We attended their presentation and after some calculation decided to pay for the membership which was $4990. We wanted to update our kitchen and bathroom cabinets, as well as bedroom furniture. We put down about $1000, and the rest was financed through their lender Beta Finance.

A month later we started planning our purchases and realized we were about to pay more by buying through them than we would otherwise. What the don't tell you on their presentation is that while you save about 10% on furniture they add 8 % handling charge in addition to 7% tax, and that doesn't include shipping.

I am now trying to get our membership money back. Do not become a member! Buy from other stores.

    YOU did not mention where you live, look up your Consumer Protection Act
    and/or Unfair trade practices act--some Acts have both in their titles

    PLEASE POST AT THE END OF THE FILE & DON'T LET THEM AWAY WITH IT!!!
    IN YOUR CASE, some local news station or consumer advocate might be interested in bringing a camera in, to see the merchandise,
    OR video tape it & send it to a news stn.

    I WAS really happy to see that an article actually referred to Complaint Wire,   YAY!!  WE HAVE TO GIVE OURSELVES SOME CREDIT FOR THAT,

    or DB might wake up, & get a conscience  & JOIN US!!!

    db IS NOT BOUND by ANYTHING VERBAL & OR WRITTEN ON THEIR ERASABLE BOARD,
    SO FAR, mpst contracts say: "not bound by verbal...No cancellation, no refund, no returns...)  that is the reason for the confusion,
    they would not dare put in writing what they promise verbally!

      ALTHOUGH,  they ARE BOUND     by their 3 day cooling-off (corp. policy)
    they are BOUND by the CBC Marketplace Video, THE PRICE CUT PROMISE
    -revised contract,March 09,  inc. 3 days...
    the  CPA and/or UTPA do protect vs. High pressure tactics
    & FRAUD, db deliberately neglecting to inc. a material fact in the contract
     IF the potential member knew, they would not join

    Hi Trudy,

    I have been checking back and have never seen a reply from you, so I am writing again.

    My wife and I joined in Virginia, and I want to force DB to recind my contract. I intend to write a letter similar to the ones I have seen here, and then file a claim in small claims court.

    Any other advice you (or anyone here)might have would be appreciated.

    Hi Trudy,

    I am preparing to send a certified letter to DB and their registered agent.

    I will happily file a claim in small claims court. This will require DB to pay their registered agent (another law firm here in Virginia) just to respond.

    Let's see how much they are willing to spend (or lose) trying to enforce their contract.

    If anyone has gone this route before me and has any advice it would be appreciated.

      Don't play games, db will laugh, stall you & delay you,
    As far as I know, a registered agent is a process server to notify of a court summons, please let me know if I am wrong,
    YOU PAY THE AGENT, WHY WOULD DB HAVE TO PAY?
      DB is not obligated to even accept your Registered Mail, so I always recc, NO SIGNATURE REQUIRED, then you get your proof of sending it from the post ofc.
      A registered letter should be all you need, directly to db,
    but if you want to start a court action, you need to show proof to db of what you want to claim from them,
    & you need to inc. your proof, in your court claim,

    there is alot of info. missing in your post,
    what am I missing...?

    My first (ever) post to this website is on page 100. Perhaps you never saw it because I have never seen a response to it.

    I am not a lawyer, but as I understand it, yes, if I want to drag Double Dash Inc. dba DirectBuy of Hampton Roads into court, I must have the summons sent to their registered agent. If the summons is not received by their registered agent then they were not "legally served". However, once Double Dash Inc's registered agent receives the summons from me, they will be forced to deal with it (me) through legal channels.

    My understanding is that their registered agent works for them, I do not have to pay their registered agent, DB does. Any corporation doing business in Virginia, is required to have a registered agent in Virginia. The registered agent for Double Dash Inc. dba DirectBuy of Hampton Roads is a lawyer from some group in Richmond Virginia.

