We attended their presentation and after some calculation decided to pay for the membership which was $4990. We wanted to update our kitchen and bathroom cabinets, as well as bedroom furniture. We put down about $1000, and the rest was financed through their lender Beta Finance.

A month later we started planning our purchases and realized we were about to pay more by buying through them than we would otherwise. What the don't tell you on their presentation is that while you save about 10% on furniture they add 8 % handling charge in addition to 7% tax, and that doesn't include shipping.

I am now trying to get our membership money back. Do not become a member! Buy from other stores.

    Hi Trudy....thank you so much for your reply...you would not believe the amount of sleep I am losing over this (or perhaps you would!)  I actually received an email from the DB center today confirming cancellation of our membership.  The email was not addressed to us personally, it simply said "Hi".  It also did not specify that our pre-authorized debits had been cancelled.  It did however comment that they were mailing a refund cheque tomorrow.  Is this all the written confirmation we require?  Should I call the finance company to request confirmation of cancellation or should I mail my request?  All that I have received from them so far is a form letter outlining the payment schedule.  I have an address and a telephone number for the company.

    I don't believe the class action filed in Connecticut seeks to obtain a refund of membership fees.  If you want membership fees back, you should contact the firm that is planning a national class action that will seek refund of membership fees:

    That California case is seeking damages on behalf of California residents only.  The Connecticut case is a national class, but is not seeking a refund of membership fees.  I am not aware of any current class actions that are national in scope and seeking refund of membership fees.  I was told that is what Craig Matthews' suit intends to do.  I gave his contact info earlier.

    Individual requests for refunds is not going to force DirectBuy to change.  A national class action could do that however.

    I suggest sending the reg'd letter that I outlined to you before wasting any $ & time "filing suit"
    When you file any kind of suit, the judge wants to know what you have done to try to resolve the problem, prior to filing.  The judge also wants to know if the company has tried to make any solutions to try to resolve the problem, and whether or not you agreed to any part of anything the co. may have offered to  you.
    As I mentioned, there are laws in Florida to help you.
    I hope you will consider this, because since you only joined about a month ago, you have an excellent chance of getting your $ back.

    If your goal solely is to get your membership back quickly, the method Trudy recommends might work.  Some members have tried writing and have not been successful.  If you want to get your membership back *and* help put an end to DirectBuy's tactics so that others across the country will not have to go through what you went through, you might want to consider joining the national class action Craig Matthews intends to file.  Normally the plaintiffs in a class action do not have to front any costs and there are no legal fees, so you would not waste any money.  A class action likely will take some time, but you would be helping out literally thousands of people all across the country.

    I suggest to call the post ofc. to make sure that db rec'd your letter,
    count 10 Business Days from that date and send a follow-up fax
    Remind them that you have not heard from them since you reg'd letter received by them on __________
    Remind them that the contract should not have been approved, based on the "not being common-law " diff't addresses...
    ...under undue stress to join...no  savings...

    u.c.c. total home was there previous name before they got sued...so all they did was change their name to try to trick people again...
