this company has been calling me for months from 760-563-5384. They just called my employer and left a voicemail message for me or my attorney to call them back immediately. I called the number back and got a CHRIS ROY of indian decent. HMMMMMM, okay there Chris Roy. I told him that i needed the name and address of his company, the original debtor and verification of the debt. He told me the name of his company, some debtor that i never heard of before and would not send me the verification of the debt. Sounds fishy to me. He then proceed to threaten me and tell me i can deal with in it court. Not really scared since i am a legal assistant and know the law. I do however want to know how to get these A*& holes from calling me and my employer.

Profile fits phony "debt collector" extortion racket.
For some time they have been calling under various names with phony debt claims and making threats of lawsuits or arrest. They are generally reported to have Indian, Pakistani, or middle eastern accents, but "American" names. They may be calling from overseas, and are often reported to spoof caller id. They are also reported to have obtained access to U.S. credit and skip-trace data, and old payday loan data from some defunct lender, and use it to fake "debts" or harass relatives or employers.
There are several Attorney General warnings out about them, and you can find complaints matching this profile under several (probably phony) names, on this site under "Collection Agencies".
Their alleged "debts" are fake, not owed, and even if they sound like a debt you owe, you would not owe it to them. Many people they claim owe "payday loans" never took out a payday loan. They cannot sue you, they cannot arrest you, all they can do is harass you if they think they can extort money from you. You did not do anything to attract their attention.
They are just criminal phone thugs.

They didn't email you anything, unless it was a "phishing lure". FDCPA would require that they MAIL you an initial notice. They aren't real "debt collectors". They are Pakistani or Indian scammers, and they are liars.

Phony "debt collectors" fitting ths pattern are often reported to have gotten access to old payday loan data, as well as U.S. consumer credit data. No matter what they tell you, it doesn't prove you owe them. They are liars.

They like to harass people at work because it is more intimidating and threatens to embarsss them in front of their employer or coworkers. This is an extortion racket. They are liars.

Do you actually owe any payday loan? If you did, it is unlikely you would owe it to these con artists.

Complaints against that number start showing up only at the beginning of July 2010. That is an indication they are probably changing their numbers, to interfere with locating them. Real debt collectors usually have months of complaints and don't change their contact numbers.

They are not "attorneys". They are scammers and liars.

They are extortionists, scammers and liars. They won't file any "court papers", and the police won't come to your house, unless it is to take YOUR complaint.

That would be illegal under U.S. law, specifically FDCPA. But they are con artists and scammers. They are often reported to use threats of embarassment with employers as part of their intimidation tactics in this extortion racket. If your employer actually gets any of their calls, file a police complaint on the incident, and make clear these are just phone extortionists. No one owes them anything, and you did not do anything to cause them to harass you. They just found your credit and identity information and decided to con you.

They may be calling from India or Pakistan, via VoIP.

Area code means nothing, since VoIP can pop up in the U.S. under any area code. Phone number could even be spoofed, but if you can call back, it may indicate it's some VoIP service, so you may be able to pass that on to the FBI. They can also confirm that these are scammers.

They are not reported to be that bright, perticularly in faking the appearance of "imminent legal action", but a lot of U.S. consumers aren't either, and U.S. debt collectors often engage in similar deception.
Many of them use movie star names, particularly action heros.
They still can't fake a real U.S. accent.

They are trying to sound like "attorneys". Don't expect them to show up anywhere near California any time soon. It's all bluff to scare you into paying them.
If any attorney DID really sue you, they would have had to serve you, and the summons would be checkabla against filed court documents. If they didn't actually serve you, that would be a basis to have any court decision vacated.

BUT it gets better...this guy called a friend of mine and said the same thing. My friend asked him to give him information as to what it was about. The guy called him an Az$#0(e and my friend was taken aback. He asked this guy "What is your physical location?" and after repeating it a few times, the guy said Miami, Florida. He said "Did you call me an .......?" and the guy said "Yes." He responded with a rude phrase and hung up on dear old Ben.
I'm glad that other people know what I'm talking about. I was worried that maybe my ex had messed me over or something. Glad to know it's a scam and I'm right to ignore "Mr. Schneider".
