you don't pay exactly on the 1st of the month... they start to robo call you 8-16 times a day until you do ... and then they will continue after you do as their process requires them to then confirm your ID and that you still occupy the property.

    I have NO problem paying my mortgage... but like any smart consumer ... I will delay for the entire grace period to let my money earn interest for me as long as I can.   I KNOW BofA does the same with their own money management.

    Anyway...  I filed a complaint with the FTC using the governments website:

    Every month after the 3rd of the month BOA harrasses me 4-5x a day from 8 a.m. till 9 p.m.  I have never been late on my mortgage in the 10 yrs i have had it w/boa.  Even if you tell them what day you will pay the mortgage, they continue to call.  Thank goodness I am selling the house this month.  I will NEVER EVER obtain another mortgage from this company and will advise everyone i know not to do business w/them.  They are just as bad w/their debit card.  At random, they deny you credit and embarrass you for no reason when you go to use it even when you have plenty of money in your checking acct to cover the charge.  Then when you get home you find a msg on your phone to call them because there has been possible "fraudulent activity" on your card.  The card is unreliable and the bank is unreliable.  I now bank with PNC.
