TEHY RECORDED MY VOICE
Complaint
robert
Country: United States
I got a call on my cell phone regarding credit card debt relief. . I was transferred to nakisha, asked if I wanted to continue, they asked for $600 or $60.00 to send me the paperwork and for the consultation. When I asked them what it was for she said they would deduct from my first payment but would not tell me what the money was for FINALLY SHE said yes.
THE FIRST TIME THEY TOLD ME IT WOULD APPLY TO MY CREDITORS BUT WHEN THEY CONVINCED ME TO RECORD MY VOICE THAN THEY SAID IT WAS ONLY A FEE FOR THE CONSULTATION!!!
. No fees should be sent to anyone for additional information requested on a company or program
she has been harrasing me telling that i have to pay this amount or else! and that they can take me to court becaues they have my voice accepting!! ! unfortunally i gave many personal information!!
what happends now??
i never signed anything!!!!

Advanced fee loans are illegal.
Advanced fees for credit repair are illegal.
Claiming to be attorneys when they are not is illegal.
Claiming you agreed to something when you did not is illegal.
Threatening you to extort money you do not owe them is illegal.
Get the pattern?
This is not some business offering to provide services in exchange for payment. Legitimate businesses don't do this.
They haven't actually performed any "services" of any real value, and probably won't anyway even if you paid them. It's all about getting as much money from you as they think they can.
All of the above should cue you that they are a scam to extort money, and nothing more. In fact, the more they threaten, the more likely they are just criminal scammers.
If you gave them any account information, better close that account.
If you gave them any identifying information, such as SSN, better put a fraud alert on your credit reports.
Do not respond to them, or talk to them on the phone.
Contact your local DA's consumer fraud unit, your state AG, and FTC.
In particular, if you search on those phone numbers, you might find out what others are reporting about their activities.
Using autodialers to telemarket to cell phones is illegal.
(Virtually all telemarketing uses autodialers.)
So unless you actually called them first, or requested that they call your cell phone, they violated the Telemarketing Sales Rule with their first ring.
I NEVER called them EVER or requested for them call my cell. i was actually watching a movie!!!they caught me of guard man!!
actually it sounds like this called"CONSUMERS LAW GROUP"
hires like a telemarketing operators to call (autodialers to telemarket to cell phones) because when i ask the first person that called i asked him "what is you website? and the guy wasnt able to tell me he would say "oh all that information will be given later" AND AVOID ANSWERING!!!and so o and so on...
I CLOSED MY ACCOUNT THAT SAME DATE i gave them right away, but i will make sure to contact all of the associations you are telling me before they start trying messing up my credit.
regarding the telephones and exact names of the companies that are involved i will get it! and gather all of the information because i destroyed the paper work they wanted me to signed!
Ill get back to you shortly!!!!!
thank you so very much!
p.s
what i do remember is that i wrote the better bussiness bureu and i was told the following let me know what you think when i asked them about this company:
********************************************************************
BETTER BUSINESS BUREU
Good Morning, First, the 20 complaints are in a 3 year reporting period. So they have had 20 complaints in three years. It mean they responded to all complaints to consumer and Better Business Bureau satisfaction. There is a letter rating there as well and you can read what each letter means. Sincerely, Jill Henderson
ITS NOT A LOAN ACTUALLY THEY WERE TO TAKE OUT AUTOMATIC PAYMENTS FROM MY ACCOUNT TO PAY MY CREDITORS
Advanced fees for credit repair are illegal.
THIS IS GREAT TO KNOW
Claiming to be attorneys when they are not is illegal.
WELL ACTUALLY AFTER I TRY TO CANCEL WAS WHEN THEY CONECTED ME WITH ANOTHER DEPARTMENT WICH I THINK IS THEIR LEGAL DEPARTMENT BECAUSE THE WOMAN SOUND LIKE SHE KNOWS A LOT THAT IS WHEN THE THREATS STARTED!!
Claiming you agreed to something when you did not is illegal.
THEY DID "RECORDED" ME AGREEING BUT THEY HAD ME LIKE A PIN BALL THEY DIDNT LET ME TALK!!
Threatening you to extort money you do not owe them is illegal.
YES THIS EXACTLY WHAT SHE IS DOING AS WE SPEAK! ACOORDING TO THEM NOW I HAVE A DEBT WITH THEM THATNKS TO THE RECORDING!!
A legitimate business, on already reaching a disagreement before you have even started, would walk away, not make threats.
