I caution any one that has a mortgage with Bank of America to be VERY CAREFUL! My dad and I share a mortgage with Bank of America, and Bank of America changes their billing address from time to time and if you do not receive an address change from them or you miss it in the mail Bank of America does receive your payments but now it is at what they consider to be the wrong location and this department holds your payment and will not forward your payment to the new billing address.

Then when you fall behind on your mortgage they foreclose on you! This is what happened to my dad and I had to file chapter 13 for him to keep his property! I make payments for my dad via online banking with my bank and my bank actually sent BOA a letter asking them to withdraw their foreclosure proceedings, cancel any late charges applied to his account and restore his good credit because my bank had proof copies of all the checks that went un-cashed.

They were sent on time but to the now wrong location because Bank of America had changed their billing address and unfortunately for us we did not receive a change of billing address notification this time, yes they have changed it before but we caught it that time. The request from my bank was refused! Why? My bank told me straight up that this is how Bank of America got to be so big! They deliberately change billing address from time to time and if you miss it for what ever reason Bank of America then forecloses because they don't receive your payments!

They receive the payments, but it's the wrong department and they just don't forward them! Proof? After chapter 13 was filed we received back one of the first checks that BOA claimed that they didn't receive, it was dated pre-foreclosure! They just flat held it until the chapter 13 was filed then sent it back. Had I not filed the chapter.13

BOA would have legally defrauded my 82 year old dad out the land he worked so hard for most of his life. If you have a mortgage with Bank of America "BE CAREFUL, BE VERY CAREFUL"! Check up on your billing address at least every six months. Thanks.

    How did you get it removed from your credit report? My husband and I are selling our home and when we went to get pre-approved for our new home, we found that BOA had reported last payments on our credit report. We made all of our payments and were told that from March 2009 - August 2009, they placed our payments into a "reserve" account. No one at BOA will tell us why that was done. Instead they reported that it against our credit. We are going round and round trying to have this corrected and removed from our credit report, but so far no luck! Please help if you can!!

      Did you ever make partial payments on your account? Like sending half every 2 weeks? Some people think they can do this, but in reality the bank doesn't know how to apply these partial payments. Also, if you pay too early in the payment cycle it will be posted as a principal reduction. Then, when the 1st of the month comes around, you think you paid, but the bank still reports you as late. Just some things to think about as to why this happened to you. As a side note, NEVER trust this bank. EVER.

    I have been with Bank of America since July of 2009....Just since October November time frame, they have been sending me letters saying I owe them more and more money.  I pay my mortgage bi-weekly to equal my monthly payment.  When I called the first time I was told that my mortgage wasn't 2 months behind but just 1 month.  I received another letter in the same week and they continued to tell me I was behind, but now more money.  I called again, spoke to a totally different person, and she proceeded to tell me I was behind because of late fees.  She said the money goes into a reserve until the amount "they" are looking for and then applied for the month.  No one at Bank of America can give me a straight answer.  I do not understand what they are doing and continue not to understand.

      I've seen this a million times. In order to properly make bi-weekly paymens, you have to enroll in a bi-saver program. This is a third party administerer of payments who hold your money until the full payment is due, then the bank gets paid. There is a per-payment fee attached to this which partially defeats the purpose. Customers think they can send half at a time, but in reality the servicing systems are not set up to assume it is a half payment. Most of the time if you send half in too early, they will credit your principal balance. Then when the 1st of the month hits it looks like you only paid half a payment. There go the late fees, negative reporting and countless calls to Mumbai. The bank makes it a point not to cover this when you sign your loan documents, because they know it means more fees and penalties later at your expense. And I should add, this bank preaches a World Class Customer Experience but in reality only has their shareholders' bottom line in mind. Take your money and your home out their grips FOREVER.

