I am being sued by Mary Jane Elliott in Novi, MI for a Washington Mutual credit card that I have never had.  I asked for verification of debt at which they laughed and said they would sue me.  Sure enough, I have received the summons and complaint.
I called JP Morgan/Chase who purchased Washington Mutual who said I do not now or have I ever had an account with Washington Mutual.  They also said that since Washington Mutual has very publicly went under, many unscrupulous collection agencies and low-level attorneys are using Washington Mutual's name and harassing people.  
If you search Mary Jane Elliott on the internet you will see that this pathetic agency is fraudulently suing many people!

    I missed one payment and she garnished my husband pay.  As of today they have $100 more than what we owed.  According to the rude woman I spoke to (who actually hung up on me), they will continue to garnish 25% of my husband's pay through April, then the refund will take 30 more days!!!  How can I get them to stop the garnishment, we are paid in full?

    what do i do here. i have a motion for alternate service denied ..plaintfit failed to comply... wtf is that?? i have no idea who or what this person is about.. and then i get another notice from who ever saying that this person is trying to sue everybody and there mother and i should fill out thois form and send it it cause i may be entilted to cash for a class action law suite.. what to do??

    This woman's company has called my home 4 times in the last week and they HANG UP every time. I have no debt to anyone. I have no idea why she's calling--how could I know, when they hang up?!! For what purpose would a company do such a stupid thing?

      She/ Her office has done the same thing to me, I do have a debt, NOT with her With a credit card company, she must have bought it, anyway, long story short, she has summons me & without receipt, she would not settle with me when I did talk to someone in her office, then after that, she would call all hours of the day, then hang up on me!!! She Needs to be stopped!!!!!!!!!!!!!!!!!!!!!!!!!

    I dont believe whats going on in the world. Things are bad, people lose there jobs, there house,and have no control over it. Then you got a greasy freaken lawyer trying to make money on peoples dispair there is something very wrong here, do you want people putting a 38 cal. in there head, do you lawyers care at all I really dont think you do.

    It is a violation of FDCPA for a debt collector to repeatedly cause a phone to ring for purposes of harassment.

    Contact your state Attorney General fo assistance.

    Mary Jane Elliott has been deemed a bottom feeder.  That would be incorrect because bottom feeders have more going for them than Mary Jane.  There are no words to describe how low she really is.  I know she picks on the elderly and the people that are barely making it in this tough economic time.  I have witnessed her and her cronies in court and I am amazed at the lack of respect they have for people in trouble.  Unfortunately while in the Brighton court I noticed that the judge (Brennen) was just as unrespectful and could care less that there are people struggling to exist.  She isn't so who cares?  She could care less if they are losing everything as long as they pay this crooked attorney her blood money.  I have no respect for either person but then again what is a judge but an old washed up attorney.  Bottom feeder is too good for the both of them!

    She is just a lawyer for the JDBs (junk debt buyers). She apparently has a reputation for this sort of work because of the amount of referrals. You would say this is her 'specialty' which is fine but she also must be overextending her office cuz they take on so many cases. Bottom line is to ALWAYS answer any legal requests (from the court). If you don't, they automatically win a default judgement. The case against you is only as good as the JDB's documents which are usually non-existent. LEARN court procedure and fight back by demanding these documents. You dont need a lawyer, you can be your own 'pro se'. You wont find a free lawyer for this sort of case but you can get free legal advice for answering the sumnmons, etc. yourself from them. They just wont go to court for you no matter how poor you are. Most judges don't like the JDBs cases clogging up their courts so you have them on your side if you show respect and prepare your documents properly. It's been done successfully. You just can't ignore.

    My husband just revieved a summons from Mary Jane Elliott too saying we defaulted Midland Funding LLC-Citibank. My husband had a credit card from Sears back in 2005 We missed a payment and they cancelled us. Next thing I know I thought we paid off the dept but they claimed we occured 36 percent intrest rate for each month we were paying so a 500 dept became a 2500 dept. Told them to sue us which never happened untill now I see. My husband is retired medically because of seizures I am not going to be dragging him all over town for court dates but I believe I need to fight this because his debt was not with Midland or her. I am not even sure this is the Sears debt. Shame on Mary Jane Elliot you are suppose to be a good catholic woman. You have sold your soul to the devil and you will have to answer to our maker one day over your over zelous need to make more and more money off the poor just so you can live the high life. What does your son Tommy think? Does he know you are living off of other families who cant even feed there own???? Again SHAME ON YOU!!!! God see's the good in people as well as the evil.........

