I emailed you twice since 05/09/11 that I had processed a case#381=400733 and acquired for the client 1567.00 of his 2700.00! The rest of the money goes to his former spouse Michelle H. Colligan same case# I wish to process her refund but it is no longer listed as a prospective client in the system! I wished re-instatement for this case#! I have not heard anything from you even though you advise I should hear from you within 24 to 48 hours! Get with it please! James Pagoota

    What is psychological harassment in the work place?

    Psychological harassment is vexatious behaviour that manifests itself in the form of conduct, verbal comments, actions or gestures characterized by the following four criteria:

    They are repetitive*;
    They are hostile or unwanted;
    They affect the person’s dignity or psychological integrity, and
    They result in a harmful work environment.

    Sexual harassment at work is also included in this definition.

    What is vexatious behaviour?
    It is humiliating or abusive behaviour that lowers a person’s self-esteem or causes him torment.

    It is also behaviour that exceeds what the person considers to be appropriate and reasonable in the performance of his work.

    Psychological harassment may come from a superior, a colleague, a group of colleagues, a customer, a supplier…

    * A single serious incidence of such behaviour may also constitute psychological harassment if it undermines the person’s psychological or physical integrity and if it has a lasting harmful effect

    A few common ways in which harassment is expressed

    Making rude, degrading or offensive remarks.
    Making gestures that seek to intimidate, engaging in reprisals.
    Discrediting the person: spreading rumors, ridiculing him, humiliating him, calling into question his convictions or his private life, shouting abuse at him or sexually harassing him.
    Belittling the person: forcing him to perform tasks that are belittling or below his skills, simulating professional misconduct.

    Management rights and normal conditions of employment

    Psychological harassment must not be confused with the normal exercise of the employer’s management rights, in particular his right to assign tasks and his right to reprimand or impose disciplinary sanctions.

    Insofar as the employer does not exercise these rights in an abusive or discriminatory manner, his actions do not constitute psychological harassment.

    Prevention first

    Prevention in the undertaking remains the best means of combating psychological harassment. It is the employer’s responsibility to take reasonable steps to prevent psychological harassment and to put a stop to such behaviour when it is brought to his knowledge

    Promote respectful interpersonal communication.
    Manage the members of his staff fairly.
    Take quick and appropriate action to manage conflicts; do not allow the situation to deteriorate.
    Clearly define the responsibilities and tasks of each employee.
    Put in place in his undertaking a procedure that is known, efficient, credible and adapted to reality, to allow persons to report cases of harassment confidentially.
    Resort, in certain cases, to specialized resources to help put a stop to a psychological harassment situation and to prevent other such situations from arising.


    What should you do in the event of psychological harassment at work?

    Wherever possible:

    Talk about the problem you are experiencing with someone that you are close to, a person that you trust. Do not remain isolated;
    Express very clearly to the person who is the source of the unwanted behaviour your wish to see such behaviour cease immediately.
    Check inside the undertaking if there is a procedure making it possible to report the unwanted behaviour confidentially.
    Bring the matter to the attention of your employer who must put a stop to this behaviour by taking appropriate steps.

    The Act respecting Labor Standards provides a recourse in the event of psychological harassment at work, which is available to every employee, whether unionized, non-unionized, or at the senior managerial level. The Act sets a 90-day period to file a complaint

    I am appalled at the ignorance displayed here by people who do not know what they are talking about and have not given the system a chance to work. When dealing with federal  government one is always dealing blind. They will do what they say only when it suits them. But give credit to Smart Tools people for creating very smart software that makes this effort a job without work. Once a name is selected and the record shows up, the issue is simple. Correct and edit the information shown and hit UPDATE. At this point the case is solved. The computer puts that client into the resolved listings no matter what you do in  contacting that person. It is forever your own case. Select the appropriate letter and or contract agrreement from the drop down list and hit print. What could be easier?? The letter goes to the client and your cost is one stamp. You wait until you have worked the case and the computer will then put that case into the Archived listing meaning that your work is done and you are then waiting for the check to be mailed to the client and them paying you. Nothing could be more simple without work efforts. Smart Tools is the best software possible and totally workable by anyone using a computer and the internet. I started in March 12 and now have several of my cases in archived status. All the letters are a work of genius worded appropriately for good business. No client has a phone number but all have addresses. The case was started at least twenty years ago when a mortgage was begun. Nothing can be improved upon.     How Does the Delphi Technique Work?

