We attended their presentation and after some calculation decided to pay for the membership which was $4990. We wanted to update our kitchen and bathroom cabinets, as well as bedroom furniture. We put down about $1000, and the rest was financed through their lender Beta Finance.

A month later we started planning our purchases and realized we were about to pay more by buying through them than we would otherwise. What the don't tell you on their presentation is that while you save about 10% on furniture they add 8 % handling charge in addition to 7% tax, and that doesn't include shipping.

I am now trying to get our membership money back. Do not become a member! Buy from other stores.

    Hi Pat
Your example is unfortunately too familiar & typical of db.
I really hope that I can help you, Dawn & I are both in Ontario & we both got our $$$ back...read our letters from P.15 to 17.

The 1st thing that I thought of, is to take lots of pictures of the cabinets, keep copies & find your written proof of the colour ordered & the colour you rec'd to go with the pix
Can you give me a bit more info, inc. were you allowed to contact the supplier/contractor/installers directly, after the fact?   Or did db make a complaint for you...or did they just leave you with the mess?
Refer to the Consumer Protection Act of Ontario
Undue pressure to join  (still no cooling-off period? I think)
Misrepresentation of products, quality,...there's so many laws that you must read to inc. in your REG'D LETTER...refer to my previous letters...
Make sure that you request for their response ONLY IN WRITING
Let me know some details, & ask any questions...

    HI ROGER
You should be proud to know that we have been helping people since April 10, 2009.  I'm so glad that we are making "a dent" IN DB...people are finding this site more often & faster...& gaining some hope that there are laws, even tho I had to find out on my own, with no help at all.

I felt absolutely helpless like the others who need help, & I read my contract over & over.."No Refunds"..."Cannot contact suppliers directly"...
I was swearing at myself, what the hell did I do...how stupid...
but I got quick results because I found the CPA branch & they told me I had rights.
I almost fainted in shock... as if a gov't agency was going to help...amazing that they told me about "undue pressure"...etc.
One very strange thing, if you can believe that I personally do not know one single person who has been scammed or admitted to it.

I do recall being at the post office, mailing my reg'd letter & I told the clerk about it & she said that just by coincidence, she had went on their website the day before, and she was already getting phone calls from them.   She couldn't believe that I reached her just in time...& I kept her informed of my progess & my success.
Another incident was after I just joined & I was so sure that I was going to save $$$, I told a friend who had not told me that she inquired & was getting non-stop calls from them. "No wonder they were so agressive..."
As soon as I told her the price, she told them to stop calling.

PLEASE KEEP UP THE EXCELLENT WORK BY WARNING PEOPLE...!!!!!!!!!!!!

I unfortunatly joined DirectBuy in Little Rock and it has been a terrible mistake and total fraud.  In light of the current economy, I am able to purchase anything I need for much less than DB pricing.  Stores and outlets are in price war and more than willing the "wheel and deal" pricing; whereas DB is set at a per centage off MSRP.  Who uses MSRP in this economy!??  It is a total rip-off. I have tried unsucessfully to get out of it and pass the word along to everyone I know to avoid the trap.  Unfortunaly, I am stuck paying $5000 for the "privledge" of buying more expensive merchandise, having it shipped (at my cost) to a storehouse (which charges a storage fee if not picked up promptly) and I have to pick it up and deliver it to my home, using my manpower or family.  CRAZY.  Unfortunaly, I contacted them two days after the three day grace period and was brushed off by the Owner.  My mistake for being sweet-talked into it and thinking I would "miss a great deal" if I didn't do it...on the spot...without seeing any products of what I could purchase. You have to price check every outlet and know the exact product you might purchase and most likely will find it cheaper at a retail outlet and can take it home that day, rather than wait 6 weeks for delivery with DB. It is a total scam...DONT DO IT!

I've gotten into the habit of going on-line to check for complaints when investigating any products or companys.  With DB, I'm so glad I did.  Thank you for this useful and informative site.  My only question now is why hasn't the U.S. Attorney Generals office not put an end to this scam????  Seems like a good use of taxpayers money to illiminate fraudulent corporations like this one.

Trudy, have received NO response from letters or from FAX.  Yes I have contacted consummer protection.  Recieved an e-mail from consummer protections stating they would be in touch -- they did not get in touch.  Thus contacted consummer protection a second time to ask how long before they would be in touch --- no response.  What next?  I have not get contacted the AG was waiting to hear from consummer protection.

Thus far I have followed Trudy's suggestions.  I have included all she said to include and have not received one word from the store or company.
How long did it take you from start of process to receiving your check?

    Trudy,

Glad to see you agree that a class action is a good idea!

The latest class action will be a national class action. Interested persons should contact Craig Matthews.  937-434-9393 or cmatthews@ctmlaw.com.

I know he is interested in hearing from members who purchased merchandise and want their membership fee refunded and also want damages for the excessive price they paid for merchandise.

