My compliant is based on their phishing via telephone cold calling techniques at night and on weekends with no legitimate reason.. IE, they
make calls to numbers without knowing who they are calling and ask for
name and SSN over the telephone with no disclosure of why they are calling.

One can only assume it is a "Phishing" exercise to obtain names and
SSN's for apparent reason other than they have some sort of scam going.

Additionally, I am on the do not call national registry so they are
quick to point out that they are not marketing or selling... and they do
not attest to any company/customer legitimacy to their actions... so one
can discern that they are on some sort of phishing exercise... asking
for name and SSN's.

They fall into the "harassment call" category as they call late at night
and on weekends.. and do not take no for an answer.

I cannot grant any legitimacy to their disguise as being some sort of
collection agency since I have no such debts in arrears and they do not
even know who they are calling... just a phone number as if it was a
boiler room operation.

    Claiming that someone has "used you as a reference" is a common lie used by debt collectors when contacting neighbors and relatives.

    Debt collectors are not supposed to disclose to others that someone owes a debt.  That generally means they shouldn't disclose that they are calling as debt collectors, but they are required to disclose to the debtor that they are calling to collect a debt.  They are also supposed to honestly disclose their company name when asked, or they would be using deception to collect a debt, a violation of FDCPA.

    They didn't actually route the call through the local attorney's number.  What they did was to spoof the caller id information.  Using deception to collect a debt is illegal under FDCPA and state laws.

    They have demonstrated in multiple ways that they are willing to violate the law, and since they have shown that they will act in ways that defeat your normal dispute rights that should result in resolving the error in identification, you would be wise to act proactively rather than wait to see what else they might try to pull.


    You would be wise to keep a close eye on your credit reports.  Contrary to common assumptions, they can put erroneous information on your credit reports without having your correct SSN, or even providing any SSN.  You would then have to dispute it through the credit reporting agencies to try to get it off.  Meanwhile, your creditors raise your rates, cut your credit lines or close your accounts damaging your finances and they aren't even legally liable for damages until they erroneously "verify" their error in response to your dispute.  The correction system is corrupt, and lets them snipe at you with impunity.

    As you saw, they tried to garnish your wages in error, but that was stopped by the difference in your SSN.  Fortunately, your employer caught that, but the multiple contacts and deceptive attempts indicate that they may keep trying to take your money even if you are the wrong person.  

    You are not dealing with smart or competent people here, they have access to skip-trace databases that give them identifying information (which is how they found you instead of the actual debtor), and when you mix incompetence, deception, and abuse with identity information, they might do anything.  

    Since they are collecting on an alleged student loan, they can do it without even a court decision, leaving you with taking legal action to get back your money that they should never have been able to get ahold of.


    As a defense, you should first file complaints with FTC and your state Attorney General documenting their deceptive collection, disclosure of the (mistaken) debt to your mother, spoofing of their caller id using the local attorney's number, attempt to garnish your wages for a debt you do not owe, etc.  (Spoofing using the attorney's number is not only deceptive, it is falsely claiming to be an attorney, violating both FDCPA, and state UPL laws).

    At this point it does not appear that they will just stop harassing and trying to seize YOUR money, despite THEIR mistake.  They haven't even sent you the letter required by FDCPA, that would notify you of your right to dispute and request validation.  This indicates they are trying to bypass the protections provided by the law.

    They tried to garnish your wages, they might try again.  They might try to seize your bank accounts, and even if you block them, your bank will charge YOU for their trouble in dealing with it, and they might not catch the difference in SSN that your employer caught.  Or you might find yourself locked out of access to your own money, trying to find an attorney to help you to deal with the mess while you have no access to your own money.

    You would be wise to contact an attorney with experience in FDCPA law, NOW.  They have already violated numerous laws, and you can sue them under FDCPA for those violations.  FDCPA allows for awarding of actual and statutory damages, as well as your attorney's fees, so there are attorneys who take these cases on contingency.  Your safest path to protect yourself from additional damage from their incompetence is to act now.

    Sick of Being Harassed by Premier in GR
    Premier Credit continuously calls me saying that someone with my number has an outstanding debt with the US Dept of Education.  They leave messages that are several minutes long on my answering machine.  I have called them back and asked them numerous times to take my number off their call list as I have no idea who the person is that they claim owes them money and I am tired of getting their messages.  I told them just now that I will be reporting them if they call ever again.

    My complaint is also about the pushiness of your agents.  One whose name is Rick Pearson.  He contacted my employer trying to get personal information. My supervisor informed me of what he was trying to do.  When I spoke to Mr. Pearson miss represented himself by stating his intent was to garnish my wages.  I too do not like the idea of someone asking me my personal information over the phone before they acknowledge who they are and what they are calling about.

    Their real business is selling private information collected from the Department of Education and IRS using information gathered as a collection agency or by fraud.

    It amazes me the amount of DEBTORS out there that have the time to sit and do research on Premiere Credit and take the time to post all the bs on this blog, maybe you should take that time and contact them and PAY YOUR BILL!! YOU ARE THE BIGGEST DEADBEATS EVER!! If you have the money to pay attorney's you can pay your bills.

