I received a phone call from a women named Anita at my work place. She is telling me that I owe a debt to WaMu. I told her no I don't. She goes on about this account and tells me I'm going to pay these fees. Again I told her that is not my account. She proceeds to start yelling and screaming at me. Tells me that they will take legal action against me. I hang up on her, she calls back. I was trying to get to the bottom of this, and she would listen or answer my concerns or questions.
I'm very upset at this point, I go home and speak to my husband. I decide to call again, Anita starts to scream and yell again. I asked her to please let me ask my questions. She tells me that I need a time out and that she is going to put me on hold. I hung up on her again. My husband tries to speak to her, and she tell him she doesn't want to speak to him to put me back on the phone. He then asked to speak to her supervisor and someone in charge, she said no and she doesn't have too.
One hour later, I tried again. I supposedly got to speak to manger. I explained to him how rude Anita was to me. I told him I was trying to get to the bottom of this because this is not my debt. He gave me the information I needed so that I could proceed to get this fixed. I explained that this is a mistake. He said that he will take care of my complaints about Anita. I just couldn't believe how rude this company was being.

I get some debt collection letter out of the blue, I think its a scam and told them so.
I received a phone call at 6:30 P.M. and when I answered it was a recording telling me that they had important information for a person at this residence. So I inquired.
The woman who answered asked if my name was Mr. *** *****. I told her no and she said, "Well actually I think you are Mr. *** ****'s neighbor. He lives at 1727 **** Ave. Is that address near you?" I told her yes it was the address across the street. She then had me take down her name and phone number and asked me to give MY NEIGHBOR the message. I asked her the name of the company and she said E R Solutions.
This woman found the phone number of the nearest address to Mr. *** **** and called me at home to get ME TO HARASS MY OWN NEIGHBOR!! UNBELIEVABLE!!!
I hope I never owe money to people that use the services of E R Solutions.
Using you to forward a message was NOT done to locate the alleged debtor, it was done as an illegal attempt to embarass the alleged debtor in front of neighbors.
You have no obligation to be a "message service", and your neighbor could sue them for this act.
Indicate that they have been calling you 20 times a day at your phone number <nnn-nnn-nnnn>, asking for <name>, that <name> does not live at your address, and cannot be reached at your phone number, that you have repeatedly asked them to cease calling you. and demand that they cease calling and harassing you.
If they continue calling and harassing you, file a complaint with your state Attorney General. You may be able to find an attorney willing to take such an FDCPA or TCPA case on contingency.
A recent federal court decision found repeated harassing calls to a non-debtor fit within TCPA's provisions. TCPA allows for $500 per call penalties, $1500 per call if "willful", so your attorney should be able to get their attention.
They can search skip-trace databases like Accurint for residents associated with any address, and pull your SSN with your credit report, allowing them to fabricate the appearance of a "debt" you might think you owe. What is missing is knowledge of when you actually lived there.
If you want to find out which it really was, id theft, or fraudulent debt collection, call Sprint's fraud department and see if there is any past account showing under your name at that address, or under your SSN. If not, then this debt collector nearly conned you, wasting your time and that of the police over an "id theft" that never occurred.
They were kicked out of Washington BBB a few years back for failing to clean up their act. Although they responded to BBB forwarded complaints, they never fixed the underlying problem, apparently using BBB just to reduce complaints to other agencies.
To make it easier, have your husband put his cell phone number on the Do Not Call list. Then you can file Do Not Call complaints.
Calling your phone number a dozen times a day is illegal harassment. FDCPA prohibits causing a phone to ring for purposes of harassment.
If their first letter to you was received on 9-17, then you are still within the 30 day FDCPA dispute period during which if you dispute and request proof of the debt, they MUST CEASE ALL COLLECTION ACTIVITY until they obtain and send it. You want to take advantage of that law, so send your dispute letter immediately to make sure you are within that 30 day period.
Send them a letter, mailed certified, notifying them that you dispute the alleged debt, and are requesting that they obtain and send you proof you owe it from the original creditor. Attach a copy of their letter to indicate what alleged debt you are disputing. Also demand that they provide the name and address of the original creditor.
After you verify their receipt of your letter, via the USPS website, if they continue to harass you without sending proof you owe anything, file complaints for their violations of FDCPA with FTC, your state Attorney General, and the Washington Attorney General, and find an attorney to sue them. FDCPA allows courts to award actual and statutory damages, as well as attorney fees if you win.
