payday loan
Complaint
trying to scam me
Country: United States
I had taken a few payday loans out last year (because it was easy) and thought I would be able to handle them, but I was not able to and a couple of them went to collections. Check N Go sent mine to a collection agency I guess. I got a couple calls at work and did not answer then on my cell phone and the left a message saying she was "Ashley Banks from county proceesing summons division and that they are filing for a cad check with the intent to commit fraud" They will serve a warrant at my house or work if I dont contact 888-392-5753 ext 516.
Do I need to contact an attorney?

It's basically an extortion racket.
Engaging in illegal threats, harassment, and refusing to provide any verifiable information on the alleged "debt" are indicators that this is a con, and that the "debt" is fake.
With these types of eggregious violations of law, most likely you will not be able to find them, or they wouldn't be able to get away with it. These are just criminals running a scam.
File a fraud and extortion complaint with FTC and your local police department.
They are running a con.
Debt collectors are required BY LAW (FDCPA) to send you a letter within 5 days of their first contact, notifying you of the alleged debt, and providing contact information you can use to dispute or demand validation (proof) you owe it.
The scams never send the letter. Instead. they have prepared scripts with ready made excuses for why they don't have to, like that they are supposedly just "process servers", or that they are not "debt collectors".
They are a bunch of lairs.
They have a new name an number now. Ms. Smith at 855-298-1439 ext 160. They are now called Creditor's. I called them out today and told them they were Progressive , she got upset and said no she was not. The so called account used to be with Progressive now they have it. I asked her for validity of the debt no response. I want they to serve me so I can sue them and then some. They are fishing for info. Watchout for this number.
The number they ate calling me from is 832_497_5581. They fooled me the first two phone calls and I lost bought 600.00 what I paid them but they not get no more.I had even told them my identity wad stolen and they didn't care they had social, bank numbers, address....
I am so mad, they took from my kids and I wish I could get my Money back. Live and learn I guess.
Thus sucks bad. If anyone could help me I would appreciate it very much.
He stated that he called chase bank and verified my account. I laughed and said chase is a huge corporation they would not verify and information on anyone unless the party involved gave their permission. He got mad and hung up. Scam artists.
They commonly set themselves of a collections agencies, which allows them to get access to credit reports (often through Experian), skip-trace info including relatives and employers (often through Accurint), and phone search databases. Whether they have any real "debt" to collect, they can easily fake the appearance of it, with complete access to your old bank and credit card account numbers that may go back farther than your own memory.
Is the "debt" valid, and do these thugs have any right to collect it?
Who knows, but if they have to lie, even impersonating law enforcement, which is a crime, what does that say?
No sheriffs deputy from another county is going to show up in your county, at your home or work. Owing debt isn't a crime, although the phone thugs like to pretend payday loans are "bounced checks". Even any out of county law enforcement actually making an arrest would have to work through YOUR sheriff's department, as they don't have jurisdiction out of their county and it would be a major jurisdictional blunder to work around your county's own law enforcement like some outlaw bounty hunter. A real process server wouldn't call ahead to tell you they are coming, even just to serve a summons. If some stranger is calling you on the phone pretending he's going to just show up, implying you should call back and "settle" before this "lawsuit" goes forward, you are dealing with a con.
Contact your local sheriff's department and court house to confirm there is no "lawsuit" and no "summons". They've probably had other complaints of similar scams.