    I HAVE THE SAME PROBLEM WENDI HAS .THEY BOUGHT MY LOAN FROM ANOTHER BANK AND ALL OF THE SUDDEN I OWE THOUSANDS OF DOLLARS TO THEM I HAVE FAX ALL MY DOCUMENTS TO LET THEM KNOW THEY ARE CRAZY AND GOT NO ANSWER FROM THEM .AMD WORST OF ALL THEY CHANGE MY LOANS STATUS TO INTEREST ONLY HAVE BEEN TRYING TO FIX THE PROBLEM AND ALL I GET IS TRASFERING OF LINES AND NO ONE CAN DO ANTHING ABOUT IT . I THING ALL OF US SHOULD GET TOGHETER AND SUE THEM FOR RIPOFS

    I got that letter too, about the fees. My husband and I have been trying to get a loan modification for more than a year, and every time they ask again for the same documents the we already submitted. And on top of that, now we are having problems with late fees when we have never been late to pay the mortgage. I called today and the person who answered said that they are going to investigate. Investigate what? The last time I paid the mortage was on April 11, in one of the Bank of America Branches and on top of that the payment was made in cash. Now I see that they posted the payment on the April 21st and they are charging me $90.22 for late fee. And I also noticed that they did the same thing last month, So 180.44 in late fees when we have never paid late.

      My husband have bank of America I can truly believe every word of what you all is saying is true but we finna pull his account. The staff are very difficult un honestly...........i truly understand.....sorry your dad had to go through that.

    I am going throught the same thing with BOA they say I am one month late and when I call and talk to someone thats knows what they are doing they say that I am not one month behind and that it will take 60 days to fixed this and for me to call back, about a month later I get these letter saying that I am again one month behind, I feel for you because I am having the same problems..

      I always take my mortgage payment directly  BOA bank and pay cash I dont send anything in the mail

    WE HAVE FILED FOR BANKRUPTCY , WE KEPT OUR CARS AND THE HOUSE. NOW SINCE BANK OF AMERICA CAN NO LONGER LEGALLY CONTACT ME, I HAVE TO CALL IN OUR HOUSE PAYMENT OF $900.00. APRIL'S TRANSACTION WAS CORRECT. MAY'S IS A DIFFERENT STORY. WE ARE ONE MONTH BEHIND ON THE MORTGAGE. SO THIS MONTH I CALLED IN THE PAYMENT FOR $900.00 AND THE TOOK OUT $1,979.02 OUT OF MY SAVINGS ACCOUNT AND THEY HAVE WIPED ME OUT !!! I NOW AM BROKE AND CAN NOT PAY MY OTHER BILLS BECAUSE I AM ON A MEDICAL LEAVE OF ABSENCE BUT HAVE NOT STARTED GETTING MY SHORT TERM DISABILITY CHECKS YET. MY HUSBAND IS DISABLED SO WE , LIKE SO MANY OTHERS ARE LIVING DAY BY DAY NOW !!! I HAVE HAD THE SAME PROBLEM WHEN CALLING BAC , I NEVER SPEAK TO THE SAME PERSON TWICE AND HAVE TO RE EXPLAIN THE WHOLE PROCESS TO THEM EVERY TIME !!!! SO, I FINALLY WENT STRAIGHT TO THE MANAGER AFTER ABOUT 30 MINUTES ON HOLD,,BECAUSE THEY DON'T WANT US TALKING TO ANYONE BUT THERE PEOPLE AT THEIR CALL CENTERS. THEY HAVE THOUSANDS OF CALL CENTERS IN THE U.S.A , SO THAT WAS THE REASONING BEHIND NOT TALKING TO THE SAME PERSON EACH TIME ! SO WE WERE ASKED TO FAX A ROLLING BANK STATEMENT TO THEM FROM OUR BANK WITH ALL THE INFORMATION THEY NEEDED ON IT..GUESS WHAT THEY COULD NOT LOCATE THE FAX WE SENT !!!!! SO I WENT BACK TO MY BANK, GOT ANOTHER BANK STATEMENT AND FAXED IT DIRECTLY TO THE SENIOR MANAGER. I CALLED LATER THAT DAY TO VERIFY THAT KEVIN HAD GOTTEN IT BECAUSE HE PROMISED ME HE WOULD PERSONALLY WALK IT TO THE BANKRUPTCY DEPT. WELL WHEN I CALLED BACK, HE HAD ALREADY LEFT FOR THE DAY !!!!! SO THE "COMMUNICATION SPECIALIST" TALKED WITH ANOTHER MANAGER THAT WORKS WITH HIM AND SHE SAID THAT I DID NOT FAX ENOUGH INFORMATION TO PROVE TO THEM THAT THEY HAD NOT ALREADY RE FUNDED MY MONEY !!!!! I SENT THEM THE BANK STATEMENT SHOWING THAT THEY HAD TAKEN OUT THE MONEY ON MAY 6th, AND MY BANK STATEMENT WAS FROM MAY6-10th, THIS HAPPENED ON MAY 12th AND SHE SAID THAT IT WAS NOT
    ENOUGH PROOF THAT THEY HAD NOT ALREADY DEPOSITED THE MONEY BACK INTO MY ACCOUNT !!!! SO ONCE AGAIN I AM GOING TO HAVE TO GO TO THE BANK AND HAVE THEM REFAX THE IDIOTS !!!!!

