I caution any one that has a mortgage with Bank of America to be VERY CAREFUL! My dad and I share a mortgage with Bank of America, and Bank of America changes their billing address from time to time and if you do not receive an address change from them or you miss it in the mail Bank of America does receive your payments but now it is at what they consider to be the wrong location and this department holds your payment and will not forward your payment to the new billing address.

Then when you fall behind on your mortgage they foreclose on you! This is what happened to my dad and I had to file chapter 13 for him to keep his property! I make payments for my dad via online banking with my bank and my bank actually sent BOA a letter asking them to withdraw their foreclosure proceedings, cancel any late charges applied to his account and restore his good credit because my bank had proof copies of all the checks that went un-cashed.

They were sent on time but to the now wrong location because Bank of America had changed their billing address and unfortunately for us we did not receive a change of billing address notification this time, yes they have changed it before but we caught it that time. The request from my bank was refused! Why? My bank told me straight up that this is how Bank of America got to be so big! They deliberately change billing address from time to time and if you miss it for what ever reason Bank of America then forecloses because they don't receive your payments!

They receive the payments, but it's the wrong department and they just don't forward them! Proof? After chapter 13 was filed we received back one of the first checks that BOA claimed that they didn't receive, it was dated pre-foreclosure! They just flat held it until the chapter 13 was filed then sent it back. Had I not filed the chapter.13

BOA would have legally defrauded my 82 year old dad out the land he worked so hard for most of his life. If you have a mortgage with Bank of America "BE CAREFUL, BE VERY CAREFUL"! Check up on your billing address at least every six months. Thanks.

    i made a payment july 15th,2009 at a bofa branch.late penalties imposed if paid after the 16th of each month.i was within the time frame.they posted my check on the 21st and imposed an irrevocable late fee.be carefull.i think this is their m.o to make extra income.i have no control of what they do after i made my payment

    I have been experiencing the same problems with BofA. I mailed my payment on the 30th of July and as of August 17th it still had not posted. When I called, the customer service rep said it was MY fault for mailing the payment. She said I could pay over the phone, but that there was a fee of $19.99 to to that. If I paid online, there was also a late fee.

    I think they do this on purpose to incur late fees. I bet my check shows up before the end of August

    COMPLAINTS ABOUT BANKS SHOULD BE SENT TO THE OFFICE OF THE CONTROLLER OF THE CURRENCY, A FEDERAL AGENCY.

      They don't help either. OCC did not help me when I complained about BOA Mortgage.

    BOA allowed my name to be removed from a home that I owned jointly with my partner after a "messy" separation of 14 yrs. I never signed off on ANY transfer of this mortgage, yet all of a sudden, I am NO longer on the mortgage. BOA is shadey and greedy and part of the problem of our declining economy!!

      If you think having your name removed is bad, I went through a divorce in 2009. Prior to the divorce my spouse and I filed bankruptcy. I had to use the local hud agency to help save the home I've lived in and paid on for 23 years. No one made my house payments for me I have paid my own mortgage. I could no longer afford to make payments on the home after the ex moved out.  I could not move out I had not credit or money or transportation to move into a hud apartment. Hud helped me get the payments lowered. It took a good three years to get it done. There is two times in my life I almost lost the house once when my first husband died I did not have to work and when he died I had not way to pay the mortgage so my mother made a payment back 23 years or so ago and I rented the home out for a year. The other time is now after the divorce in 2009 which I managed to keep under control with hud help.  At this current  time 25 payments have been made and the rule is 24 payments have to be made before a refinance or anything such as a sale can be done. Since the payments have been made the bank has come back deleted the mortgage off my credit report. Bank of America never went back and updated the credit report they are showing me over $??? past due. Now that being said, what the bank is telling me, after they modified the house they need me to send them bankruptcy papers for the chapter 13 I filed. Well "hello" Bank of America I never filed chapter 13. So basically what the bank is telling me is even though I modified the house because I went through a divorce, the want copies of the bankruptcy papers.  What they are failing to do is take correct notes. It was chapter 7. Than,  I went through a divorce, that's why the house got modified. The bankruptcy was expired by the time the modification was completed. And the bank had this information provided to them when the modification packet was being completed.  I just don't understand how it is they can continue to keep the mortgage in collection and lie to my face tell me its been modified and continue to get a promised monthly mortgage payment. Oh, and to top that off they even have the wrong address on file.  "wow" This is a very corrupt company. If I had the money to hire a private attorney as I would have done in the past. I would jump on the first plan and do it.

