I caution any one that has a mortgage with Bank of America to be VERY CAREFUL! My dad and I share a mortgage with Bank of America, and Bank of America changes their billing address from time to time and if you do not receive an address change from them or you miss it in the mail Bank of America does receive your payments but now it is at what they consider to be the wrong location and this department holds your payment and will not forward your payment to the new billing address.
Then when you fall behind on your mortgage they foreclose on you! This is what happened to my dad and I had to file chapter 13 for him to keep his property! I make payments for my dad via online banking with my bank and my bank actually sent BOA a letter asking them to withdraw their foreclosure proceedings, cancel any late charges applied to his account and restore his good credit because my bank had proof copies of all the checks that went un-cashed.
They were sent on time but to the now wrong location because Bank of America had changed their billing address and unfortunately for us we did not receive a change of billing address notification this time, yes they have changed it before but we caught it that time. The request from my bank was refused! Why? My bank told me straight up that this is how Bank of America got to be so big! They deliberately change billing address from time to time and if you miss it for what ever reason Bank of America then forecloses because they don't receive your payments!
They receive the payments, but it's the wrong department and they just don't forward them! Proof? After chapter 13 was filed we received back one of the first checks that BOA claimed that they didn't receive, it was dated pre-foreclosure! They just flat held it until the chapter 13 was filed then sent it back. Had I not filed the chapter.13
BOA would have legally defrauded my 82 year old dad out the land he worked so hard for most of his life. If you have a mortgage with Bank of America "BE CAREFUL, BE VERY CAREFUL"! Check up on your billing address at least every six months. Thanks.

I don’t know where to start other than we have been trying to get a loan modification on our primary mortgage but no one can help us because we are not in foreclosure and we are not more than 2 months behind but now I just found out we are just over $9000.00 behind on the mortgage. We have an 80/20 mortgage which in the beginning was adjustable rate with the 80 primary and I was able to get Countrywide Mortgage to put it into a fixed rate for the remaining life of the loan but just found out they also put another 15yrs onto the loan now its in a 45 yr mortgage.
The only thing Bank of America has been able to do for us is:
a) Leave the interest rate at 7.2%
b) Add the escrow on to the loan (we paid our own property taxes and homeowners ins)
c) Add the so called $9000.00 to the back of the mortgage (which I don’t believe is correct )
I was told by BOA that we don’t qualify for the HAMP program since our mortgage payments are not 31% of our income and at one point I was given a call saying they can drop the interest from 7.2% to 5% which was great but the next week I received a phone call saying the investor (Wells Fargo) did not approve it.
I am so frustrated with all the time and effort I am putting into this as far as trying to get some help and feel like if we don’t go into foreclosure we will not get any help at all. I have even contacted
America, we need help!
Now their system say I am 4 months in the rear plus in the rear for April payment but April is not here yet. In reality, I am only 1month in the rear because BOA is still holding a cashier check in the amount of $655.00. This all appears to be a scam to me. Now BOA has added thousands of dollars of legal fees and they wouldn't accept a payment without the thousands of dollars of legal fees although this was an error made by BOA.
Until the NACA convention in Jan 2012 in Ontario - leaving in tears after being there close to 8 hours n "NO HELP"!!! Right before it was my turn to proceed to the final desk to speak to BofA rep - they sent me away. They told me to come back in Feb to the LA Convention. I did try again n no help again! The gentleman stated I should go back to my branch n talk to the mortgage officer.
I walked in n found out I was reported 3 late payments therefore no one could help with FHA nor conventional loan till 1 year later from the last late payment!
By this time October 2011 till the present I get notices in the mail stating "foreclosure proceedings" - I have ignored all correspondence - I thank GOD we r current in our payments n although I'm not happy with the 5.5% interests rate - I have 6 more payments more - than I will seek refinancing through another lender! No more business with BofA - I stopped my payroll direct deposit n switched banks!
I WOULD SUGGEST WE BOYCOTT BofA !!! LET'S STOP BEING ROBBED!
