I caution any one that has a mortgage with Bank of America to be VERY CAREFUL! My dad and I share a mortgage with Bank of America, and Bank of America changes their billing address from time to time and if you do not receive an address change from them or you miss it in the mail Bank of America does receive your payments but now it is at what they consider to be the wrong location and this department holds your payment and will not forward your payment to the new billing address.

Then when you fall behind on your mortgage they foreclose on you! This is what happened to my dad and I had to file chapter 13 for him to keep his property! I make payments for my dad via online banking with my bank and my bank actually sent BOA a letter asking them to withdraw their foreclosure proceedings, cancel any late charges applied to his account and restore his good credit because my bank had proof copies of all the checks that went un-cashed.

They were sent on time but to the now wrong location because Bank of America had changed their billing address and unfortunately for us we did not receive a change of billing address notification this time, yes they have changed it before but we caught it that time. The request from my bank was refused! Why? My bank told me straight up that this is how Bank of America got to be so big! They deliberately change billing address from time to time and if you miss it for what ever reason Bank of America then forecloses because they don't receive your payments!

They receive the payments, but it's the wrong department and they just don't forward them! Proof? After chapter 13 was filed we received back one of the first checks that BOA claimed that they didn't receive, it was dated pre-foreclosure! They just flat held it until the chapter 13 was filed then sent it back. Had I not filed the chapter.13

BOA would have legally defrauded my 82 year old dad out the land he worked so hard for most of his life. If you have a mortgage with Bank of America "BE CAREFUL, BE VERY CAREFUL"! Check up on your billing address at least every six months. Thanks.

    I have been working with BOA since March of 2010 regarding a modification. They have told me they are working on this and I never speak to the same person two times.. Its always someone who knows nothing about my account. I had to file a complaint with FHA and The office of the Comptroller of Currency.. I am starting to get some calls from them now, they are the worst!

      I am experiencing the exact Same problem!! They actually lost my Loan Modification paperwork that was sent to them in March 2012 and for a Year, No one could find anything!! I got case manager after case manager! They have the WORST service I have ever received.  I filed a complaint with the Better Business Bureau and other agencies.  I live in CA and sent a lette to Barbara Boxer who is in the senate.  I REFUSE to give UP!!!         Husband and I going through divorce, wanted to short sale the home because it is worth less than what we owe B of A said we had to go through a modification. They keep on losing the paperwork, 5 different managers on case. One told us if one of us moved out we can stop the modification process and go directly into short sale. Two weeks after I moved out she called and said she was wrong. She is no longer there. We have been lied to so many times I cannot even keep count.
        We actually had a buyer for the home if they would of approved the short sale. I cannot believe the government lets this bank do this to people.  What good are  our leaders when they let this happen to hard working tax paying people.   I complained to the FTC on there practices and got no where, even wrote a letter to the governor of California and of course no response.
        Why should any other country follow our example of government when ours does not work. POTUS does not give a dam of the people.
        I am 58 years old and having perfect credit all my life B of A has ruined it. The citizens who had dealings with them should start protesting outside of the banks. The people need to stand up and get this bank closed.

    We have to send our mortgage payment monthly over night delivery with express return.  Because they say they never get it in time and charge us a late fee of 71.44.  Last Oct 2010 they did that and it was on our credit report, we just got that off.  It is a darn shame that you have to mail your mortgage like this.

    I do not use on line banking because again it takes up to 15 days to get into the Bank of America processing center.

    I have called spoken to a advocate person of which is no longer there.  The only way to send it is to over night it with guar. signture return.

    To bad life has to be so complex and wrong.

      I agree I had direct withdrawl and getting late payments on that, or how about your payments being unposted, if anyone has to deal with this get in writing, trusted Leslie that these would be posted even sent thank you for helping me and then tell me you don't know who I am. I hope they can sleep at night knowing that their lies someday will come back to haunt them

    I have always had my mortgage payment automatically drafted out of my account and have never had a problem with it not being credited right away. That is odd that it takes 15 days for it to be credited when you pay it online.

    Has anyone received a letter about new fees charged to an existing fixed rate mortgage? Such as: verification of mortgage $15.00, payoff statement $5.00, payoff demand fee $30.00, and the best one, if you pay off or refinance your loan a fee up to $100 for the preparation of the documents to release your lien will be charged. What, the $150,000 in interest isn't enough to cover that?

