We attended their presentation and after some calculation decided to pay for the membership which was $4990. We wanted to update our kitchen and bathroom cabinets, as well as bedroom furniture. We put down about $1000, and the rest was financed through their lender Beta Finance.

A month later we started planning our purchases and realized we were about to pay more by buying through them than we would otherwise. What the don't tell you on their presentation is that while you save about 10% on furniture they add 8 % handling charge in addition to 7% tax, and that doesn't include shipping.

I am now trying to get our membership money back. Do not become a member! Buy from other stores.

Does this sound ok? I was also going to send the 3 references from page 93 with it...

    Dear Owner: ------
    DBA DirectBuy of Fort Mill
2180 Carolina Place Drive, Suite 103
    Fort Mill, SC 29708
    803-835-8950

Our names are ------ and ------. Yesterday, September 15, 2010 we filled out a 3 year contract to be financed over 36 months at $100.88 a month after a $190 down payment.

We are exercising our  right to cancel our DirectBuy membership, based on the information provided by a DirectBuy owner in the video investigation by CBC MARKETPLACE- THE PRICE CUT PROMISE on March 27, 2009. Stating that DirectBuy was in the process of  printing new contracts including a three day cooling off period. My contract does not include this therefore making this contract invalid because it hasn't been updated.

At the time that we signed, we were put under intense pressure by your salesperson. We were not offered any trial membership and told that this was a one time offer.

I would like a rescission. We want conformation in writing by mail within 10 days that we will receive a full refund of the down payment and will not owe any money to you and/or any companies you may try to submit the Retail Installment Contract.

We will not except phone calls or emails.

    HI TOM
YOU need to be as specific as possible, list all 3  ref. in detail
separate each 1 in a seperate paragraph

    YOU are cancelling the contract
...were shocked to find references that guarantees a 3 day...
...contract violates your own corp. co. policy
...invalid & obsolete due to your use of a contract stating
    No cancell...?

    1)   cbc video, list all details as i printed on p. 93- you are missing owners name...location...

    2)  As far back as MAY 2007, their has been a cancellation period
print a copy of the article by boston channel
on p. 91--click on link & print copy to inc. in your letter
highlight the bottom --Regarding our cancellation...

    3)   Acc. to S.C. CONSUMER PROTECTION LAW,
a contract cannot be written biased in favour of your co.,
forcing a consumer to give up their rights to complain & cancel
----contract has also been misrepresented to me.

Thank you for all support suggested.  If I remember correctly, I think Roger or someone said that they'll wait for class action lawsuit and also mentioned that they had tried everything for refund and nothing happened.  I believe they're a member in CA?  Yes, a very few have been refunded.  VERY FEW....
Roger (?) also stated at least they are in a position, although ripped off for thousands of dollars by joining db, they won't go broke over it more or less and can move on. That's just what we'll have to do as well.
For over a year I've been agonizing and arguing with spouse over the great amount of money we've lost; I've called attorneys, two class action lawyers' ofc, filed complaint with Attn Gen, gathered my info, contacted, by calling our local db owner by phone did receive answer & responses right away from owner.  He does everything by the book!  I believe he truly thinks his franchise is a winner.
ad nauseum,  yes, I believed, like one member advised, to talk to the owner (against Trudy's suggestions) which we did but no refund.  One thing I haven't done is call the corporate off.  I still am hooked on this site.

corp. address is near the end of p. 1,

I DID IT!!!! I sent them the letter I wrote above a day after signing with them and they called the next day trying  to talk me out of canceling but I said as many bad things about the company as I could think of and they eventually said OK!!! I told him about how I have read that some members have signed up only for that location to shut down just days later, that I didn't want to do business with a company that would do that to someone. He actually told me that the contract WAS legal even though it didn't say there was a 3 day cooling off period. Even though it just said not cancelable. That it had been rewritten before. All i have to do now is send back the pamplet for him to do the recission. THANK YOU SOOOOO MUCH Trudy you are an amazing person for what you do...

Yup, good for you Tom, you had the advantage it takes to drop the membership.  The 3 day cancellation period is the ticket and it's the law.  I sure wish I had done it too..  Now it being a year later it's about impossible.  And if this store closes in our city I don't know what I'll do.

