Calls all the time, says we own a payday loan. WE do not. He says very nasty words to us, threatens us too. I will not repeat on here what he has said sexually then hangs up. He is calling a lot of people I know using the name Jeffery, Jason, Richard and some foreign names. His telephone number is 1-866-782-9069. Everyone start calling and. It does cost him due to his service. It is a scam.

    Similar complaints:
    https://800notes.com/Phone.aspx/1-866-782-9069

Reports are consistent with criminals posing as "debt collectors", running a phone extortion racket using threats and harassment to try to intimidate people into paying for phony "payday loans".

Other complaints include reports of thick foreigh accents with American-sounding names combined with vicious threats of "arrest" or "lawsuits", which fits the pattern of a commonly reported group of such scammers calling from overseas, probably India or Pakistan. They may be calling via VoIP, which allows their caller id to show any American area code, and they may also spoof their name on caller id.

    They are liars and criminals.
    The "debt" does no exist.
They cannot do anything to you.
    They can only make threats.

They may have access to U.S. credit reports or skip-trace information, including relatives or employers, which they are often reported to use to harass and intimidate.  They may try to fake a "debt" using information they find on credit reports, or they might also have gotten access to old payday loan data, or possibly more recent on-line loan application information from phony on-line "payday loan" sites.

A Jason Fernadez acting as an Attorney, threatening me with 3 counts of criminal charges, due to a loan that he said I supposedly took out. They get affirmation/verification, when they ask for your name & they already have a SS# from computer hacking. PURE IDENTITY THEFT.   I called their phone # back, and they have a good con-artist set up. My REAL attorney googled the 866-782-9069 and found all these complaints, on the same #, same person, same scam.

    Somebody stop these people.

    Your complaint matches many others.

Complaints of this type of phony "debt collector" scam are beginning to pass complaints against actual debt collectors on this site.

The redeeming value is that their extreme illegal and abusive tactics are easily recognized, and are helping educate consumers to the more subtle illegal tactics of actual debt collectors.

File complaints with FBI, BBB, and your local TV or newspaper consumer reporter.

Stories in your area about this scam are probably the most effective way to reduce their effectiveness.  Periodic BBB press releases may help as well.

The problem with law enforcement is that most of these thugs are calling from overseas, using cheap VoIP phone service.  The telecom companies providing access to the U.S. might be a useful target, however, as they are aiding and abetting these scams.

    went against my better judgement
I was taken by this exact scam. They are good, they have different phone numbers. Mine was out of Florida and the man had a strong foreign accent. He even harrassed my husbands work place. I had ingnored his calls at first until they called his work.
We have had problems with our finances and I did take out a few loans online. I was almost positive that they had all been paid. My poor record keeping made me doubt myself.
And then, he threatened my husband will be served papers and now this is a criminal case and he may be arrested for fraud. He had promised to pay and did not. He will be served and arrested if this is not taken care of out of court. If we do go to court you will be responsible for all attorney and court fees. Being arrested he may lose his job and so on.
I kept asking what loan service this was online. He kept saying he did not have all that information since the company ownes many websites.
So regrettfully, I paid it. I feel so stupid.
He called again, today, stating there was another loan taken out and that it had nothing to do with the first.
This time I called a my identity theft program. Which my husband and I signed up for some time ago to report it. The people there told me that this has been a common complaint. And together on the phone we conferenced called a fraud alert to all the credit reporting agencies. I also called Homeland Security and they said these people are most likely overseas and have numbers that look like a US phone number.

"They are good, they have different phone numbers"
They are using cheap VoIP phone service, so they can make their calls appear to be coming from any area code.

"Mine was out of Florida and the man had a strong foreign accent. "
They are probably callig from India.  A debt collector based in Florida that was shut down for illegal and fraudulent debt collection practices by the Florida Attorney General once had an Indian call center, which might be connected to these scammers.

"He even harrassed my husbands work place."
That is a common complaint with this type of scam.  They appear to have access to U.S. credit report information as well as skip-trace information, which would allow them to locate relatives and employers.  They use this to harass others as part of their extortion racket.

"We have had problems with our finances and I did take out a few loans online. I was almost positive that they had all been paid. My poor record keeping made me doubt myself. "
A lot of people are in your situation.  That is what allows these criminals to run their scam effectively.  They can either find hints of old debts through credit reports, or just guess, and with enough calls they might find someone to con.

"he threatened my husband will be served papers and now this is a criminal case and he may be arrested for fraud. "
That is what they always do.  They are criminals running an extortion racket, calling from overseas, and although those threats are illegal under U.S. law (FDCPA), they have no fear that anyone can touch them.

