RPM trying to collect a fake debt

On 4 Apr 08 I got a call from Receivables Performance Management (RPM) claiming that I owe $85 on a Verizon account from 2000.  I know that I’ve never had a Verizon account, and that my phone account from 2000 (I forget which company) was paid properly.  So I told the RPM rep that they were full of s**t, and that I wanted written proof that this debt is actually mine.  They had the last 4 of my SSN and tried to pass that off as “proof” that their info was legitimate.  I still didn’t fall for it and asked for everything in writing.

Fortunately I have records that go back that far.  I also called Verizon to confirm that they don’t have any account information with my name on it.  Surprisingly they have no record of me ever having an account with them.  I then went online to find out if RPM is some sort of scam.  They are a “legitimate” company, yet seem to be practicing what I would describe as predatory debt collection, or legal extortion.  Unfortunately, there is not much information on the internet yet about RPM.  However, there is a lot of information about AFNI, who seem to be doing the same thing.

So, after I found this web page, and read all of the information about AFNI, I downloaded the FDCPA and FCRA and read them.  I’m sending RPM a letter in accordance with the FDCPA.  I’m also sending the letter to my state’s AG and the WA state AG.  (RPM is located in Bothell WA.)  I also checked all of my credit reports to make sure that nothing has been placed on them.  I’ll continue to monitor my credit reports very closely for the next few months.  As this develops I’ll update this comment.

I’m considering contacting a lawyer to see if what RPM is doing is in any way actually extortion.  It’s a crime that the max penalty under FDCPA and FCRA is only $1000 or actual damages.  Obviously that small amount isn’t enough of an incentive to keep these companies from violating the law.  I’m also going to contact my Congressmen about this.  Maybe if enough of us complain the law can get changed?

Oh, and a huge thanks to the poster on this site TJ!  His information and advice was invaluable!!

From what you describe, RPM's tactics in collecting on this alleged Verizon "debt" matches AFNI's.  Is there any indication they may actually be collecting for AFNI, or that this "debt" was assigned or bought from AFNI?

If it turns out they had no legitimate basis for dunning you for this "debt" (perhaps because your name, address, and other identifying information wasn't originally associated with it), and if you want to look for additional violations, check your 3 credit reports to see if they may have pulled one of your credit reports.

If they did so without any legitimate permissible purpose (as defined in FCRA), and in particular then used your SSN obtained from that credit pull to attempt to deceptively claim having your SSN "proved" it was your debt, to get you to pay a debt you didn't owe, you might have an action under both FDCPA and FCRA, or corresponding state law.  Some state laws allow for higher statutory penalties.

I'm going through the same thing with RPM. They claim I owe $99.00 from the year 1998. I had never received anything in writing until I called them after returning home from a trip and seeing their number on my caller ID. I called them slightly upset and they HUNG UP ON ME! They then... for the first time, sent me a letter giving me 30 days to respond. I sent a certified letter in 5 days stating this was an INVALID DEBT and got a signiture confirmation back from the post office. Today I got an email alert saying RPM had listed on my credit!! It still hasn't even been 30 days since their original letter!! I just now called them and they hung up on me again!!  If anyone is sueing these [***] COUNT ME IN!! Feel free to contact me at zcaptain@comcast.net.  Sincerely, Scott

Thanks for your information. Yes, RPM collection agency keep calling me ten times a day from different numbers they use. However i never picked up their phone. I dont know why they are calling. I did not have any debt with any body. I had some problem with t mobile phone company 6-7 years ago and since then i did not receive call from any collection agency. Now what should i do?

I have been recieving the same harrasing phone calls.  However it is now automated and tells me to wait that I have received a call but then hangs up on me.  When I finally called the number back they are very deceptive and immediately ask for me to verify my address - without telling me who they are or why they called in the first place.  When I tell them I am not going to give out that information until they tell me why they called - the guy was allusive and said "there are lots of reasons why they would call"  but never even said they were a debt collector!  So I told them to remove my number from their calling list.

Since they are making harassing phone calls, and not identifying themselves as a debt collector, file complaints with FTC, your state AG, and the Washington AG.

An ex-employee a couple years ago revealed that they are so cheap they were using old obsolete phone number database records to skip trace, resulting in numerous erroneous calls

          Hello

We have been receiving calls daily from this company Receivables Performance Management. They claim to have a $19 Sprint Long Distance bill from 2005 that supposedly we were making payments on until 2008. First of all who makes "payments" on a long distance charge for that many years. That had to have been one heck of a LD charge. Second Sprint has never been our long distance carrier in 2005 or any other year.