    •Always be charming, courteous, and pleasant.  Smile.  Moderate your voice so that you do not come across as being aggressive.
    •Stay focused.  Jot down your thoughts or questions ahead of time.  Do not fall for the tactics and make sure that they answer your question.   This may require you to politely repeat your question until you receive an answer.
    •Be persistent.  Continue to politely repeat your question.  Never become angry under any circumstances.

    This is one of the perennial manipulation methods of con artists. They create a web of lies laid around so thick, that it warps reality for you and makes you fall victim to their manipulation. The only way of saving yourself is to check for inconsistencies and recognize bluff. Be slow in trusting is my rule. Till you know a person closely enough, avoid sharing personal and financial information. Be wary of any offers, business proposals that are just too good to be true. On a more deeper level, avoid basing your decisions on flimsy bits of information. It is always best to verify sources of information and test the validity of statements before basing your judgment on them. Again, taking your time and thinking things through is always the best defense mechanism against getting sucked into a vortex of lies. Resist impulsive decisions and you should be fine.

    We all know how this goes. Emotional manipulators will always make themselves look more of a victim than you are.

    They crave for attention, which is why they're not always happy when you get the limelight, even if it's just for a headache. There's really no getting around to a person like this.

    Perhaps with the right timing, a huge and frank outburst might get through to their head. However, it's easier to just let that person be and avoid commenting anymore.

    The truth is, psychological manipulation techniques are often used by cowards. They can't do direct combat; so they will usually resort to sneaky ways to get you to do what they want. Now that you know what some of these dirty tricks are, hopefully, you'll be able to avoid getting sucked into them.

    Basic manipulative strategy

    1. Assessment phase

    Some psychopaths are opportunistic, aggressive predators who will take advantage of almost anyone they meet, while others are more patient, waiting for the perfect, innocent victim to cross their path. In each case, the psychopath is constantly sizing up the potential usefulness of an individual as a source of money, power, sex, or influence. Some psychopaths enjoy a challenge while others prey on people who are vulnerable. During the assessment phase, the psychopath is able to determine a potential victim’s weak points and will use those weak points to seduce.
    2. Manipulation phase

    Once the psychopath has identified a victim, the manipulation phase begins. During the manipulation phase, a psychopath may create a persona or mask, specifically designed to ‘work’ for his or her target. A psychopath will lie to gain the trust of their victim. Psychopaths' lack of empathy and guilt allows them to lie with impunity; they do not see the value of telling the truth unless it will help get them what they want.

    As interaction with the victim proceeds, the psychopath carefully assesses the victim's persona. The victim's persona gives the psychopath a picture of the traits and characteristics valued in the victim. The victim's persona may also reveal, to an astute observer, insecurities or weaknesses the victim wishes to minimize or hide from view. As an ardent student of human behavior, the psychopath will then gently test the inner strengths and needs that are part of the victim's private self and eventually build a personal relationship with the victim.

    The persona of the psychopath - the “personality” the victim is bonding with - does not really exist. It is built on lies, carefully woven together to entrap the victim. It is a mask, one of many, custom-made by the psychopath to fit the victim's particular psychological needs and expectations. The victimization is predatory in nature; it often leads to severe financial, physical or emotional harm for the individual. Healthy, real relationships are built on mutual respect and trust; they are based on sharing honest thoughts and feelings. The victim's mistaken belief that the psychopathic bond has any of these characteristics is the reason it is so successful.
    3. Abandonment phase

    The abandonment phase begins when the psychopath decides that his or her victim is no longer useful. The psychopath abandons his or her victim and moves on to someone else. In the case of romantic relationships, a psychopath will usually seal a relationship with their next target before abandoning his or her current victim.

    Sometimes, the psychopath has three individuals on whom he or she is running game: the one who has been recently abandoned, who is being toyed with and kept in the picture in case the other two do not work out; the one who is currently being played and is about to be abandoned; and the third, who is being groomed by the psychopath, in anticipation of abandoning the current "mark".