"He will be served and arrested if this is not taken care of out of court. If we do go to court you will be responsible for all attorney and court fees. Being arrested he may lose his job and so on."
They always play that up, even though they haven't proved there is even any debt you owe.  They are bunch of liars.

"I kept asking what loan service this was online. He kept saying he did not have all that information since the company ownes many websites."
He's making everything up.  It's a con, and he's phishing for what "information" YOU provide, to use it to con you.

"So regrettfully, I paid it. I feel so stupid."
You were defrauded.  Immediately contact your bank to dispute their fraudulent charges, and close the account or block the card number to prevent additional fraudulent charges.  Follow up with a fraud affidavit sent to your bank's dispute address from your statement.  Your bank can reverse fraudulent charges if you dispute them within 60 days of the statement date of the statement showing the disputed charges.

In addition, file a fraud and theft complaint with your local police, obtain a copy, and send it to your bank to substantiate your fraud dispute.

"He called again, today, stating there was another loan taken out and that it had nothing to do with the first."
He conned you once, so he's back for more.  In the scamming "business", it's called "reloading".  If you fell for it once, you might fall for it again.

You do not owe them any "debt".
    They cannot prosecute you.
    They cannot arrest you.
    They cannot sue you.
They are just criminal phone extortionists, calling safely from overseas looking for suckers.

There is no "Bureau of Criminal Investigation".  They are just criminals running an extortion racket, conning people out of money for fake "payday loans".

There never was a "loan" you owed them.  There is no "new loan" you owe them.  They just conned you once, so they are back for more.  As long as they keep getting money from you, they will keep coming back with more threats to get more money.

If you were defrauded recently, see if you can dispute their charges through your bank due to fraud and extortion.  FRB Reg. E and FCBA allow fraudulent charges to be reversed if disputed within 60 days of the statement date of the statement showing the disputed charges.  Back up your dispute with a fraud affidavit sent to your bank, and also file a police complaint for fraud and extortion.

Contact the FBI to file a fraud and extortion complaint.  They can verify that this is an increasingly common scam, usually run by criminals calling from overseas.

Legitimate debt collectors don't threaten you with arrest or prosecution, as that would be a violation of FDCPA.  They also send you a letter within 5 days of their first contact, notifying you of the alleged debt, and that you can dispute and request verification.

"Debt collectors" that do not act in accordance with FDCPA and state debt collection laws must be assumed to be engaged in fraudulent debt collection, with the likelyhood that the "debts" are fake.  They may be  using their illegal threats in place of the legally compliant notifications and verification to extort unowed payments.

High numbers of calls, rising to levels that are abusive or harassing, are in violation of FDCPA and state laws.  Again, this suggests that the callers are not legtimate debt collectors, and that the alleged "debts" are also fake.

    See above.

"Good luck to you", "god help you" (similar to "god help my soul") are commonly reported in connection with India-based fake "debt collection" scams.

"i hung up and reported it to the ftc"
That is the right thing to do.  If you call BBB, FTC, your local police, state AG, or FBI, they will all confirm that this is a well known scam.

You might also report it to a local TV or radio consumer reporter so they can do a story warning others in your area about this scam.

    He is a liar.

He is just a criminal, probably calling from India.

Half the "debt collection" complaints on this site are now due to these overseas fake "debt collection" scammers.

You don't owe them anything.  There is no "payday loan".  (They must think every American is up to their eyeballs in payday loan debt.)

They can't "arrest" you, they can't "prosecute" you, they can't "sue" you.  They aren't "attorneys".  They aren't "investigators".  They aren't law enforcement of any kind.  They are just criminals running a scam by phone.

All they can do is call you and harass you, and that only if you let them.

This company has called my job several times and also my cell stating that there were files that were going to be charges filed against for a criminal case and that I need to pay or have my attorney call them back. The switch board at my job contacted by supervisor making him aware that this company is calling for me through the switchboard back to back several times a day, what can I do?

I received a message from a Neil Stevens claiming to be from the BCI (Bureau of Criminal Identification)....his words, not mine. The number was a 707 number, which is Kelseyville, CA. His message was claiming that a friend of mine was a main "suspect" and since they have my name I could be in trouble also. It went on saying that I need to contact them before something bad happens to me. What they don't realize is I used to work in the courts and am aware that monetary debt should only be settled directly with the person or company, or through a civil judgment. No police agency is going to come arrest you for a civil debt owed. My friend and I are going to "return" the call this evening to see how far they take this. I will update soon.