Contracts are based on a "meeting of the minds", both parties in agreement on what the terms of the contract is. That does not occur when they deceive you into some agreement to one set of terms, and then claim you agreed to some different set of terms. Their claim that your money would go to pay your creditors, followed by, after they claim you agreed, later claiming it was instead first going to their fee, is probably just the most obvious misrepresentation. How could you expect to depend on ANY company that made such a misrepresentation from the very start?
Scammers alleging they have some agreement "recorded" can pick and choose what part of anything you say they play back, they can edit or leave out their various deceptive claims or offers, and then even claim you agreed to something completely different. The whole purpose for doing it all "verbally", is so they can later claim you agreed to whatever else they want. After all they "recorded", but almost none of the people they call are set up to do the same.
They may have recorded you "agreeing" to something, but without the full recording of the call, with all the representations made, what exactly did you "agree" to?
Many just claim they recorded, but refuse to play it back, saying they don't have to, but threatening that you can hear it when they take you to court. Some (such as those pulling "business directory" scams) have been known to actually edit their alleged recordings to make some employee's confirmation of some address sound like an agreement to an advertising contract. Remember, the alleged "terms" are whatever their person said, so they can make that be whatever they like, even after the fact.
And to even be pulling this stuff, they had to have planned it from the start. They called you with the intention of coercing money from you, and were willing to say whatever it took to do so. Why else have all this BS already in their "script", complete with "recording", and some "legal department"? That is not the business model of a legitimate business.
Did they claim this would "help your credit"? If so, then they are a "credit repair organization", and subject to a specific federal law governing CROs (possibly state laws, too). One of the provisions of that law is that they CANNOT accept fees ahead of performing their services. If they requested such fees, they violated the law.
The key thing to remember, however, is that this type of scammer, for all their threats, generally can't take the risk of actually going to court. They probably have records of complaints against them, whether with BBB, law enforcement, AGs, FTC, etc. They might even have problems getting an attorney to represent them, since a legitimate attorney might have his license at stake should it come out he was aware of their fraudulent actions but sued anyway.
The focus of their threats is to panic YOU into coughing up money as quickly as possible, and they feel safe and anonymous enough to make some pretty outlandish threats, knowing it might take years for any state AG to go after them. They can change names and cities faster than that. If they can get some money out of you, they may then use that to pressure you into paying more, claiming that proved you agreed to the "contract".
Their "legal" department is probably just for show, just like their name. In reality, it's just the "closer" they transfer you to threaten the money out of you. Probably sitting on the other side of the same room. As far as what she "knows", she probably knows the psychology of threatening and stampeding people on the phone. That's the "business" they are in.
If she does contact you again, you might ask her if she is an attorney, and if so, what her full name and what state she is licensed in, and what her license number is. A licensed attorney would tell you, but a licensed attorney probably wouldn't be doing this [***] job. She will probably either backpeddle to avoid prosecution for unlicensed practice of law (state bars protect their turf), or increase threats to try to get you to back down and pay. If she admits she is not an attorney, then ask for the name and license number of their alleged "attorney", and what state the "attorney" is licensed in. Remember, by putting the word "law" in their name, they represented that they were run by at least one attorney, and that their activities were done under the supervision of a licensed attorney (unlicensed "attorneys" are NOT attorneys, and they don't get to call themselves attorneys). If that is not the case, then everything they said is a misrepresentation.
And if you feel like it, record their calls. After all, they claim they do.
In particular, if they are doing telemarketing, phone numbers are easy to search on and find complaints from others, since people get really pissed if they get telemarketing calls on their cell phones, or on their landlines when registered on the Do Not Call list.

