I got a call today at home from a man stating he was a process server for Collin County DA's Office and he is with the Sheriff's office and needed to come serve a warrant on me. I was shocked and asked why? He stated do you live ....are you still at this address are you now at this address and I stated who are you? He again, stated he was from the county going to serve court papers on me today. He gave me a toll free number for what he stated was the county's office which is 1 866.872.6116 gave me a case no. which he called a Cause No. 008307-TX. I called the number was transferred to a Mr. Fisher's office who stated that law suite in the amount of $6,214.24 was filed in Collin Co., Tx and that warrant was out for me. He then after back and forth said let me get more information from my secretary and state this was for an outstanding debt in from Capital One a credit card that I obtained several years back and had disputes over interest charges etc. He stated that if I did not want to go to court or jail that I could pay $1,951.00 in full by end of business today and this matter could be cleared up. I explained that I recently lost my job etc. Anyway, he stated that I needed to call him back by EOB today or they will serve the papers. Ok, so that was a heads up for me. I called the DA's office nothing is filed on me as of today, after searching PMG it is clear that they do not practice best practices for collections and have been in trouble for this before back in 2004. I need someone to give me advise. I want to pay off my debt, I don't want this type of collections to continue this upset me, made my blood pressure raise, this type of collections are not the right thing to do. Had they called and ask to make arrangements or give me an opportunity to clear the matter, rather then threaten me by taken legal action, or harassment stating they are sending a sheriff over today. This is wrong, bad business, and should not continue this company is bad news.

they may show up under several names: "HGG", "ARM", and "Mason" have been reported, but they use at least 15 names, so there might be others.

"Federal Privacy Act"? More likely it was the BSPA, "Bull Sh*tters Protection Act".
FDCPA requires that they disclose the original creditor and the current owner of the alleged debt if you request.
If he calls again, why don't you ask if the "private investor" is Jason Begley? Or Lowell Meyer?

Probably true, and for a fake "debt", probably illegally. It's part of pretending they are a "debt collector" and makes it easier to size up how much you are good for. Check your credit reports, in particular Experian, for a recent credit inquiry, possibly under the names "HGG" or "ARM".

Then you know that they are using the FDCPA as a list of what to do. They just don't get what the word "prohibited" means.

On a 2002 debt? In any state with an SOL of 8 years or less (most of them), it's run out. Past 7.5 years as well, so they can't report this bogus "debt". Maybe that was in case you asked why it wasn't on your reports? All moot on a fake debt, of course.

They always play up these "court and attorney fees", like they always win in court, to scare you into "settling". FDCPA violations for claiming you might owe what no court has decided you owe, as well as for threatening a "lawsuit" there is no indication they have any capability of doing, on a fake "debt". Deceptive collection.

They keep adding on the made-up "costs" of not paying them. It's easy when they are making it all up, but hiding where they are located to avoid lawsuits. Supposedly they have a bunch of boiler rooms in Corona, CA, running this scam.

Google "1251 Pomona Rd., Corona" shows lots of different companies with different unit numbers.
Several others have reported Experian, one other Equifax.

Bluff and the rest of the deceptive act point to fraud, and the likelihood the "debt" is fake. If it were real, and they had the right to collect, they could validate and would have no reason to violate FDCPA so routinely.
Did they have part or all of the actual card number that you remembered or could verify against your own records?
Did they just have some bank name (that they might have just guessed, or found on a credit report), and then claimed it was "from 10 years ago", with no proof? If so, what bank name did they claim?
Or did they just work the "con" off of some statement you might have made, like "That's not my debt, it's probably my ex-husband's", after which they started making up "reasons" why you would "owe" this "debt" of your husband's?
In other words, how much of this "con" is built on access to your account information, such as through pulling your or your husband's credit reports, and how much is a "social engineering" con?
