I got a call on my cell phone regarding credit card debt relief. . I was transferred to nakisha, asked if I wanted to continue, they asked for $600 or $60.00 to send me the paperwork and for the consultation. When I asked them what it was for she said they would deduct from my first payment but would not tell me what the money was for FINALLY SHE said yes.
THE FIRST TIME THEY TOLD ME IT WOULD APPLY TO MY CREDITORS BUT WHEN THEY CONVINCED ME TO RECORD MY VOICE THAN THEY SAID IT WAS ONLY A FEE FOR THE CONSULTATION!!!
. No fees should be sent to anyone for additional information requested on a company or program
she has been harrasing me telling that i have to pay this amount or else! and that they can take me to court becaues they have my voice accepting!! ! unfortunally i gave many personal information!!
what happends now??
i never signed anything!!!!

Regulators, Chase Target Debt Settlement Firm Hess Kennedy

Consumer credit giant Chase Bank and regulators in at least two states are going after Hess Kennedy, a Florida-based debt settlement company, alleging deceptive practices in its dealings with consumers.

Regulators and creditors are cracking down on the so-called debt settlement firms that many consumers are turning to as their debts spiral out of control, according to several news reports
One firm that is coming under intense scrutiny is Coral Gables, Fla.-based Hess Kennedy Chartered and its affiliates.
Both Florida and North Carolina have filed deceptive practices suits against Hess Kennedy and another two states are investigating the firm, according to Business Week magazine.
Florida Attorney General Bill McCollum charged the firm with promising consumers it would help to reduce or eliminate their credit card debt for a fee. Hess Kennedy allegedly takes the fee but doesn’t pay off the debts, according to McCollum,
The Florida bar is seeking to suspend the law license of Hess Kennedy as well, according to the Daily Business Review in Florida.
Chase Bank USA sued Hess Kennedy last Friday in federal court in Wilmington, Del., accusing the firm of running an “unlawful debt elimination scheme,” according to the Review. Chase’s six-count complaint charges the firm with interference with Chase customers, conspiracy and violations of Delaware trade practices. Beth Moskow-Schnoll, a partner with Chase’s attorney Ballard Spahr Andrews & Ingersoll, referred calls to Chase. Chase did not return calls
In December, the Attorney General of West Virginia obtained an injunction that barred Hess Kennedy’s Florida attorneys from settling consumer debts for West Virginia consumers.
Hess Kennedy claims on its Web site it is an international law firm with offices in the U.S., Europe, and the Caribbean. It manages $6.8 billion for 3,500 clients, the site reports. Hess Kennedy referred calls to its attorney Robert C. Buschel with Rothstein, Rosenfeldt Adler of Ft. Lauderdale. Buschel did not return calls.

Look Out for That Lifeline
Debt-settlement firms are doing a booming business - and drawing the attention of prosecutors and regulators

Granville Jones knew he was spending beyond his means after he racked up $90,000 largely in credit-card debt - $10,000 more than his annual income. So last summer the Durham (N.C.) pharmacist turned to the Consumer Law Center for help. The firm told Granville that if he withheld payments from creditors, the CLC would have the leverage to negotiate a lump settlement on his debts and cut his balances by half in five years. So Granville stopped paying his bills and instead handed over a monthly sum to the CLC to cover an eventual settlement with creditors as well as the firm's fees. "When you are financially stressed, you hope for miracles," says the 47-year-old, who was current on his bills before reaching out to the law firm.
The miracle never happened. Instead, Jones gets daily calls from collection agencies. One lender has sued him in county court for the $25,000 it's owed. Frustrated, Jones cancelled the program in January. The CLC agreed to refund the $10,744 he paid, but only after Jones filed a complaint with North Carolina's attorney general in February. "All Consumer Law did was leave me hanging," says Jones. The CLC did not return calls for comment.
Jones' predicament is another by-product of the credit crunch. With individuals of all income brackets struggling to pay their bills, many are seeking help from the hundreds of debt-settlement firms that promise to reduce credit-card balances by as much as 70% over several years.

Wary of such pitfalls, seven states have already banned settlement activities. Others, such as Iowa, are considering similar rules. Meanwhile, the Federal Trade Commission and attorneys general in six states have recently filed complaints against debt-settlement firms. Four are investigating Hess Kennedy Chartered, an affiliate of the Consumer Law Center, including AGs in North Carolina and Florida, both of which filed civil charges against the Coral Gables (Fla.) firm for allegedly deceptive practices. "There are more of these firms than we can handle," says Norman Googel, an assistant attorney general in West Virginia, which is investigating 15 settlement firms. "They are truly exploiting a group of consumers already in crisis." Hess Kennedy didn't return calls for comment.

The American Collectors Association (ACA) is currently challenging the law trying to exempt debt collectors from prerecorded messages to cell phones because the originsl creditor established a business relationship with the consumer. If you search the www.fcc.gov website you would find it somewhere.
The TSR has to do with the National Do Not Call Registry and applies to wireline (landline communications)
Political calls (Texas for Hillary) are not supposed to use prerecorded messaging to cell phones though I had to argue with the FCC (some seem to be biased on this issue) Commerical telephones are the only ones that they can use autodialed prerecorded messages.

I have a few questions I would like to ask you since you are working with them and are pleased with their services. Myself I am not very pleased. I am having liens put on my home and be threated to garnish my wages, one of my creditors called my sister today to find out if my address they have on me is correct cause they are getting ready to serve me papers to sue me. After being with CLG with 5 months I started getting monthly statements from Rocky mountain and trust(the account where my $365.00 a month payment goes) the statement was only a few dollars in it at this time. I called CLG to inquire why there was no money in this account I was informed that the first $5000.00 that I send is going towards my atternory fees and that after that time they will start working with my creditors. My question is is this how yours is going or am I being screwed? Please Help.
Are you in Louisiana? I just saw an employment ad with one of the local law schools, also for "Consumer Law Group" from Michael Metzner in Pompano Beach, FL, requesting the services of a contract atty. here. As I do strictly short-term contract projects, I was about to apply, but am now also skeptical at this point. So, now I'm wondering if Metzner has contract atty. ads all over the country or just in LA. Thanks.
