Country: United States
I have received a corespondence in the mail from Portfolio Recovery COMPANY Dept 6541  PO box 1259 Oaks PA. 19456 or send checkt to p O box 12914  norfolk va. 23541  for Federico Martinez at my address. My Name is Frederick Martin. My complaint is that this: A above refered to collection company in the name of Bank of America and Fleet Bank is simply looking for people with similar names and sending form letters and demanding money... I consider this to be an invasion of my privacy and an infringment of my personal information. Obviously this is a company grasping at straws and has no knowlege of where Federico lives.. and is just trying it collect money at my expense.

Did you call up B of A tell them you are being harassed,  and their bill collectors are the ones.
Tell them you want them (BofA) to go and tell their colectors to stop it.  Tell them they are calling
you six,  seven times a day and tell them you told the bill collector you are not the person they
are looking for and when you say that collector called you a liar.  than go google the portfolio recovery
associates  find out which state their corporate office is,  file a consumer complaint with the State Attorney of that state, State Attorney of your home state,  Federal Trades Commission and BBB.
(BBB will ask where is the company lokated  give them the city and the state corporate office lokated)
those flakes are relentless.  Send them a letter tell them DO NOT CALL ME EVER AGAIN, , ANY call received from them will be considered harassment and you are keepingg a detailed record calls
and what was said, and will be used for POSSIBLE litigation (DON't say you will or you are going to... and BofA

You dont say stop calling use the words "Cease and Desist". Under, the FDCPA and most courts those are the correct words to use, though that is the quickest way to be sued. Also, some lame judges are now starting to say "Stop contacting me" surfices but if the collection company has balls the if they loose will appeal,  and probably will when. So use your words carefully and document all contact with them.

That is pretty much the business PRA is in:  buy really cheap, old debt, and cheaply send out a bunch of letters trying to collect it, using sloppy computer matching.  If they think they find someone, they then try to get a default judgement.

Be careful they don't try to sue this "Federico Martinez" and garnish your accounts instead.  If they start "accidentally" trashing your credit, "correct" their records to your name instead of the original debtor, get an attorney and sue them.  Don't mess around.

Im getting mail and phone calls for my name from this company. I explained  to them that I have no debt, sent in an edited statement and credit check from my bank. They wont accept it because I wont give them my social security number. I told them they are never going to get my social. So they sent another collection notice last month, this time with the other Roger Krause's SS Number in the letter. I had my friend look up this other guy by his ss, hes 25 years younger and living half way across the US from me. I sent them correspondence including the info we printed out for them. Last Monday yet another letter exclaiming that I am in dept to them from a 20 year old JC Penny account hahahahaha...........     Today, I received a carbon copied letter from my attorney who has filed lawsuit against them that he guarantees will not only stop the harassment, but give me some extra spending money for my trouble. SEEK AN ATTORNEY! I found mine on Google, stay tuned!

This is the way to handle these.  I just sent one back yesterday from this outfit.  I put a white-out label over my name and address, write NO CONTRACT on it (over my obscured name) and put return to sender.  I always invest in a stamp for the return as that makes me postmaster of the mailing.  I handle all these obnoxious debt collectors this way -- including lawyers.  Don't open the mail!  it contains something designed to make you mad or fearful so you will engage them.  You must send them back however, you can't just throw them away, as there is a legal concept called tacit acquiescence (by your silence you consent to whatever is in the envelope) that you want to avoid.
