caller fails to identify the company before asking for credit card information on an extended warranty.  I went through five levels of "approval" before reaching the closer -- but he failed.  When asked to be removed from the call list, the caller (representing Consumer Direct Warranty Services) refused to acknowledge my removal request and proceed to verbally abused me -- finally, he hung up on me.  Fortunately, I have an email from the rude individual, and have access to their network.  I've filed a complaint on the company via the do-not-call list.

Department of Insurance Slams Consumer Direct Warranty Services for Unlicensed Sale of Insurance
Dilbert taps into consumer frustration with the comic strip posted below. Call it wry humor. But the California Department of Insurance doesn't think consumer fraud is funny. Whether they are referred to as "service contracts," "extended warranties" or "mechanical breakdown insurance," vehicle repair agreements are a big profit center for new and used car dealers. Telemarketers or internet schemes may tout them as well. Often such contracts are unnecessary. Even illusory. Some of these products are legal, but many are not. In the midst of a slick sales pitch, almost no one reads the prolix printed warranty form. That is a mistake Dilbert's "confusopoly consultant" wants you to make. Now the Department of Insurance is clamping down.

For many years, car dealers have claimed that these after-market products do not qualify as insurance and they do not have to be licensed to sell them. That may change. On June 17, 2010, the California Department of Insurance issued a Cease and Desist order against Consumer Direct Warranty Services and related entities. You can read the Department's full press release here.

Some dealer service contracts fall within an exception to the insurance rules. However, in order to exploit that loophole, car dealers must follow certain procedures, have back-up insurance, provide cancellation rights and comply with other regulations.

"If you want to sell insurance in California, you must obtain a license, have adequate financial reserves and you must not deceive consumers," said Commissioner Poizner. "In order to protect California consumers, there are specific requirements for insurance companies seeking to do business in California. If companies do not abide by these requirements, they will not be permitted to sell insurance in our state."

The Insurance commissioner's website goes a step further to promote consumer protection. Check out its "Guide to Auto Service Contracts and Agreements" here. If you have purchased a service contract or extended warranty that does not comply with these rules, contact us even before your car breaks down.

They haven't made money on my policy.  My father took it out when he own the ML430 and just since he passed last April CDWS has paid over $4k in repairs. Seems like any insurance issue -- scam if you don't need it and great if you don't.

I just read you complaint letter regarding auto warranty company's scamming you. I had the exact same situation happen to me. I paid in full, filed a claim, was denied twice, ended up having to pay out of my pocket, had an attorney help me cancel and have been waiting for a refund since August 11, 2010. I just picked up a small claims packet. Its confusing to me. I want to know if I'm wasting my time with small claims, because I will never get my money back, basically they stole my money. I want to do something about, but don't know what i can do. On the small claims form, who am I sueing? Triple Warranty and CDWS? I have a PO Box address for CEO in Redding, but do I also have to get process server for Nevada? I need any help you can give me, anyone can give me. Thank you

I just read you messgae on complaint wire, and I am in the same situation. I have been waiting for a refund since August 11, 2010. I don't know what to do, basically they stole my money an I am pissed, because now I need that money for down payment for a new car. I work hard for my money, I don't have money, and i want to do whatever it takes to rectify my situation. I paid in full up front for the warranty, was denied when i put iin a claim twice, cancelled my warranty due to breach of contract, and was told that they weren't going to refund me, because it wasn't in the contract. Plese let me know what has happened with your quest for your refund, because I need any help I can get. I just picked up a small claims packet, but after reading everybodies complaints it seems like thats not even going to do. What can I do?

Good luck, To take someone to court, you need to find a live person. If one is found, he/she, should not be alive. I have been dealing with a computer "it" for the past two weeks and am about ready to implode. This outfit is one of the largest scam jobs I have ever seen, and it is nationwide. And, the perps are using many different named companies to hide behind. The BBB is on to them, and the state of Calif. is on to them. However, the State has only told them to stop being crooks, or else. Maybe if the CDWS moved it's crooked operations to Mexico, we may se justice.

I purchased this warranty in 2009, and just submitted paperwork and a $75. check to transfer this warranty to the new owner of my car.  I should get $1,500 back if there is no claim, at the end of the warranty.  They returned my check and information saying they needed all service information.  I was not filing a claim, just transferring to a new owner.  Now I cannot locate a number to call.