    My father passed away a few years ago. I have faxed,called and carried in all the required documents to BOA mtg at least 7 times. Just called again to get the year end info,needed to file the tax return, and was told they didnt have the court documents needed to release the info to me. I am the executor of the estate. The mortgage payment changed last year and they didnt notify me and never bothered to tell me it was behind (since they still claimed they hadnt been notified of his death) They refused to change the address so I would receive the notification. It was close to foeclosure by the time I got them to give me the info, even though the payments had been made every month. There is only a small balance left on the mortgage and I beleive they are trying to foreclose on purpose for their own gain. I fax the executor document again this week and got back a letter requesting all the court documents I have alredy sent several times since his death. SO FRUSTRATED! I'm now trying to figure out what Federal agency to file a complaint with. NEVER USE BANK OF AMERICA MORTGAGE!

      I hear you loud and clear and I second the motion. DO NOT EVER get a mortgage through BofA. I am dealing with the same frustrations. I have been at this for over 10 months. I finally got approved for the Making Homes Affordable program. The problem is that BofA "is showing" my income as over $500.00 more than it actually is. I've asked them where they got that number from and they said they got them from me however, when I asked them what my bank statement showed they read me the correct amount. they also have a copy of my SS 'new Benefit Amount' which shows the same thing. When I call to straighten this out they tell me "there is nothing they can do". I can resubmit my application and start all over again. My question is, who do I have to contact to get BofA to correct their error? Contacting them has done no good.

        If you are reporting social security income, it is normal for a lender to "gross up" your SSI income by 1.25.  This is normal and legal underwriting procedure. But I am not excusing B of A for being the worst place on the planet to get a mortgage. One trick they pulled to disqualify hundreds of thousands of borrowers was to take out mortgage insurance policies on loans without the customers knowledge. So when these people try to get relief via the HARP program, guess what? The are deemed ineligible due to the type of mortgage insurance carried on the loan!  I've had to turn down hundreds of hard working Americans who otherwise would have qualified. This is just one of many stories I could tell you as a B of A insider.

        Bank of America did the same thing. My house is almost paid off and has a automatic biweekly payment by a third party company. Then all of a sudden,I got a letter from BOA stating that my mortgage is in default and that it will be foreclose.They never credit to my account my payment I made every two weeks. I settled my account and is current now and have to stop my biweekly payment. This is a warning to everybody to check your account in BOA and make sure your payment is actually credited to your account! I make my payment now thru their bank teller so now I have proof of payment in my account.Next year I can say goodbye to this people cuz my mortgage will be paid off..

          Manny, I went to make a payment on my HELOC at the branch, on a Saturday where I opened the HELOC years ago and needed it done ASAP. Like that day not to be late. AS you know they close by 12.  I was told that they could not make the payment. I had my new bank acct. number and routing number and they said that they could not do it. If you can make a payment over the phone (where the automated system cannot understand you so it takes 45 minutes to make a lousy payment. It thinks that you want to pay the full loan amount off, when you really want to pay the amount due that month).. Then why can't the bank do it? I find this very strange and think that this is another way for BOA to charge late fees, ruin your credit so you can't go to another lender and eventually steal your house. Tell me I'm wrong !  I will be looking forward to an answer, thanks...

      You can contact the Office of Comptroller of National Banks, otherwise known as the OCC. This is the agency that governs all banks and believe me, if you file a complaint with the OCC, Bank of America will take notice and take all measures necessary to correct the situation.  I filed a complaint online with the OCC and I received a phone call from someone working in the office of the CEO and President of Bank of America. Since then I have ONLY dealt with their office and after almost 2 years now and no foreclosure, there are finally fixing things like they should have 4 years ago!
