So last week/early this week I got some blocked calls. One of them was on June 8th and a voicemail was left, no agency name was left but the call was threatening me with a lawsuit and how I was in trouble and the call ended with a great line, "you've been served".

Ha ha ha

So today I get a call from Quan Paine. He wanted me to confirm info he had and I refused. He said that they were working on behalf of mycashnow and I had not responded to anything and that I was being summoned to court.

After I told him he couldn't legally serve me court documents over the phone he said they'd be mailed. He wanted to know if I was refusing to settle the case. I told him I had no proof or documentation or anything of this "loan" and that I knew it wasn't on my credit report. I use Lexington law to monitor my credit reports and dispute any fraud charges for me.

Anyway, they "emailed" me a notice of assignment with today's date that the loan had been purchased by CRSCraig. They made sure to reference 559.715 (Florida regulations) for debtor assignment. They said I could dispute and they would validate. I sent them a little note back asking for the original date of assignment, to dispute the loan, blah blah and that I thought they were fraudulent :)

Then I got a call from a number in Buffalo new york for Teresa Paine "the manager" in the Florida office. She is more than happy to talk to me.

So, anyone else working with these folks?

    "Serving" by phone is nonsense, generally associated with fraudulent collectors playing the fake "process server" game.  

    Telling you that you have been "sued" yet not actually serving any summons is consistent with this type of con.  The most aggressive of these cons allege som "payday loan", imply a "lawsuit" or "prosecution for fraud", and routinely claim :you are in trouble", and "you have been ignoring" letters they have never sent.  Typically they falsely claim they sent the FDCPA "g" letter, maybe "45 days ago", to deceive consumers into believing they can't dispute.

    Referring to a "loan" that you know nothing about, emailing you some "assignment", and referring to some "Florida regulations" to sound all "official" and "legal", are all focussed on deceiving unsophisticated consumers into believing these are some "proof" of this "debt", when in reality, they prove nothing at all.

    All of the above is aimed at threatening and deceiving consumers into paying a "settlement" without any proof of any actual "debt", and are intentionally crafted to work even when they reach people who owe them nothing by "mistake", if there is even any actual "debt" that someone owes.

    They are taking numerous separate steps to threaten you with this "lawsuit", yet amazingly each fails as proof of anything  SAYING they will supposedly "validate" if you dispute says they expect you to dispute, but are trying to evade your FDPCA right to dispute.  Just saying the will "validate" it is no proof they can or will do ANYTHING AT ALL, but it probably fools a lot of people.


    Thanks for the fine example of "weazel word" language.  You have more separate indicators of attempting to deceive, bluff, and con than I have seen in a single scam complaint in a long time.  Every threat is undermined by its own lie, which is really stupid when you are trying to con someone.  These jerks are really incompetent amateurs at this.  (I won't go into how the more competent players of this con operate.)  

    The Buffalo connection is interesting.  Presumably, 716 area code?

    Buffalo appears to be a major center for fraudulent debt collection, as well as the brokering of "portfolios" of old or unowed "accounts" use as cover for these scams.  That suggests that either the Florida connection is a mail drop, or some minimum wage strip-mall debt collection call center with an ownership connection to Buffalo.  The "closer" level pressure came from Buffalo, not Florida.

    They appear to be operating out of the same building as the Florida AG's Economic Crimes Division Tampa office.  Why don't you contact the Florida Attorney General, to find out if they are licensed in Florida, as well as to report any violations of FDCPA?  In fact, why don't you contact the Tampa office, and let them know who their neighbors are?

    No this place ain't fraudulent they ain't joking they are easy to work with they sent me everything I wanted for proof the supervisor name is Aimee she is very nice old school and understands how we have problems I can say they we honest and one of the easiest people that does care and will work with you they have all the proof they need for payday loans we did and we can get served and go to court I know that for sure.

      I just got acall from hem threatening me nd have reported thm to the fcpa, my state attorney generals office and the state financil commission. and have a form to fill outfor the Florida stat attorney generals office of some cr5ims unit. received a call from a fdcpa lawyer who is taking my case against them and  Mr. John Anderson in their Florida office. recorded my conversation with him and he knew it was being recorded cause I told him i was recording it.  Got all the threats on the ecording evening him saying basically they do have to abide by the fdcpa laws because hey are not a collection aency.  found out anyone trying o collect on a dbt even lawyers are bound by he fdcpa laws which includes them you record aything with them be sure and tell them it is being recorded. I am now filing a report with it the FTC. some co called multi loan source sent tehm after me, I called them and they wouldn't dicuss anyting with me because it was out of there hands and in this companies hands. I also filed against multi loan source to stop this kind of abuse.

    This company is not a scam they helped me and worked with me say what you want but I spoke to a Amy and she worked with me hey just pay your bill they will do payment arg with you just dont lie I know one thing they can and will take it to court if they have to.

      I was a former employee. They had a written script of exactly what to leave on a voicemail. That we where process servers calling about a court summons. THIS IS 100% ILLEGAL. Court documents are sent by mail, delivered etc. I've been sued 2 times. Papers came in the mail. Those agents calling don't even make $10 hr that company didn't care to tell us it's illegal. Future reference get as much information as possible sue the company.