I have spoken with 2 different people and asked them for proof. I would pay $19 to stop  the calls but am not comfortable giving them any money over the phone. They asked me to confirm the full social. Yeah, that's going to happen. But they only confirm the last 4 of the social and the mailing address. The funny thing is the address they have for us now if current but was not the address in 2005. So they clearly make up amounts and then go fishing.

I spoke to a nice fellow today who said he will send me the info that he does have by email and that they will not be calling again. Sure enough, they called just minutes later demanding that I take care of this. I want them to go away. What do you suggest. If you can get the $1000 keep it. I don't want it. I just want it to cost them for this crap.

I have had the same experience as others with this company. They were sent a cease and desist letter only to report negatively on my credit report AFTER receiving the cease and desist. I have cleared the credit report but only after not getting a lower interest loan which would have saved us approx. $5000 with the lower interest rate. How do I get a hold of you?

I got a call today from these a**holes saying I owed them money for a Dishnet account. I've never had a Dishnet account! So I called Dish Network, my satellite provider to verify this information. They had no clue what I was talking about either. Their fraud department helped me make a conference call back to them (2nd call) and they hung up on me. Everything as described by others here. If your comany sues them, please contact me back because they called my JOB!!!! for a fraudulent collection action when I know I don't owe anybody anything in collections for a fact!

Debt collectors must follow FDCPA.. replies to Keneth slayton
Federal law (FDCPA) says what debt collectors can and cannot do.  It requires them to send a letter within 5 days notifying  you of the alleged debt, and of your right to dispute it and request that they obtain and send proof you owe it.  NEVER pay any debt collector that can't send you documentation on the debt from the original creditor, and verify that it matches your own records before paying.

The scams use illegal threats, harassment, abuse, and deception to collect on what may be inflated or faked "debt", and typically fail to send the required letter, fail to send verification (proof), try to pass of some email "settlement letter" as "proof", or claim they don't have to comply with all the FDCPA requirements.  You can sue them for violations.

I've been receiving several vakks a day from RPM everyday for the last 2 or 3 weeks - when I answer using my common salutation, "this is Charles", they hang up, as though they're just trying to verify they have my correct contact info. When I try and call back the number RPM is calling from, a person answers, and before I can finish asking what all the calls are about, I'm hung up on. I would very much like to become involved in either a civil or class action suit against these leeches. My name is Charles Crago, and I can be reached at c3crago@gmail.com

I just got the same notice from RPM yesterday about a T-mobile account that I don't even have, I have current service (in good standing) with T-mobile and T-mobile admits to mistakenly sending it over to them.  T-mobile initiated this mess, and T-mobile wants ME to write a letter when they can see what happened in all of the notes!  Its amazing the RPM doesn't verify accounts they accept.  Count me in on a lawsuit.

I too have had an account with T-Mobile, a thoroughly deceptive cell phone company.  We changed to them because I have serious medical problems (heart) and wife periodically calls me each day while at work to ensure I am still on this side of the turf.  We need the service for health emergencies and T-Mobile which claims the largest 4G network (they are nowhere near that) had no service at all for my area but still insisted I pay the early disconnect charge even though they could provide no service.  I appealed to corporate headquarters of T-Mobile and they said no I had to pay because I was not promised service to my area (they told me of course your area is served by us) but I found out they do not even have a cell tower any where near my area and they tried to tell me their tower was out of service temporarily.  They lied, I am honoring my contract however and paying T-Mobile directly but still they referred me to RPM and another group who insist I pay them now.  Wife told them I am paying T-Mobile direct and hung up on them.  I am certain they referred this to my credit reporting companies  so count me in on the law suit as well.

Wow I am glad I looked.  These guys have been harassing me for what they first said was 107.00 for a T Mobile bill.  Next they said it was 10.75.  They have never sent me a written notice.  I had the same trouble with TMobile as one of these customers compaining.  My husband is high risk heart patient.  We moved to the mountains and could not get service regularly.  Went round and round with TMobile.  They told us to get new phones.  We did.  Save service.  They gave us many excuses and no performance.  We had been with them since they began.  The last straw was when the man told me to go out into the yard and try to call.  It was below zero!  I walked from the coutract.  Eventually settled with them through a collection agency just because it was right to do so even if they did not perform.
I have no idea where these people from RPM are coming from and if they are legal or fraud.  AZ

Please, please, contact your dept. of commerce and get this handled by them.  If you get some dismissive lazy-A--ed bureuCRAP who just doesn't want to be bothered to help you, then call your commissioner of commerce and complain.  This is/should be illegal. Is sure sounds like fraud to me.  I have a similar problem w/Verizon.

Why are we held to contracts that these companies do not honor themselves?  I would love to be part of a class action on all of this.   Please count me in if one arises and you need proportionate signatures to get it started. (jinjelle@gmail.com).