    WHEN I DID ASK TO SPEAK WITH A SENIOR MANAGER IT WAS LIKE THEY DID NOT WANT ME TO BUT I INSISTED AND THE LADY FINALLY CONNECTED ME TO KEVIN. SO I SPOKE WITH KEVIN, ASKED FOR HIS LAST NAME AND HE WOULD NOT GIVE IT TO ME,,,,ONLY HIS EXT #.....WHAT IS HE SO AFRAID OF ABOUT GIVING ME HIS LAST NAME?? HE'S AFRAID OF BEING SUED I GUESS,,,IDK !!!!   SO IF YOU NEED TO TALK TO A SENIOR MANAGER AT BAC BANKRUPTCY MANAGER HIS NAME IS KEVIN AT EXT 3567...CALL 1-800-669-6607. I HOPE THIS CAN HELP SOMEONE OUT THERE GOING THROUGH THIS BS!!!!!

    I TOTALLY AGREE,,,,I WAS TOLD YOU WILL NEVER GET THE SAME PERSON BECAUSE THEY HAVE HUNDREDS OF CALL CENTERS LOCATED IN THE U.S.A  SO I WENT TO THE SENIOR MANAGER OF THE BANKRUPTCY DEPT, THEY WERE EVEN HESITANT TO DO THIS FOR ME,,THEY KEPT ASKING IF THERE WAS ANYTHING THEY COULD HELP ME WITH,,,I SAID NO I WANT A SENIOR MANAGER. WELL ABOUT 30 MIN LATER SHE CONNECTED ME WITH KEVIN AND WHEN I ASKED FOR HIS LAST NAME HE WOULD NOT GIVE IT OUT TO ME,,,ALL HE SAID IS THAT "I CAN GIVE YOU MY EXTENSION #" MAKES ME WONDER WHY HE IS HIDING HIS LAST NAME FROM ME ???????   BUT IF YOU NEED HELP IN THE BANKRUPTCY DEPARTMENT CALL 1-800-669-6607  EXT  3567 AND YOU WILL SPEAK TO HIM I GUESS CAUSE WHEN I CALLED HIM BACK LATER THAT SAME DAY HE HAD ALREADY LEFT THE OFFICE,,,BULL SNOT !!!!!!!!!!!!!!!!!

    The phone number to the Office of the Controller of Currency is 800-613-6743. You can also file a complaint on line with them as I just did about Bank of America @ HelpWithMyBank/gov

    I know your anger. My wife and I are going through the exact same problem.
    I asked BoA for help to lower my mortgage payment 2 years ago and like you, they say there working on my situation. But, in the meantime, Im threatened with forcloser. I was told by an associate at BoA to get behind 2 payments and then I could get a loan modification. Well, now they say they can't help us because were 2 payments behind,,,,,GO FIGURE????????? I will never deal with BoA for any reason ever again,and I'm asking ALL my friends to do the same,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,

    well i have to call these quacks every 2 months cause they take 46.91 out of my paymt and apply it in a ( mis applied funds) acct. what the hell?
    call today and i am informed by mistake that i have over paid by 480 last year.. funny, i was threatened with forclse more than once for being 1 month behind and 6 months behind on latre fees ( i refused to pay them), but now i have 480 set aside.

    how do you really fight these morons?

    call hector rodriguez in mortgages x 8308,8808 or something like that.
