We attended their presentation and after some calculation decided to pay for the membership which was $4990. We wanted to update our kitchen and bathroom cabinets, as well as bedroom furniture. We put down about $1000, and the rest was financed through their lender Beta Finance.

A month later we started planning our purchases and realized we were about to pay more by buying through them than we would otherwise. What the don't tell you on their presentation is that while you save about 10% on furniture they add 8 % handling charge in addition to 7% tax, and that doesn't include shipping.

I am now trying to get our membership money back. Do not become a member! Buy from other stores.

I contacted the firm Cohen & Malad in Indianapolis re their class action suit.  He said they indeed had one, but a firm in Conniticut just settled a class action suit that would include me, and I assume, all others.  He said to watch the mail for information on the settlement.  I have asked him for the name of the firm in CT.

Trudy I would like to get your info, so that I can contact you directly (email). Unfortunately, my mother and myself were victims of the sorry DB sales tactics. We were herded around like cattle through the show room and given a very short introduction. It all sounded so amazing at first, but I questioned the idea of making such a fast decision on a 5,000 dollar plus membership fee! The sales person told us we could order coupon for fast food and groceries online. He didn't bother to tell us the trouble you had to go through to do it and most importantly that after spending 5,000 on a membership fee that when ordering the coupons it was necessary to provide them with a credit card number! We have tried several attempts since going into the store on March 18, 2010 to get in contact with a manager, but we have had no success. I take it the old saying still holds true "If it sounds too good to be true it probably is"!!
    A. Connor any help would be much appreciated! arthur241070@yahoo.com

    Trudy how is this letter?
i have 4 examles of price matches that i will attach

    Dear, Dandeneau & Associates LLP
          address

My name is Blank; I filled out a contract with you on March 25 of 2008. I hereby RESCIND the contract signed on 03/25/08. I demand a Full Refund of all monies, including but not limited to, our deposit of $1500 and all monies paid to Fair Finance/ Duvera Financial. I want a written confirmation of cancellation, including a statement from Duvera Financial stating that I do not owe any money. I am requesting a rescission due to the fact you/Direct Buy have violated the Utah consumer sales practice Act chapter 13-11-4, Deceptive Act or Practice. The price advantage promise that you claim does not exist, I have price matched and have found examples. See attached documents 1-4.
My wife and I were invited to attend an open house at Direct Buy on 3/25/08 after the presentation, we were told to trust the statements made by the Direct Buy staff. We were told by the representative that if we did not sign up for your services “that day before we left” the opportunity to join would be GONE FOREVER. That we “had to sign up there and then” or the deal was gone and would never be available again. We felt tremendous amount of pressure to move forward that day without any time to investigate the offers you were telling us about. We requested to wait and talk it over, it is a big decision and your representative said “NO”. We were put under pressure to join. A contract may be considered invalid if it was signed under the following conditions: Under Duress, Coercion, Oppression, or Undue Influence by various laws on a nationwide basis, but also state wide.
Now with the downward turn in the economy my wife and I are struggling to pay for a membership that we cannot use, and HAVE NOT USED. It’s just a high-risk debt with no compromises. It has also been brought to my attention the high amounts of lawsuits all over the states involving Direct Buy.
    To sum things up:
    1.    I was put under pressure to join.
    2.    I would like to RESCIND the contract with FULL REFUND.
    3.    I need a statement from Duvera Financial stating that I do not owe any money.
    4.    I will only accept your response by mail & will not accept any phone calls or emails to discuss the matter.
    5.    I will not accept any kind of offer that suggests any kind of meeting with you.
    6.    Please respond within 10 business days of receipt of this registered letter.
    7.    I expect my refund with your response.
Thank you ahead of time for your timely response and cooperation in this matter.

    signed both on contract

    HI Bj in Utah

The main problem is the fact that you have waited over 2 years &
db will ask why you waited so long & a refund is not even reasonable,
Start with "my wife & I..."
Then stress the fact that you have found cheaper prices
& then name the law & explain.....
Then explain "undue pressure" to join,
-part of the undue pressure resulted in a very high risk loan with no compromises...
     Then "request a rescission"...

Good Luck, do not give up!!!!!!!
while you are waiting for a response from db, I suggest contacting any of the lawyers listed on p. 67......

Hi All. This is an update from my post on page 76. I'm sure this has already been answered, but I can't seem to find it.  I have not had any feedback yet from DB. I have sent 3 letters. How many letters do you recommend before sending something to corporate? Should I begin bombarding them with letters? This could become quite expensive...

    Hi Trudy,
FYI- The issue on page 79 is due to someone filling the page with a blank comment hundreds of lines long with only a "." at the beginning and an "!" at the end.  If you scroll to the bottom and then up slightly, you can access the button to have the post removed. I have done so, but I'm not sure how this site works with number of abuse complaints necessary.

Wow.........we did not know how many other individuals out there shared our same experience. We too were in the process of building a new house in ALBUQUERQUE, NM and were given a sales pitch that had us thinking we were going to get a heck of a deal on all building materials.  Come to find out we were able to buy locally and the prices we got were less than Direct Buy.  When we tried to cancel our membership we were told that we had signed a binding contract and could not get out of it, etc.  We were eventually able to save a few dollars on appliances but not nearly enough to cover a fraction of our membership costs.

The danger in Direct Buy membership invitation is that you are told that you have to decide right there and then and paid them a portion of the membership costs and sign a contract.  There was no waiting period to decide, it was immediate and after they get you all pumped up too many of us seem to have done the same thing.  Learned the hard way.

Thank you all for entering your problems with Direct Buy. This helps me decide NOT to visit their show room with their FREE pass. I can't deal with such problems. I try to check out everything before I enter into such a committment. This web site is great.

    HI LAURA
Thanks for the info & it's good to know that you made the complaint
I have made complaints before & a few of the comments have been removed but I had to make a few complaints over a few days before the removal,
I have complained about repulsive language & a few compliants encouraging violence...Good to know that others are keeping track of what is going on here.