Google :SCDCA HOME PAGE  --go to complaint services & follow the instructions on how to file a complaint (by mail) I never suggest E-file.

Call scdca & ask if they suggest that you try to contact db again by mail, & let db know that you are in the process of filing your complaint with scdca...I think that scdca will agree to that, (It may help db to realize that you are serious and you have caught them in their scam)
You are in a better position now because you now have evidence to prove that they deliberately withheld your password...Evidence of their ruthless desparation...
After they process your complaint, they will give db 30 days to respond.
Make sure that you inc. that you want a refund in full (nothing less)...
Any questions, let me know...Don't give up, they should cave in soon...

    HI TOM
I hope that you understand me better now, because I cannot sit & hear these complaints without trying to help people to fight a.s.a.p., any way that they can. They can still bring their evidence to the class-action suits to help build as much evidence as possible vs.db.
Refer to the RITA case above, because I did not keep asking her for details, no one would ever know how ruthless db was to her.
We have to keep exposing their methods as fast and furious as possible.

    The victims in CT
We were scammed as well. $4300.00 out the window.  We did not have the opportunity to buy because the Connecticut office does not work with members.  They rope the unsuspected in on Sundays and then walk away with your money like thieves.

I here that Channel 8 News in CT is running a story on the Rocky Hill location.  Evidently, they have had a great deal of feed back from victims of this location.

Hi trudy this is a copy of my letters let me know what you think, please thanksTo the director or manager of Direct Buy Coquitlam branch.
This letter is being written to request my money returned to me,because of your tactics in cohearsing my enrollment into your company and for a breach of contract on your part ,you have not fulfilled your obligations to me.I believe that I was sold this membership under deceptive practices.I am wanting a rescission of my contract I feel Ive given you enough time to prove your company and you have failed miserably! When I visited your showroom I was informed that I could get everything I needed for my renovation(except lumber ) at a huge savings to me. I began having problems immediately with something as simple as a playpen for my neice, which I had to buy elsewhere because the model was now discontinued, after it was paid for and ordered, a week later I was notified of this, this is bad business practices.Next was my attempt to order your Ducane furnace the only one available but that to was discontinued so that had to be bought through another company.I then tried to hire one of your gas fitters to install my gas line and was told it would be a six month waiting period!Unbelievable. As for my windows the vendors that are supposed to save me money were all extremely more expensive than other companies without my discount. After all this I then tried to order my washer and dryer from you and was told the model and color that I wanted was not available to direct buy,I was told that with my membership I would be able to buy products that other retailers carry at a large discounted price, this has been one of your deceptive practices that I have been a victim to over this last year.I feel that you have breached your contract with me.Ive tried to order my gutters and vinyl siding but they are not available through you,but I  was informed that all my renovation needs would be met, excluding lumber, that is another misrepresentation of your company.I would like a full refund as your company has not fulfilled any of the obligations of our contract..I am requesting a full refund or further action will be sought,I will expect a reply within two weeks, that I feel is a prompt time to get this problem resolved. This was my first letter no reply.then this fax To Mr Steve Pippy and Mr Steve Reutz.

My registered letter was received by you on the second of July, yet I have heard nothing from you about this situation we are in I am awaiting for your con formation that the contract will be rescinded due to your companies cohearsment and undue stress in getting me to sign, also the fact that you have breached the contract with your products. The materials were not available to me as I was told before signing. The other problem with this contract is the fact that I am not married and you have my exboyfriend down as my spouse, weve always had different addresses and never lived commonlaw.I expect your prompt reply as I will be taking action against your company. And now this final letterMr Steve Pippy and/or Mr Steve Reutz
This is my second letter to your company the first was received on the 2nd of July.I have found that your company has used "deceptive act or practice" means, in relation to a consumer transaction,
    (a) an oral, written, visual, descriptive or other representation by a supplier, or
    (b) any conduct by a supplier
that has the capability, tendency or effect of deceiving or misleading a consumer or guarantor; These deceptive practices have been used by your company when I was informed that I would be saving money and that everything I needed to remodel my home would be available to me,except lumber.Your company has also breached "representation" includes any term or form of a contract, notice or other document used or relied on by a supplier in connection with a consumer transaction.
    (a) a representation by a supplier that goods or services
    (i)  have sponsorship, approval, performance characteristics, accessories, ingredients, quantities, components, uses or benefits that they do not have,
Your company informed me that I could purchase my furnace from you and then there was none available to me,also the washing machine was not available to direct buy members. All the reasons for wanting a recission of my contract were outlined in my first letter to you.The outcome I am looking  to Remedy for an unconscionable act or practice
10  (1) Subject to subsection (2), if an unconscionable act or practice occurred in respect of a consumer transaction, that consumer transaction is not binding on the consumer or guarantor.I will except a reply within 10 business days or I will have to take further actions against your company, you may E-mail me Thanks alot