    First of all this is an already existing mortgage. There is no prepayment penalty. This is not a checking account, where they can change or add on new fees, and I can just close my account if I don't like it. Where in my 6" pile of closing papers does it say you can add on as many fees as you want 10 years later?

    I am sick of this bank working so hard to think up new ways to rip off the customer. Maybe they should charge anyone who speaks their name.

      Sounds like you went through a refinance. This are normal fees with any refinance. A release deed needs to be filed with you county, an accurate payoff statement has to be generated, and services need to be performed to ensure clear title moving forward. I hate this bank for many reasons, but what you described is pretty normal anywhere.

    BEEN TRYING TO DO A SHORT SALE FOR THE PAST 3 YEARS, 02-08 TO 04-11. JUST RECENTLY I TRY TO DO A DEED N LIEU AND STILL CANNOT GET A FINAL OR DEFINITIVE  ANSWER FROM  *BANK OF AMERICA* , MONTH TO MONTH IS A DIFFERENT STORY AND ONE DEPARTMENT DOES NOT KNOW WHAT THE OTHER DEPARTMENT IS DOING.
    IT LOOKS LIKE THEY CHANGE THE RULES AS THE GO.
    FAXED THOUSANDS OF PAGES NO ANSWER, BUT I DO GET CHARGE FOR THE ONCE THEY FAXED FORM DIFFERENT DEPARTMENTS.

      We are in the process of completing a short sale now, they have the final paperwork but keep saying that they need time to review, they have already approved it once.  I have been dealing with them for over a year and a half on the sale of my house, we have had several contracts, some have walked away because we could get no answer from them.  Anybody know who we can contact about this, its BS...

        If you are working with a realtor, your short sale request has to go through B of A's EQUATOR system. B of A will give your realtor a log-in and password. It is an electronic portal where all steps of your short sale are logged and tracked, and all documents related to your sale are uploaded. This way, there is one common paperless file and one assigned short sale negotiator from the bank. I did my own short sale this way and it went through in less than 60 days. My realtor was assigned log in credentials and I took over the controls from there and basically did my own. So I know it can be done. Hope this helps. By the way, I hate Bank of Embarrassment and hope they have legal headaches for the rest of time.

      I feel for you, just wondering have you been able to get anywhere, I am in somewhat same situation as you, my problem is that I closed on a short sale last june, when I went to do my taxes I realized they had not send me a 1099C, I had to ask for an extention IRS gave me till August I cannot get anywhere with BKOA they say that I'm now in foreclosure? I don't understand I closed back in June and now I'm in foreclosure, I contacted the IRS to let them know what's going on they said they are now in violation that I must get a 1099C form in order for me to get my taxes done, I call leave messages noone calls me back, can you please suggest alternatives since you've dealt with your share, I would appreciate your guidance. Thank you.

        Are you expecting tax consequences for amount you short paid? My understanding is the IRS is not imposing a tax on short sales if it was your primary residence. As a backup, there is an insolvency rule too. If you were insolvent at the time of sale (meaning your debt exceeded your assets), your tax obligation is basically offset by the amount of your insolvency. The IRS supplies an Insolvency Worksheet in their forms section. You should really check with an accountant familiar with this. By the way, NEVER do business with these scoundrals again. Do you hear me?

      I started out with the Make our Homes Affordable application and kept getting passed from one representative to another, each having the excuse that they never received the information that you faxed and telling me my application had been sent to the underwriting department and it would be 4 to 6 weeks to process. Found out it never went to the underwriting department and that my home had been put into foreclosure three months prior. If my application had been put through I would have had a new lower mortgage payment. Then tried to do a Deed-N-Lieu and had to refax all documents again, was told that a BOA representative would be assigned to me in 7 business days and that I would be contacted.  I called on the 7th business day and was told my request was not in the system and had to start over, this happened three times before I decided BOA was purposely stalling so they could take my home.  My advice is to get an attorney immediately.  If you can not afford an attorney, there are non profit agencies that work with assigning attorneys that will help you with your case ProBono.  For example, The Florida Bar website lists the agencies by county.  Good Luck.

        Thanks for your help, I am in the same situation, BOA stalls so they can steal your house. I am calling every god damn person in Amerika to put these monsters out of business..
