RPM trying to collect a fake debt

On 4 Apr 08 I got a call from Receivables Performance Management (RPM) claiming that I owe $85 on a Verizon account from 2000.  I know that I’ve never had a Verizon account, and that my phone account from 2000 (I forget which company) was paid properly.  So I told the RPM rep that they were full of s**t, and that I wanted written proof that this debt is actually mine.  They had the last 4 of my SSN and tried to pass that off as “proof” that their info was legitimate.  I still didn’t fall for it and asked for everything in writing.

Fortunately I have records that go back that far.  I also called Verizon to confirm that they don’t have any account information with my name on it.  Surprisingly they have no record of me ever having an account with them.  I then went online to find out if RPM is some sort of scam.  They are a “legitimate” company, yet seem to be practicing what I would describe as predatory debt collection, or legal extortion.  Unfortunately, there is not much information on the internet yet about RPM.  However, there is a lot of information about AFNI, who seem to be doing the same thing.

So, after I found this web page, and read all of the information about AFNI, I downloaded the FDCPA and FCRA and read them.  I’m sending RPM a letter in accordance with the FDCPA.  I’m also sending the letter to my state’s AG and the WA state AG.  (RPM is located in Bothell WA.)  I also checked all of my credit reports to make sure that nothing has been placed on them.  I’ll continue to monitor my credit reports very closely for the next few months.  As this develops I’ll update this comment.

I’m considering contacting a lawyer to see if what RPM is doing is in any way actually extortion.  It’s a crime that the max penalty under FDCPA and FCRA is only $1000 or actual damages.  Obviously that small amount isn’t enough of an incentive to keep these companies from violating the law.  I’m also going to contact my Congressmen about this.  Maybe if enough of us complain the law can get changed?

Oh, and a huge thanks to the poster on this site TJ!  His information and advice was invaluable!!

I received a letter today from them, stating that a creditor called Pinnacle Credit Services, LLC has retained their services to collect a debt from me in the amount of $3996.58.   I have no idea who this Pinnacle is and I certainly do not owe them that amount of money.  I can't find anything about them, but that they are a collection agency too.      BUT if I pay by 8/26  $799.32 will settle the debt.  So very confused.  Guess I better go check my credit report to see if this BS is showing up on it.

Like most debt collectors, they have a history of problems with providing validation on alleged debts.

received a collection notice in the mail today saying that I owe AT&T Wireline $155.56 from November 2013. SAY WHAT???? We've had prepaid cell phones from Verizon for the past 5 years -_- I contacted AT&T to see if anything was listed on my account as me having some debt even for cell phones that we DO NOT have. There is nothing listed on my account, I am not past due on my account so...............SCAM!!!! Do not give them information over the phone, make your complaints against them on the Better Business Website, and other sites that will accept your complaints. Companies/Scam phish information out of you so they can screw you over at their convenience. I had the gal from AT&T make a note on my account that I received this collection letter and my concerns that it is a scam. I was told to ignore the collections notice, my account was fine.

I received one of these letters today.  Actually, it was addressed to my mother, who died in 2013.
It has a garbled version of one of her phone numbers, and the 'Original Creditor' is 'AT&T Wireline', with a date of June 2014, which is the date we sold her house.
If AT&T had been billing us for this, I would have known, and would have paid the bill.
Yes, it sounds like a scam to me.  If it costs them $1 to send a notice for $60, and 25% of people erroneously billed just send in a check, then they make $15 for for every dollar they spend sending out bad notices.  Even if some of their bills are valid, they have no incentive to weed out the bad ones.
To cover the interests of the estate, I will send a letter disputing the debt.
I guess I should track down a copy of the aforementioned FDCPA to make sure my letter meets all requirements.

to ATT's fraud department.  That should pin down whether there ever was some unpaid ATT bill.  If not, that would suggest that these creeps may be constructing fake "accounts", maybe using obituary notices or county property transfer records.

Estate shakedown scams are nothing new.  The movie, "Paper Moon", had an example.

Evidence of fabrication.. replies to It's probably worth a call..
is often in the form of "information" that doesn't quite make sense.  If the perp doesn't actually have access to real records, he'll make up something that sounds plausible, just to fill a blank that would be expected to be known.

Sometimes the hardest things to get right are dates, since accessible sources, like skip-tracing, may show names and addresses, but might not show accurate dates. They are designed to merge and conglomerate information from multiple sources, to find a lead on a person, not reconstruct the exact time order of specific events.

I have been dealing with these [***] since October of 2014, and in total thry have called me 46 times and have left 8 voicemails on an attemot to collect a debt on a Sprint bill that i just recently canceled. I called Sprint and got no answers to this matter, I also finally answered on day, AND GOT THEM ON RECORDING SAYING THEY ARE TRYING TO COLLECT A DEBT. After this i contacted my Attorney and now am filing a complaint against them and they are in a whole lot of violations. I told them to stop calling me because i never gave them permisson to do so and also i am registered on the National no call list so this is a major violation which can cost them thousands if it goes to court. And i have all snapshots of the calls, phone records, and all saved voicemails. This company calls from two seperate numbers and thier website does not show these numbers but they have several other numbers listed. I don't know if they are bogus or not but They F...ed with the wrong dude and they are going to wish they did'nt because my Attorney's don't play. Good luck to you all.

    Thankyou for you clear messages.
I couldn't think of any debts I may have, I don't have credit cards or loans, haven't had sense 2001.  so how could I owe.  They claimed I owe money to the IRS and wanted my social Number.  "Hell No!"  and I hung up.  I still get calls and I don't answer them, I just hit delete.  Let them call I don't care.  They haven't anoied me past 5pm any day or on weekends and it's only one to two calls a day.  A hang-up during the call wouldn't stop them because it has my call are a recording and I'm not going to call back again.
Your right, it's just a scam; if the IRS wants to sue me they can sent me an official letter.

IRS knows how to collect what's owed.. replies to Chuck J
They don't do it by making threatening calls asking for your SSN.  They send a letter, and if they decide to, they can sue and take it out of your bank accounts.

On the other hand, it is common for scammers to pretend they are "the IRS", when they're a bunch of fakes. Anyone can make anonymous phone calls, and anyone could say they're "the IRS", and ask for your SSN.  It proves nothing at all.

That's a blatant FDCPA violation.. replies to JL
There have been other debt collectors slapped down for sending deceptive postcards notifying of "prize winnings", to get alleged debtors to call back.

I've been dealing with RPM now for a little over a year. The constant recorded calls, the emails. We finally settled our debt with RPM they said they would mail out a letter stating that the account was settled. I have yet to recieve anything. To top it off they actually sold my debt to a second collection agency for what would have been the remaining balance.  I spoke to the other collection agency and they stopped calling me.  The thing is that  it is still affecting my credit because it shows as an open collection. I call and call and get sent here and there and told they will send the letter out, email within 24 hrs. Well  a year later and i have yet to receive anything.  They are aware that the acct. was settled and closed but for whatever reason have not reported it to the credit bureaus. Every single time i call it sound like there is a party going on in the background with people laughing and screaming. I have had a representative continually yawn when on the phone with me so much so i could hardly understand what she is saying. I am now considering reporting them to the BBB and opening a class action lawsuit.
