Lol gee how do you get them to stop calling?  Maybe, hmmm oh I dont know, maybe just maybe pay your bill?  Wow what a concept.  Actually paying something.  Maybe pay your car loan every single month like you are supposed to and signed a contract to do, maybe pay those old school loans or credit cards off instead of just letting them go saying oh well to bad.  Show some responsibility so people like us dont have to call you.  Its not illegal to call neighbors or relatives, its just illegal to disclose any information.

If they already have your contact information, then there is no reason to contact neighbors or relatives.

Debt collectors who continue to contact others when they already have your contact information do so for one reason:  to put pressure on you by embarassing you.  That is abusive and illegal, and you can sue them for it.

No its not illegal, its only illegal if we tell the relative or neighbor why we are calling.  Giving them personal information is what is illegal.  And yes there is a reason to contact them, if it gets someone to call in after your so called embarrassment, and then they pay, well then it worked huh.  What I collect for though, is for vehicle loans at a certain bank, who the people still have their vehicle, and are in danger of repossession.   If they dont pay after 60 days past due, and we get it at 31, then it is assigned for repossession.  Maybe just maybe these idiots should answer the phones and pay us.

Yes, RAB is a collection agency and yes sometimes people fall into hard times and are unable to continue to pay their bills.  On the other hand though we have been working with RAB for over a year now and they have been nothing but courtious and of course we are trying to make good on the debt as well.  Thank you for working with us and as of today we have settled our debt!

Explain to me why RAB has been calling my house for years looking for my wife's ex-husband's widow. We do not know her. She lives in a city 100 miles from us. My wife has been divorced from him for 20 years. He has been dead 10 years. Why would we even care where she is or how to get in touch with her. I have asked and asked and asked the callers not to call me again but they don't care. How do I get your company to stop harassing me?

Although I can see your justification for attempting to work out payment arrangements before repossessing, that does not amount to a legal right to do so beyond obtaining location information.  Obtaining location information is not using a third party as a communications channel without the agreement of the alleged debtor.

Since the § 804 exception was the only reason you could legally contact third parties other than those explicitly outlined in §805, once you have location information, you no longer have any "reasonable" purpose for further contacting third parties to obtain location information you already have.

    http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf

    "...
§ 804. Acquisition of location information
Any debt collector communicating with any person other than the consumer for the purpose of acquiring location information about the consumer shall—
    ...
    (3) not communicate with any such person more than once unless requested to do so by such person or unless the debt collector reasonably believes that the earlier response of such person is erroneous or incomplete and that such person now has correct or complete location information;
    ...
§ 805. Communication in connection with debt collection
    ...
    (b) COMMUNICATION WITH THIRD PARTIES. Except as provided in section 804, without the prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a postjudgment judicial remedy, a debt collector may not communicate, in connection with the collection of any debt, with any person other than a consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector.

Does anyone know of any lawsuits or know of any class action suits against RAB or FIFTH THIRD BANK?

Fifth Third Bank is the worst crooks in the world!  They sent a letter after 4 years of a car being sold and stated that we still owed over $12,000!  The car was bought 11 years ago for $17,000!  They said if they didn't hear from us within 30 days, they would turn it over to a collection agecny, RAB.  I sent a certified letter within 10 days and they still turned it over to RAB!  I've faxed RAB papers, sent them emails, and am still waiting to talk to them.  This is bogus!  I have Power of Attorney for my husband who is in extremely poor health since he was the one who c0-signed for this car.  I get nothing but a run a around.  My husband can not hear about this as it will litterly "kill" him.  He had a massve stroke which almost did kill him.  I can't sleep nights and am a nervous wreck.  We are senior citizens and don't have that kind of money (even though I know it's not owed).  The government needs to step in and close down Fifth Third!  I have read terrible reviws on them and over 400 complaints.

You can send a cease and desist letter but beware that that may accelerate the collection process. At that point, they can sell your debt to a bill collection agency that will not be bound by the cease and desist letter. Also, third party collectors are more likely to violate FDCPA than your lender's in-house collections department. If you contact them and communicate with them, this can stop the calls as well.

They are not allowed to harass third parties into getting you to contact them. Keep in mind these third parties may be their customers or prospective customers. Think about how that would make the bank look. Instead, they have a legitimate reason to run a partial skip trace if they have not had any contact with you in 21 days. What good does your contact info do them if you don't answer the phone? If someone stole from you, would you whistle dixie and do nothing about it? Then why do you expect this of them? You owe it to your relatives to at least communicate with your bank so that they don't get involved. That is EMBARRASSING to have  a bank call you for someone you know even if you didn't borrow the money. Don't do that to them COMMUNICATE!

They cannot collect from anyone who is not contractually liable for the debt. If you didn't sign the contract, they have no right to collect from you. The contract by the way, supersedes divorce decrees. Contacting neighbours and relatives for locational purposes is a practice known as "skip-tracing" which is subject to FDCPA. Contacting third parties is only permissible if the creditor has had no contact with the debtor within 21 days.  You cannot hide from your debt! Communicate or run the risk of having relatives, neighbours, associates, and co-workers knowing about your debt. If you feel your rights have been violated under FDCPA, contact legal aid or an attorney. In some cases, FDCPA violations can result in cease and desist orders which prohibit the creditor from attempting to make any contact with you.

"RAB collector" gives very good insight to the type of people you will be dealing with when working with RAB.  No matter how you came into this unfortunate situation they will consider you a "dead beat". For you "RAB collector" to say "stop f*** being a lil b***h and pay" is completely unprofessional. You sir are the real dead beat for making a living off other people's misfortune.  I believe that the majority of people would like to pay off the bill for the signed contract that you mention.  The battle in paying lies in the ridiculous collection fees and outrageous interest rates that incur. If you can't pay the entire balance at once they do not offer any sort of settlement and when trying to set up a payment to show intent to pay the debt a monthly fee that is impossible to meet is offered.  I would recommend to you "RAB collector" to treat your clients with decency and evaluate each person on a case by case scenario.  If you conduct yourself in a friendly professional matter, you may find yourself making more money and come to mutually beneficial terms.