    Unless He's a brother-in-law or already on the payroll, I'm sure that the lawyer from the group in Richmond will begin to charge them for phone calls, and for the filing of court papers, motions etc... it will cost DB $$$

    As you note in on your website, there are lots of laws that these ratbastards are breaking. How many laws are they breaking? That's how many times I will drag them into court. I will keep going back at them over and over and over ... they'll get the message.

    I am NOT joking around with DB I am dead serious ... If they want to be AH's ok, bring it... I can be just as big an AH as anyone else.

    I feel like I may end up being a lawyer by the time I'm done... But, I will make 300 trips back to the local courthouse and sue these [***] 1000 different ways before I send them a nickel.

    I need proof to win, not to send a summons...  

    That's what my plan is right now... has anyone tried this before?

    yeah, well there is no way to recoup the money spent on membership.  i'm trying to work it out with the db we joined.  they are bending over back- ward to accomodate us.   So what the hey, just go ahead and spend the d _ _ m money and learn our lesson, reading agreements or contracts before committing.  we have to get our renovation done and whatever it costs we have to do it.

    PLEASE make sure that you get everything in writing from
    all your db contacts that you use for your reno.

    Remember that they subcontract their suppliers,
    get a written guarantee of quality, quantity, delivery date & details,
    return & refund quarantee for any excess materials ordered,
    since they subcontract,
    you have some power to demand company names & make written price comparisons,
    they know that you can still complain about them

    As for CONTRACTORS, they are real dirty scammers, too,
    & often refuse to give you a written price, UNLESS YOU AGREE ON THE SPOT
    --they tell you that they will "write up the contract, with a discount, if you want that price, you have to agree right now,
    ...they can't write it up, unless they know what you want...

    --DEMAND THE WRITTEN DETAILS, WITH ESTIMATE, SO YOU CAN READ IT, THINK ABOUT IT & COMPARE IT TO OTHER CO'S

    ****MAKE SURE YOU ASK THEM TO SPECIFY IN WRITING, ANY DEPOSIT WANTED,
       & DO they accept Credit Card payments
    Anyway, still keep copies, & Good Luck with everything!

    Sorry, I missed your 1st post, it gets overwhelming sometimes,
    I still don't understand the Registered Agent rules,
    but ask as many ? AS POSSIBLE,
    JUST remember that Beta will send you to 3rd party collections, if you don't pay, no matter what action you take, db is not obligated to stop their contract conditions, just because you want to sue them,
    you are obligated, unless db agrees to rescind, ...refund in writing,

    also, there is a limit to how many times you can sue a company,
    & if you keep filing claims, IT will cost you a fortune & the court will throw them out,
    & consider them frivolous, & THERE ARE CONSEQUENCES FOR BECOMING A NUISANSE TO THE COURT,

    So, be as organized & as specific, as possible...

    It didn't take long for me to realize that DB is NO bargain as they were very late in getting me quotes that I beat them to it only to find out I could get items cheaper on my own.  I was told that if I didn't sign that nite I couldn't join for another 7 years!! I had a witness with me as we went in together.  My credit card company sided with DB inspite of the history and arguements I gave them.  I stopped my payments and the collection agency called my work, not only to me but to my HR department firing hostile statements to them because they wouldn't give information to them. I was told by them I"D better get a good lawyer - this DB are real serious about keeping your money.
    It seems that DB sells their debts to collection company and after that I received another membership card to do business with them.  These sales people use the most crude and intimidating means to get a contract signed and I am just sick that I was convinced DB was a good way to get the deal they sold me on.  
    I wrote to the collection agency how they disobeyed the law upon contacting my work and to cease and desist any further contact.  I think I got lost in the shuffle of all their legal ranglings.

    From my experience, you can't cancel - you signed an agreement and that is the bottom line no matter how you feel you were ripped off or lied to.  In their contract it also says , words to this effect, they are not bound by any statements made.  I guess I didn't really see that before I signed.  READ VERY CAREFULLY BEFORE YOU SIGN ANYTHING!!!!!!!!!

    Going to the Attorney General isn't helpful unless there is a combined lawsuit involving many in your area.