      I am a single mom that got audited in last year for 2011 taxes. It was handed over to premier who did not contact me put a levy on my bank account. They are to busy to answer the phone so you must leave a message. I got a call back 6 hours later and told them to take the money out of my account on Monday. they did not do it and I cannot get anyone to call me back meanwhile I work my butt off and take no govt assistance and cannot even feed my kid right now. So I am not a dead beat just a hard working mother that has a levy on her little paycheck that she is trying to give to them so that I can have money for gas and food to get to work. These people are shady and if they have that many people calling and trying to make arrangements then maybe they need more help. And furthermore when someone says take my payment on the 16th and they say ok then they should collect the payment as agreed and lift the levy. Not everyone has a pile of cash laying around the house and not everyone is on assistance. I work for everything I own.

    I didn't get the impression from reading this, that all of the comments are coming from those who actually owe money.  In fact, it seemed that some of the calls being made by Premier were made in error.  I am researching Premier as I am about to talk to someone in connection with a position with this company.  

    These are sad times, many unemployed through no fault of their own.  Not everyone who owes money and can't pay for a time or two in their lives are dead beats.  Perhaps that is something to think about.  You could be working one day, paying your bills and life is good and without warning loose your job. Try a little caring, compassion and say a prayer for those who are less fortunate.  It's only money....

    It is amazing how many debt collectors think no one sees what they are doing when they harass, lie, and threaten people who do not owe them a dime.  

    You must have all flunked math, totally missing out on any concept of statistics, such as that as the complaint sample size increases, the complaint statistics increasingly reflect the population statistics.

    In other words, the more you generate complaints, the clearer it becomes to the whole world what you are actually doing.  When your activities result in large numbers of complaints, the numbers overcome your lame excuses, and show you for what you are.

    How dare you call these people criminals!!! As a debt collector you cannot threaten anyone as or with a crime!!! PERIOD!!! You should be reported and anyone reading this please report this person.

    There are many reasons people don't pay their student loans...
    Their advisors...advised them wrong!!!
    They were injured or disabled
    Bad economy
    Illness

    So go screw yourself...collector.  Yes you can be worse than the debtors, don't kid yourself...your letter proved it!!!

    I asked Premeire credit via telephone for a 75.00 per month payment plan. They agreed. They then persisted in getting my information over the phone. Bank account, social, etc...I told them please send me in writing and I will respond and sign agreement with payment. I need to know who and if I am dealing with a ligit person/company and was uncomfortable giving that info over the phone. I told them I did not have a bank account number to give. I finally said please do it in writing and hung up. They continued to call daily, sometimes more than a couple times a day. I received a letter in the mail that said please call Premeire Credit as I may be able to pay less than 75.00 per month. I then received an email from my brother that I still have that they called him and said to tell me to call Premeire credit about a DEBT. I was upset that they disclosed this info to my brother(family. I had already agreed to 75.00 and they accepted that figure as well. They continued calling and my roommate answered the phone and told them she has someone with special needs here and they need to cease calling and send the agreement in writing for "ME" to sign. They continued to call, I answered them again and said I would only agree to that payment by mail. He got angry and I hung up. I then received garnishment orders in the mail.

    Now what is obsurd is this garishment say's "any hardship or not working or dispute this garnishment, to respond to them Premeire only VIA mail. No phone calls.  How ironic is that...

    These people are awful they demand social security numbers and are rude and nasty. When I ask for them to mail me the forms for forgiveness of my student loan they refuse. They have had multiple opportunities to resolve this but like most credit collection agencies, they lie cheat and wanna steal your money. With interest!

    Also you can fax them a demand under the fair debt collection act that they must cease and desist calling you. I did and they no longer call.
    So they will follow the law if its done right.
    Get rid of these A$$holes. Send the fax use faxzero,and ms word.

    dont know if anyone pays attention to this forum anymore, but i googled premiere credit scam and this forum came up. The reason i think they are a scam, i got a certified letter that i had to sign for from the indiana IRS. They said i owe 549$. The mailman also gave me my mail for the day and in it i get a letter from premiere saying i am in default and owe 611$ In the letter from the indiana irs it says 549$ due 10/24/10 and it also states if i dont pay they will take the tax out of my federal tax return and charge an additional 22$. So is this premiere credit bill a scam or is it something like, they will pay my tax debt and i will owe them interest. The letter they sent reads like i have no choice and owe them the money. I will call the IRS tomorrow.

    My Debt had been paid by my ex-husband in a previous marriage not to premier credit but the real actual debtors, I work and take care of my family and this Dominic calls me out of the blue and demands I pay 30,000 and there is an order to garnish my wages? This is the first I've heard from them, there was no mailings, no calls, and then out of the blue one day they call and tell me they are going to garnish my wages? What action can I take, where can I write I want to sue! This is illegal I smell scam!

    bellyphat: If they meaning premiere, did not notify you that they were trying to collect a debt on behalf of the irs or whomever, they violated your rights under the fair credit reporting act. The IRS and premiere where suppose to give you the option to dispute their clam or pay the bill if you really owe it. If they didn't and especially if you do not owe it don't pay it take them to court. a class action civil suit is pending against premiere contact this number to get more info. 800-644-4673.