Key provisions of CROA:
"...
SEC. 404. PROHIBITED PRACTICES.(6)
...
(b) Payment in Advance.--No credit repair organization may charge or receive any money or other valuable consideration for the performance of any service which the credit repair organization has agreed to perform for any consumer before such service is fully performed.
...
SEC. 405. DISCLOSURES.(8)
(a) Disclosure Required.--Any credit repair organization shall provide any consumer with the following written statement before any contract or agreement between the consumer and the credit repair organization is executed:
'Consumer Credit File Rights Under State and Federal Law
You have a right to dispute inaccurate information in your credit report by contacting the credit bureau directly. However, neither you nor any ''credit repair'' company or credit repair organization has the right to have accurate, current, and verifiable information removed from your credit report. The credit bureau must remove accurate, negative information from your report only if it is over 7 years old. Bankruptcy information can be reported for 10 years.
You have a right to obtain a copy of your credit report from a credit bureau. You may be charged a reasonable fee. There is no fee, however, if you have been turned down for credit, employment, insurance, or a rental dwelling because of information in your credit report within the preceding 60 days. The credit bureau must provide someone to help you interpret the information in your credit file. You are entitled to receive a free copy of your credit report if you are unemployed and intend to apply for employment in the next 60 days, if you are a recipient of public welfare assistance, or if you have reason to believe that there is inaccurate information in your credit report due to fraud.
You have a right to sue a credit repair organization that violates the Credit Repair Organization Act. This law prohibits deceptive practices by credit repair organizations.
You have the right to cancel your contract with any credit repair organization for any reason within 3 business days from the date you signed it.
Credit bureaus are required to follow reasonable procedures to ensure that the information they report is accurate. However, mistakes may occur.
You may, on your own, notify a credit bureau in writing that you dispute the accuracy of information in your credit file. The credit bureau must then reinvestigate and modify or remove inaccurate or incomplete information. The credit bureau may not charge any fee for this service. Any pertinent information and copies of all documents you have concerning an error should be given to the credit bureau.
If the credit bureau's reinvestigation does not resolve the dispute to your satisfaction, you may send a brief statement to the credit bureau, to be kept in your file, explaining why you think the record is inaccurate. The credit bureau must include a summary of your statement about disputed information with any report it issues about you.

Complaints to several state Attorneys General, and FTC.
Warning from Oklahoma Attorney General.
Indications the "debt reduction" pitch may be a scam to get account numbers and run up "up front fees", and even a report of fraudulent personal retail charges. Reports that "3 way calls" with your bank are used to get you to "authorize" putting a large charge on your account.
If you have any further problem with these people, they appear to be located in Florida, so contact the Florida Attorney General. Close any accounts if you have given them the account number.
Looks like they are being "hunted" by several internet packs.
Very entertaining.

"I wish I had checked this site out before I got taken. I am grateful that I was only “hit” once and my BofAmerica is handling the fraud. I was kept on the phone for ovre 30 minutes and when I asked questions was passed from person to person and finally to their “Legal Verification Department” The call came from 877-696-1474 at around 1:00 pm last Monday. I spoke to three representatives. Mary, Mari (mah-ree),and a young man named Shawn Vinson (not Vincent, he corrected me). They put in a call to BofAmerica with me on the line and I thought I was on a 3rd party call to authorize their charge which was to help me reduce my interest rates because they work with the “550 plus lenders in the country” and have a team of “experts” who help people with credit card debt reduce their interest so they don’t have to file for bankruptcy. I am 50 years old and have been very very careful. These people were very slick and I was very stupid. I don’t usually tell everyone that, but for all those people who were careful and relaxed one day thinking maybe someone could help, beware. I even asked that darn guy if he would do this to his mother and he said yes.

