Harassing Collection Calls
Complaint
Sharon Marsh
Country: United States
I am not sure that this is the name of the company because it is very difficult to understand the name of the company. This company has called me 2 times and left 15 minutes of messages on my answering machine. He repeats his name (which I cannot understand) and his phone number over and over again for 15 minutes.........I called them back the first time approximately a month ago and told him do not call again, and today I received the same 15 minute message. He is not calling for me, but and I am not going to put up with the harassment. The phone number that he give to call back is 1-800 -335-0872. I DO NOT WANT ANYMORE COLLECTION CALLS. I HAVE GOOD CREDIT AND I DO NOT CARE WHO HE IS CALLING FOR HE HAS NO RIGHT TO CONTINUE TO CALL AND HARASS ME! Please let me know what else I can do to get him to stop!

Both laws allow courts to award damages and attorney fees if you win, so look for an attorney willing to take your case on contingency.

Consumers are rightly concerned about strangers calling them on the phone and demanding their SSN. There are many con artists doing the same thing, even playing at "debt collector". Besides, having your SSN is no proof you owe some alleged debt anyway, particularly when you know you never had an account with the alleged creditor.
Debt collectors can obtain SSN information on anyone from Accuring or credit reports, and there are many reports that they attempt to use possession of a SSN as some sort of "proof" of a debt, when FDCPA requires that they notify consumers that they can dispute debts and request that validation (proof) be obtained from the original creditor.
Debt collectors who try to convince consumers disputing debts that having their SSN is "proof" are engaged in deception trying to evade the validation and dispute provisions of FDCPA.
The debt collection industry would like you to believe that somehow you have some obligation to make their job easier, even when you don't owe them, including compromising the security of your identification. The law says no such thing. On the contrary, it places numerous legal compliance obligations on them, due to years of abusive practices.
If you know you don't owe a debt, and you are being harassed by a debt collector, get an attorney, and let them do what they do for a living.

This fits the same profile as a number of other debt collectors who have been caught "cutting corners" with compliance, and the reported violations are likely to result in the defrauding of consumers.
Given the above pattern, you should be wary about paying any unrecognized or unsubstantiated "debts", and seek legal advice should violations or erroneous credit damage become a problem.
"Cutting corners" must have a cost.
Answer their call, and notify them that you are not the party they are trying to reach, and that they must cease calling your number.
Your cell phone records will document their call, so note the date and time of your request that they cease calling. Send a follow up letter, certified, indicating that you notified them to cease calling on <the call date>, that they are to cease calling your number.
If you have any further problems, file complaints with FTC, your state Attorney General, and the New Jersey Attorney General.
Then find an attorney to sue them for violating your FDCPA cease communications letter, and additional TCPA violations, which allow for penalties of up to $1500 per call for wilfull voilations.
And all they can land is a collection job calling people at the direction of a computer?
If you want it to stop permanently, there are two solutions:
1) Change your number (although you might get a new number with the same problem).
2) Send them notice in writing, that your number is not "Mr. Niles", and that they are to cease all calls to your number. If they don't, find an attorney to sue them, for violations of FDCPA and TCPA. It will help their memory.

It also sounds like there is some question as to whether your payments are even being credited toward paying down this alleged debt.

When they call my number:
1) A number from Wayne, PA appears on my phone (I am in the same area code)
2) They do not ask for me; they have asked for Betsy and Omar. Much to my surprise, they didn't know who Omar Sharif was. Haven't any of you seen Lawrence of Arabia?
3) When I called back (at the 484 area code number and 856), the 20 something woman who answered the phone was very rude. She said "Oh, we'll take that number off the list" and I had to tell her, "That's what you said last week." Then she asked for my name, phone number and social security number. I gave her the name they called for-Omar. This seemed to confuse her, but I refused to give her the other information.
4) I called there again. I told the person who answered, I was going to call them endlessly and annoy them the way they had been annoying me.
5) I called and asked to speak to a supervisor. I asked for the company Home address and this seemed to confuse her. I told her most companies have a "Home" office and other locations. I wanted the company "Home" Address; not hers. I did get it. (I'm not an elementary school teacher.)
6) I asked several people, "What does MRS do"? and no one seemed capable of answering the call. I told them what the voice message said when you call--Capital One (press 1), Auto Loan (press 2), Customer Service (press 3). I asked can I get Auto Insurance through MRS? No answer. They said they are a financial service company. I asked "What financial services do you provide?" They could/would not say.
If they are a collection agency, why not say it? Yes, I own some money and I am paying it off. Would I like to do it faster and in larger amounts? Yes, of course I would, who wouldn't? I'd also like to be Michelle Obama--she has a kick-ass wardrobe and a great hairstylist.
You know, generally (unless they are rude to me) I give the collector a break. I know they aren't the person I need to cuss. However, in this case I say make an exception.

Stop M.R.S. Associates Harassment
If you want to stop M.R.S. Associates harassment, you need to know what you're up against. One of the tactics debt collectors like M.R.S. Associates use is to send consumers misleading and fake documentation. It's illegal for a debt collector to use false representation, but many people don't realize that false representation isn't just when a debt collector assumes a false identity, but it also applies to documents related to the collection. This means that, whether M.R.S. Associates is dealing with you or calling someone you know in order to find you, M.R.S. Associates can't send a document that looks like (or says it is) an official court, governmental agency, or state document. The deceptive practice of falsifying documents is illegal across the board, but debt collectors' practices can be especially predatory. Debt collection agencies like M.R.S. Associates will often mail “official” looking paperwork to consumers, hoping that people will react to what they perceive are governmental documents.
When M.R.S Associates calls you, the debt collection agent must state who they are, and tell you that they are attempting to contact you regarding a debt. Remember that a debt collector from M.R.S. Associates can't pretend that he is an attorney, that he is a government official, or that he works for a credit reporting agency.