    I've been summoned on a couple of cases.  I can't afford to pay right now.  Mary Jane send me an "Income and Expense Questionnaire", I filled that out and sent it to them.  I failed to make a copy for myself (stupid)! Is it too late to ask them to validate the debt at this time? I made a payment to them for $50 so far on one debt and $150 on the other debt.  One of the summons was for garnishment of wages.  They failed to garnish because the account they tried to take it from was closed.  They they continue to try to garnish from other areas?

    My elderly parents were just contacted this evening with threats of a law suit due to them "owing" money to a long-overdue credit card at Target. The person on the phone gave her name as 'Tony' and said she was calling regarding this $500 debt that needed to be paid "immediately or it will be going to a judgment in court". Thank goodness my mom had the smarts to question about the account number and make further inquiries about why they had never received any statements from Target, (she thought perhaps my father had filled out a credit card request without her remembering). She told the person that she would check with her husband and call them tomorrow, but then she called me right away and as I checked it out, no surprise, it was totally fraudulent. I am just now filing a complaint with the Attorney General of Michigan and will follow up with this. Thanks to all who have posted as it was a quick red flag for me!!

    Report this immediately the the Attorney General's office in your state. It is a scam and will cause you a lot of headaches and more importantly, financial issues. Do not hesitate to contact a lawyer either.

    This business is a major scam. They overload fees, create fictitious other fees and have a business practice of not telling you everything and then hang up on you. I had my bank, Wells Fargo, call them and the bank associate was hung up on 5 times in a row! They are not a debt collector as much as they are scammers. I Look forward to driving to Novi to have a face to face. I am contacting my attorney and then, my local affiliation near Novi. But that affiliation is not legal in any way. [***] these people

    Even though you have determined that the alleged account is either fraudulent or not their account, be careful to respond to any lawsuit.  

    Many complaints are indicating they may attempt to obtain defaults judgements, through what appears to be a pattern of "sewer service" to other addresses.  It appears that they are cutting corners on correctly identifying alleged debtors, and taking advantage of this to obtain default judgements they can apply to misidentified consumers.

    Seek representation by an attorney, as they may be violating state and federal (FDCPA) collection laws.

    Mary Jane Elliott wants to keep her deceptive practices a secret.  After settling our suit against her this week in federal court, we were asked to adhere to a "silence" agreement.  We did NOT agree, and we WILL make sure to inform all those we encounter of her deceptive practices.  Please don't let friends or relatives become a victim of this lawfirm.  The financial penalties against her are nothing compared to the annual income of 10-20 million as reported by Manta.com.  That is why they will sue anyone for anything! View cases at Justia.com.  I have found the following people who have sued her in Michigan, (McKeown, Glover, Charbonneau, Openshaw, Anderson, Liang, Haynes, Donahue) Judge Scoville warned Elliot in the case brought by Glover, "If the answer in the present case represents defense counsel's usual approach to civil litigation, he should reform his practices immediately."  It is evident in federal court that Mary Jane Elliot is grasping at straws to defend her deceptive practices. Fight back against Mary Jane Elliott!!!!

    You can fight this.  Go to the court where the complaint is filed and file a motion for a hearing.  Present your case to the judge and you should get some satisfaction.  They did the same thing to me and the judge in my court ordered them to release the funds.  They did it a second time and this time instead of just placing a hold on the account, they actually took the money.  I went back to the same judge and the issued an order that they return the money to me.  Most people do not fight.  You have to work the legal system with them to get results.

    I just had the same thing happen to me and I have on unemployment for almost a year.  I have asked for documentation as to the amount of money that supposedly owe and I have not received anything.  I just happened to check my bank account and all my money is on hold as well.  I have been in contact with an attorney and I plan on suing this debt collector because I have not received any information such as the notice to garnish my bank accounts.  It is illegal to take my money because it is unemployment.