    TRUDY
THE 3 DAY CANCELLATION PERIOD IS THE TICKET

THE 3 DAY COOLING-OFF PERIOD IS DB'S OWN CORPORATE COMPANY POLICY

I list the references continually, listed in my letter to Tom & ON P.  93

BUT DB REFUSES TO USE UP-TO-DATE, VALID CONTRACTS, INC. THE 3 DAYS

THEIR POLICY IS TO PLAY STUPID
& their motto is "what the consumer does not know, will not hurt db..."

DB'S other motto is 'TELL as many lies as possible'
Because the lies are not written in the contact
& they are "not bound by verbal..."
    ---------------------------------------------------------------------------

DB DOES BREAK MANY LAWS, as I continually list,

Duress, Fraud, Misrepresentation as of contract
Miss material contracts of the contract...
    biased in favour of db...
===========================================================================Anyway sometimes I get frustrated from repeating myself,
but I always have the victim's in mind,
I will not give up & will always try to help....!!!

DON'T LET ANY ONE GIVE UP IF YOU CAN HELP THEM!!

    WOW TOM!!!
I ASKED FOR "Good news soon..." & I got it!

AMAZING!  But db is so brutally desperate, that I still don't trust
    verbal statements & phone calls,

SO I SUGGEST a FAX, INC. details of your phone call,
date & time that you are coming in,
    agree to return materials,
& receiving written confirmation of rescission of contract...full refund...

    IF it still applies!!
Either way, I'M proud of you for fighting back,
please stay here with us, & help by warning others!

I just LOVE this site!  It helps to vent. Losing $5,490 hurts bad.
But I have to say that on the Agreement we signed in Florida, IT WAS VERY PLAIN & FORTHRIGHT ABOUT CANCELLING THE MEMBERSHIP (in a 3-day period only).
On the back page in large and bold letters, there it was, a stand-out paragraph about their policy of our right to cancel -
=== only within that 3-day period!!!!
To Trudy, and all others: ----------------
I really believe that if I had utilized that policy of cancelling, we would have been refunded without a problem.
Sure, they would have tried to talk us out of it, of course BUT THEY HAVE TO HONOR THEIR CONTRACT policy.
That's DB's only catch in writing and it's a law.  They cannot possibly get away with not refunding monies if that's what new members want to do.  Direct Buy owners, plus DB's Corporate Ofc knows it too.

I will always deeply regret that I didn't cancel DB right away when I had the chance.  But having just signed the Agreement only that weekend (after their FABULOUS presentation), the clause to cancel failed to provide me with enough time.
They are pros at hardcore salesmanship and move in fast for the
'membership to join' money.  A LOT OF MONEY!!!!
Most people are more cautious with spending their hard earned money and do not purchase a $5,000+ deal in that manner.
We who were mesmerized were thoroughly duped and/or just fell into their clutches.  Their offers seem pretty good.  I still remember and will never forget our presenter claiming "why pay retail when you can get it from us wholesale?"  Bulls*$t.  No, he did not put that in writing.

Oh well.  My only recourse is to keep accummulating price comparisons and eventually strike at the corporate office.  My membership is now already a year old.

I'd really like to know if ROGER ever received a refund?????   Thx.
Oh- (the class action lawsuits will take forever). I believe the attorney's ofc I spoke with said theirs is only good for Indiana residents???  I may be wrong.  I'm out my money for now period.  Time to move on.  My spouse is sick of hearing about it so that's it.  +++

Do not join!  I went in with a freind and joined mostly because they told me I could not come back for 7 years if I left without signing.  What kind of honest business practice is this?  Somehow, I lost my mind and signed. Then I went back 4 days later for the oreintation.  After that I had to leave the country on business and realized that I would never benefit from the contract since I have a new home.  Tried to cancel when I returned home and they told me after 3 days I was not allowed.  That was one day before they even showed me what I bought!  That can't be fare.  This is the scam.  They schedule your oreintation after it is too late to quit and how do you know what you bought unless you investigate it first?  Stay away.....RUN away from a Direct Buy sales pitch! Are there any law suits against the North Pittsburgh Cranberry Twp store? I would picket also with anyone interested.