That evening, the infamous Michelle called to confirm my appointment with the financial analyst who would work with me on the phone for all my “problems.” I have cancelled my cards and the appointment with the financial analyst is March 17 at 10 am. I don’t know if they will call, because I have left messages for them to return my call and they haven’t.
To the smart person who started this page, thank you…I wish I had come here before and not after and I thank you for your help. If you need or want to edit my writing, please do. I just don’t want anyone else to have to go through this, even though there are trusting souls who still fall for polished cons. Thank you very much, RA Marshall.

I am playing with a scammer
So I get another recorded call from "Michelle from Cardholder Services" asking me to press 1 to talk to a counselor or 3 to be taken off their list. Well I get these calls about twice a week, I am on the do not call list, and I have pressed 3 several time. I figure I am being scammed. So a few weeks ago I decide to press 1. I get a dopey guy asking me if I want to lower my interest rates. I try to get some info, but no good he hangs up on me. I was pissed, but I knew they would call back. A few days later same call. This time I play it a little different, I play along and tell the girl that I already gave them my info and ask to be switched to the other guy. This confuses her so I see my opportunity. I then get a little info from her. I start to make small talk to get some info. I talk about the bad weather here and ask what it is like there. She tells me warm and sunny. I say, 'it must be nice to be in Cali. She says 'no, I am in Florida'. Next I get into having family in Miami. She says that is south of her. I then say something about going to Orlando. BING! We have a winner, she is in Orlando. I am feeding her my false answers in between getting more info. She starts to get wise and hangs up. No problem I know they will call back.
Next week I get the call again. This time I play dumb again, but armed with my bits of info that I plan to build on. This dope plays right into my hand. I load her up with my fake info, but ask for a little info from her. She gives up the street address, and I keep pressing. Playing dumb but concerned. I let her think that I am just concerned about giving my info and would like some verification of who they are. She mistakenly gives up her supervisor's name which I am connected to. The supervisor points me to some generic website with no contact information other than an EarthLink address. http://www.interestsavingstoday.com/about.html A quick look up of the address reveals a name and a number (386) 860-1037. I look the number up and it is some guy in Deltona. I call the number up and looks like a winner. I get a person that answers the phone just like they did with option 1. A chic named Jen that wants to lower my interest rate. I tell her that I know who they are and will be providing the information to the FTC. She is furious and says 'where in the hell did you get this number?' and hangs up.
That encouraged me to call back. I got a different person and the same response. I asked for Debra Roberts the supervisor and was told that there was no one there by that name and hung up. I wait and call back. I change my approach. I go back to nice mode. I tell the person that I know they are just trying to make a living and I am friendly. I tell them about all my calls and how Jen hung up on me, Susan yelled at me and I even talked to her supervisor Debra. She asked if I wanted to talk to Debra again. Idiots! That confirmed that I had the right number. I later confirmed their company name and address from the BBB http://www.orlando.bbb.org/newsearch...07330022002792
So now I am at my next step. I called my local police and they really don't care. The Orlando police doesn't care. I am not sure if I should waste time with the FTC or just keep calling these people every day to annoy them.
I think this may be bigger than just this company. I get the idea that they are getting their calls from a call router.
Anyone else get calls from these people?"
"BadBradHaz
I played dumb with one of their dopes and they gave me their website. Obviously they crafted it in a way so that you can't get any info from it, but they weren't smart enough to change their lookup info. So a simple whois revealed:

The plot is thickening a little bit. I had a police officer call to put the pressure on them. At first they were rude, but when they realized they were a real police officer they gave up a little more info. They are claiming that they buy the calls from a service. I kind of suspected that they were using a call router since this scam seems to occur in several places in Fla, and when I called my number came up as an area code 281 number. If someone feels like calling them and asking what number is showing up I would be greatful. That could put me closer to finding out who these people are. (386) 860-1037 Most likely Tasha would be the person that would give up the info. Call and play dumb and tell them that you are not sure what number you are calling from and get them to tell you. Tell them that you are in Houston which is where that area code is from."
Oklahoma Attorney General warning about "Card Holder Services", "Card Services" or "Credit Card Services":
http://www.sequoyahcountytimes.com/articles/2007/06/08/news/front9h.txt
"Public warned about possible phone scam
Friday, June 8, 2007 5:06 PM CDT
Attorney General Drew Edmondson issued a consumer alert recently after receiving dozens of complaints from Oklahomans about a possible scam.
The attorney general's Consumer Protection Unit has received 61 complaints from Oklahomans who have been called by either Card Holder Services, Card Services or Credit Card Services. According to the complaints, the company offers assistance to consumers who want to consolidate and lower interest rates on credit card debt.
"In the beginning the calls are automated," Edmondson said. "The recorded message tells consumers to press a number to speak to a live person who can then consolidate and lower interest rates on any credit cards they have."
Edmondson said the live person then begins asking the consumer for information about their current credit card accounts including balance information and security codes.
"One consumer gave out her information and then received a call from her actual credit card company notifying her that a $1,000 service fee had been placed on her account," Edmondson said. "Additionally, the card number had been used to make a $760 purchase at Neiman Marcus."
Investigators for the attorney general's office believe whoever is behind the calls may be in violation of state and federal identity theft, credit card fraud and Don't Call laws as well as laws restricting the use of autodial machines and caller ID spoofing.
The attorney general's office is investigating the complaints, but in the meantime, Edmondson wants consumers to be vigilant in protecting their personal and financial information.
"We think this company may be violating a number of state and federal laws," Edmondson said. "These people have taken great pains to hide who they are and how they operate. We are doing everything we can to find these people, but until that happens, we want to remind consumers to protect their information.
"You should never give out your financial information to someone who calls and asks for it," Edmondson said. "Anyone can lie and say they are from your bank or your credit card company. If someone calls requesting your banking information, hang up and call your bank. You should never freely give out the keys to your accounts."
Edmondson's Consumer Protection Unit has statewide jurisdiction to investigate and prosecute violations of the state's Consumer Protection Act. Anyone with information regarding suspected fraud or scams can contact the attorney general's consumer protection hotline at (405) 521-2029."

I work in the call center of a 6-store pizza company in Seattle. I’m the main operator during the day, so of course I’m the one who gets all the telemarketing calls. What’s funny about “Michelle” is that she says to consider this the “final offer,” and yet we get her pre-recorded schpiel about once a week. Once a week isn’t bad, but considering we get a call once a week from about 30 different telemarketers, it’s quite annoying. I agree that the most annoying aspect of this particular company is that they won’t give you ANY pertinent info. in order to file a complaint anywhere (all our company’s #s are on the Do Not Call Registry). I think if I could nail any of the companies that call us with a lawsuit, I’d pick Cardholder Services. If anyone gets any info. in order to do so, please post it here as it looks like there are many people in the same boat."

Thanks Spyboy, I think that you are onto something but the number that you had provided points to a residential line (unless I am missing something). The website seems to be a “genuine/bogus” site. The links all point toward nothing and the phone number does not seem to be valid either. I sent an email (with a virus attachment) that did not get returned so I believe that the email address is good and probably the domain(belonging to a company called QAGroupOnline.com). It would be nice if anyone reading this has the technical aptitude to get some information regarding their IP address and domain if possible.
I called the number that QA has listed on their website and it was busy. Don’t know much about telephony but I think that only a paid line can provide a busy signal. This would be one way to dig deeper if anyone wants to pick up the ball from here, both companies are listed as :
Our mailing address is:
385 CenterPointe Circle
Suite 1305
Altamonte Springs, FL 32701
A Google search on them provided this:
http://versadebt.com/Main/FAQ.aspx
Apparently another related company with this interesting paragraph from the page:
If you experience difficulties durring the ordering process, please contact us by phone: (877) 680-DEBT, or by email (csr@QAGroupOnline.com)
I tried the number but a message plyed asking to call back during normal business hours (it IS very late here). THat page lists a GA physical address…..
Here is another site that claims the SAME email address also in GA:
http://www.getdebtsafe.com/ContactUs.aspx
and another:
http://mycalculatedsolutions.com/contactus.aspx
which both appear to be hawking bogus debt relief software (notice that there is little, if any, information regarding the mechanices of the software) with contact information that appears to be invalid.
It all points to fraud and if true, I would love to see people like this hanged from the highest tree in land. Anyone out there willing to take the ball and run with it from this point>??

