I have been called by these people, claiming to be partnered with B of A (they must be, they have all the information) and I gave them NOTHING.  I've asked them, NOT LESS than 7 times to remove my name from their database.  They keep calling.   I finally got angry yesterday and asked for contact information from the "call center."  She claimed she didn't know.   Guess what, today there's a $20 debit from my Account.  Again, I never gave them an iota of information and I told them.  They insisted that I be "enrolled" before they'd even send a copy of the policy.  I said, "I know how impossible it is to cancel once you enroll, so no thank you."   This is a CRIME, not just a tort.   I would very much like to collecgt the names and phone for anyone else in this situation and go after these people.  I couldn't believe it when I saw this bulletin board FIRST on google.   B of A is responsible for this too.  They gave them the information.   This is an ILLEGAL business practice.

Okay...I just checked my account to see a smart step deduction of $40. When I began perusing my account, I saw that at least 3 payments had been made to a company, I have never heard of!  I check my account and this was not there before!  I have a BofA account....is BofA and SmartStep in cahoots?

You can call smart step insurance by calling 1-866-879-0179. You should call them as soon as possible.

Smart Step Insurance has been deducting $40/month since October 2008. I NEVER spoke to them in my life. I called my bank to stop payments to this company and they also gave me the following phone number 866-879-0179 for STI. I called that number and the agent I spoke with, Eduardo, was extremely arrogant and rude. He stated that they had spoke with my husband regarding the insurance and that he authorized the deduction. I do not understand how my husband can authorize a deduction from MY PERSONAL checking account. My husband has no authorization to that account. I spoke with my husband and he states he never spoke with anyone from SSI. I am fuming with rage at the moment. I tried to cancel the so called "insurance" during that phone call and all the agent persisted to say was "Your husband authorized this. He is the only one who cancel" I nearly lost it at that point. I sent over a complaint to the BBB and BOA regarding this matter, lets see what happens. Its situations such as this that make me not want to have a bank account.

I have had the same problem, but for a much longer time. The charges go back as far as 2007!!!! They pestered me as well with repeated phone calls. I finally caved but cancelled before the two months. They continued to charge me after I cancelled, so I called again & told them to stop taking the money out of my account, that I had already called & wanted to cancel. In Augest of 2007 I became pregnant & had morning sickness 24-7. I did not check my bank statements (way too sick!) thinking that they were not taking the money out anymore. I had my son in May & he is 8 months old now. Needless to say, I have been extremely busy raising my son as a single mother. I finally had time to check my account activity today (1/24/09) & they are still taking 20 dollars out of my account every month!! I tried to call but they were closed. As a single mother, I really  need that money they have been taking after I told them not to almost two years ago!! Does anyone have any advice as to how I can resolve this matter & get my money back??

Hi - I'm sadly starting to get resigned to this! I'm an aussie working in the US - have only been here for 3 years and this is the 3rd company who has continually debited my account without authorization! Australia obviously has tighter regulations!!! Anyway, I'm fortunate that this company has only managed to get into my account once this month with their $20 Smart Step charge.
I'm contacting BofA tomorrow, and if they can't assist and refund the funds, I'm simply closing my account with them.
You've probably seen this website - but there's interesting reading on
    http://www.ripoffreport.com/reports/0/259/RipOff0259829.htm.
Good luck to all of you :)

i called the 800 number that bank of america gave me and told them it was a mistake because the accidental insurance wasn't even for my name.  it was under "jenny."  they asked me "if you're not jenny, what's your name?"  they have my bank account info but they don't even have my name?? i told them to refund my money but they said it needs to go under investigation.  i am still waiting for my refund and will probably cancel all of my bank of america accounts because of this!!!

I have just got off the phone with a representative for this insurance company.  Them and who knows who else calls our phone weekly wanting us to sign up for the best deals on the planet !!! I think it was them that I told to go ahead and when I called them back to cancel. They claim we did not do this ... Which we did. They wanted a verification number they claim they gave to us for cancellation. Well, they did not give us one. Now the rep says the billing will be reviewed by their company and they will go from there. So we have determined if they aren't in person looking you in the eye ---- LEAVE THEM ALONE  TELL THEM  NO  NO  NO  ON THE PHONE  -  THEN NO SOME MORE...  ANYHOW --- do these companies have your  credit card number  when they call you so they can just go ahead and bill you even if  you tell them NO !!!   Any  answers to this Question  ---- Thanks ....

    Mr. Austin
    Mr. MacGrath,
Were you actually able to get a refund working with Bob? I assume he is a customer service agent. When I called, there did not seem to be a problem getting them to acknowledge a cancellation but I have been fighting for a refund for months now. They claim to record the authorization conversations and can provide a copy of that which I have now requested three time. So far all I'm getting is a run around. I have also asked for a copy of the so called policy I was buying. They have also not sent that either. Has anyone out there actually gotten a written copy of this policy? I wonder if anyone out there has actually passed away and their spouse does not even know they may have had this policy? This company must be skimming millions from bank customers.
If you go to Bank of America website and type OPT OUT in their search you can file an electronic form so they will not share your bank account information with their affiliates. I might help to avoid this in the future.
I would urge everyone to contact your states Attorney General office and report this company. They are likely to have a fraud division. I have done this in the State of Washington

Yes, they appear to already have your BofA checking or credit card account information.  Numerous reports indicate their charges showing up on BofA accounts, many with no prior contact.  Since there are also reports of them adding their unauthorized charges to BofA mortgage statements, they can only be getting this information directly from BofA.

I was actually successful in getting my refund.  I filed a claim with BBB (Better Business Bureau) http://www.bbb.org/ and received a reply from them within 2 weeks.  They apoligized but still claimed I had authorized the charges.  I told them I had cancelled my Bank of America checkings account because of them and demanded a check within 1 month or else I'd seek further action.  I received my check this week.

I has since called BOA an spoke to shean , and this policy has been cancelled, he claimed that the policy has been cancelled, will see next month if they cause my account to be charges an additional $35 overdraft, if you are having any problems with BOA, take all of your money out an go to another bank, they have gotten enough of our tax dollars to bail them out an you can't go to them for a loan because of the color of your skin, banks are a ripe off.

Did you report them to the BBB in IL (where their HQ is) or your home state?