I called the number but didn’t enter the extension number and waited for a real person to answer. They answered “Capital Law Group.” I asked who he was and he said his name and that he was a debt counselor. I asked for the address and refused to answer his multiple questions about why I wanted it and he gave me this:

I used to work for this company. As a matter of fact it was last week for one day. i knew something was not right. Mike is a manager that works there whom has no respect. The environment is very unprofessional and I belieive it is also a scam. You receive inbound calls and you have to ask if you owe total of 2500 in total credit card debt. if you say yes, they automatically switch you to a representative. They are not part of your credit card companies and they will not give you any information. They tell people that the name of the company is Account Services and it is a general call and to stay on the phone for no longer than 1 minute to prequalify. If it takes longer than than that they are advised to hang up. They have 4 locations, I believe and the headquarters are located in Fl.The Marietta, Ga office has been there for 2 years I think. The physical address is 4501 Circle 75 Parkway, Bldg A Ste 225. Atlanta, Ga 30339. I hope this can help. I would not suggest doing business with this company.Beware all!

All,
I have filed a complaint with the State of Michigan Attorney Generals Office of Mike Cox against these folks. Thanks to Amy Christie for their information, I had something to actually provide to them. Because I am a person of principle, I am going to follow this through until I see that these scammers get what thy have coming to them.

Here’s some information on a group of the same name in California that is in trouble with the FCC. Are they related to the Georgia group? There is a name and address here for the owner.

I’ve been getting calls from these people for over a year now, but it wasn’t until a few days ago that I pressed 1 to speak to a “representative.”
“Can I help you?”
“You are in violation of US Code Title 47, Section 227 regarding the use of pre-recorded messages to initiate telephone calls.”
“…You’re a smart man.” *Click*
It felt so good to do that. Needless to say, *69 didn’t work. And they called back today. My phone company told me I could add a tracing service to my phone for another 10 bucks a month, and I’m seriously considering it.

BBB report on "Capital Law Group":

Two consumer complaints against "American Debt Negotiators".
One sounds very similar to your experience, with misrepresentations with regard to when an agreement was reached and when payment would be made.

One complaint, in 2003, on Ripoffreport.com
Looks like a screwup, although at a different site.http://www.ripoffreport.com/reports/0/042/RipOff0042754.htm
Nothing on complaintboards.com
You should probably read the BBB report. Search on "Money Management International", and check the report for the "9009 w loop s suite 700 houston tx" address.
Credit counseling companies are often set up with a for-profit company working thru associated non-profit companies. Not sure whether Money management International itself is a non-profit, but "Consumer Credit Counseling" is probably non-profit. BBB's concern appears to be with the public accountability for spending of funds of the non-profit. BBB revoked their BBB membership over this in 2007.
Regarding the quality of their services, you might need to look further, and that might vary from site to site. BBB lists various branches all over the country, some are BBB members, some not. It would be worth a call to Houston BBB.
The main problem with any third party paying of creditors is that you are at risk of damage when they screw up. As the one complaint indicates, if you are out of the loop, and one creditor isn't being paid, you could end up with higher interest, more debt, and damaged credit, compared to managing your affairs yourself. Of course, the people who are considering this approach to their debt problems may not have learned the skills to manage their financial affairs, and that is what these organizations claim to teach.
You want to be sure of two things: 1) are they honest (not just pocketing the money and stringing you along without paying the creditors? There may be requirements under state law that funds held for payment of creditors be held in escrow, and dispursed within designated periods; 2) are they competent?
You would check on appropriate licensing in the state where they are serving you, reports of complaints, and in addition, insist on keeping close tabs on their activities. Monthly statements of payments made by you to them, and payments dispursed to creditors would be appropriate, just as you would have if you were paying your creditors directly. You would want to make sure that counseling service statements and accounting matches your creditors' statements.
